It shall be unlawful for a person(s) under 18 years of age to
remain in or upon the streets, alleys, parks or public places in the
Borough between the hours of 11:00 p.m., prevailing time, and 5:00
a.m. the next day, prevailing time, unless such child is accompanied
by a parent, guardian or other person having the legal custody of
such juvenile, or unless there is good and sufficient cause for such
child to be out after the curfew. The Chief of Police, or the officer
in charge of that particular police shift, shall have the discretion
to determine whether or not an unaccompanied child has good and sufficient
reason for being out after the curfew.
It is hereby made unlawful for any parent, guardian or other person having the legal care or custody of any of the children of the age above designated to allow or permit any such child, ward or other person under such age, while in such legal custody, to go or be in or upon any of the streets, alleys, parks or public places in said Borough after the time prohibited in §Â
153-1 of this chapter, except as herein provided.
Any child found to be in the above-designated places in violation
of this chapter shall be taken into custody by the Police Department,
and his or her parent, guardian or person having his or her legal
custody shall be notified to immediately report to the Police Station
for the purpose of determining whether or not a violation of this
chapter has occurred.
The officers of the Police Department, in taking persons into
custody under this chapter, will use their discretion in determining
age and, in doubtful cases, may require positive proof; until such
proof is furnished, the officer's judgment shall prevail.
