(a)
No person shall hold, conduct, carry on or cause to be held,
conducted or carried on a community event as defined herein on any
public property or portion thereof owned or controlled by the City
without first having obtained a permit to do so pursuant to this article.
In order to obtain a permit, an application for same must be filed
with the Chamberlain's office no less than 30 days prior to the
scheduled date of such community event. The Chamberlain shall deliver
a copy of every such application to the City Administrator, the Chief
of Police, the Fire Chief, the Commissioner of Public Works, the Corporation
Counsel, the Councilmember in whose ward the event is to be held,
and any other department that may be affected by the issuance of a
permit. Approval by the City shall be given only upon satisfaction
of all City requirements imposed and conditions thereof and as required
hereunder, and may be revoked for failure to submit payment of the
fees and costs as specified by the City.
(b)
Application for a community event permit shall be made on forms
prescribed by the City for the particular type of community event
as set forth in this chapter. Application forms shall require, at
a minimum, the following information:
(1)
The correct name, mailing address, telephone number (including
cellular telephone number) and email address of the person sponsoring
the community event. If the applicant is a corporation, organization,
partnership, limited liability company or other association, the title
of the individual completing the application, as so authorized by
such entity, acting as the authorized representative of same.
(2)
The name of the person or persons in charge of organizing and
conducting the community event, and the name, title, mailing address,
telephone number (including cellular telephone number) and other contact
information of the person who shall be present at and with the operational
responsibility and authority to hold such community event. If the
applicant is a corporation, organization, partnership, limited liability
company or other association, the names, titles, telephone numbers
and other current contact information of the chief executive officer(s)
and other responsible persons in authority over same.
(3)
The total number of people invited and/or expected to participate
and to be present as attendees of the community event.
(4)
All locations (including specific City streets and City parks,
and portions thereof) requested to be used and the dates and hours
requested at each location for each such use.
(5)
The sanitary facilities, if required under this chapter, in
addition to any already existing and present at the proposed location(s),
which will be provided by the applicant or sponsor.
(6)
Whether live or recorded music shall be used at the community
event, and if so, a description thereof including any means of broadcast
and/or amplification.
(7)
Whether any labor by City employees is requested, and if so,
the kind or nature of the labor sought, and whether any City property
or equipment shall be requested to be used at the location(s) where
the community event will be held.
(8)
Whether any fees for participation and/or admission to the community
event are to be charged, and if so, the amounts and schedules of same.
(9)
Whether any vendors will be present at the community event,
and if so, the names, addresses, telephone numbers and other contact
information of each vendor, and the nature of the goods, merchandise,
food or wares to be displayed, distributed and/or sold at the community
event by such vendors.
(10) A description of the nature of the community event
and the reason why public property is to be utilized.
(11) Any provisions to be made or as may be required
by any law, rule or regulation to accommodate persons with disabilities.
(12) The date when the applicant and sponsor propose
to commence moving equipment for the event onto the site, and setting
up such equipment.
(c)
Permit applications shall be filed with the Chamberlain no later
than 30 days prior to the earliest date that the community event will
commence but in no case later than the time required by the City to
review same and to determine that all arrangements are satisfactory
and sufficient to protect the public health, safety and property.
The City may waive such requirement and accept filing of an application
after the deadline for same if the City Administrator determines that
such late filing shall not impair the City's ability to adequately
review the application and all arrangements necessary to hold the
community event as intended so as to safeguard the protection of public
health, safety and property by evaluating same according to the criteria
set forth in this chapter; however, the City shall have the right
to deny any such permit and prohibit such event due to the late filing
of an application or other material failure to comply with City requirements
as defined hereunder, including if such late filing shall have precluded
or significantly impaired the City's ability and opportunity
to evaluate said application as provided under this chapter.
(d)
In the case of a spontaneous or similar occurrence involving
an exercise of free speech such as a rally or gathering associated
with a contemporaneous occurrence or incident, an applicant or sponsor
of such event may, in lieu of filing an application for a permit under
this article, file a registration of event form with the Chamberlain,
if such gathering is expected to result in the disruption of traffic
or the disruption of the public's use of any public property
or way. This registration of event will notify the City of the nature
of such event, its location, the anticipated time at which it will
commence and end, the number of persons expected to participate, the
nature and extent of disruption of pedestrian traffic, vehicle traffic
and the public's use of property, and any other information the
Chamberlain and City Administrator deem relevant for the City to accommodate
such event. Such events shall be exempt from fees required by this
chapter, except that a fee may be imposed to pay the costs incurred
by the City for assigning police, fire or public works employees to
provide services made necessary in the judgment of the City Administrator
for such event.
