A. 
The Village of Greenville recognizes the importance and need of providing the Fire Department rapid entry into locked buildings. Delays in the Fire Department gaining rapid entry reduces the occupants' chances of survival in a fire, the chances for substantial property damage increase because of delays in gaining entry to the structure and firefighter safety and survival may be compromised because of said delays. Additionally, delays in providing prompt prehospital care to the sick and injured as a result of locked/secured structure may/will have a negative outcome on patient recovery.
B. 
To assist the Fire Department in gaining entry into locked/secured facilities/structure, the Village of Greenville hereby adopts a rapid entry system ordinance utilizing the Knox Box® rapid entry key box system.
A. 
The following structures shall be equipped with a key lock box at or near the main entrance or such other location required by the Fire Chief effective January 1, 2001:
(1) 
All commercial and industrial buildings. "Commercial and industrial building" shall mean buildings where any industry, trade or business is carried on or where any process or operation, directly or indirectly related to any industry, trade or business, is carried on and where any person is employed by another for direct or indirect gain or profit.
(2) 
Multifamily residential structures comprised of four or more units in which access to the building or common areas or mechanical or electrical rooms within the building is denied through locked doors.
(3) 
Any building or facility containing a quantity of hazardous materials, which would require compliance with Title III of SARA (Superfund Amendment Reauthorization Act).[1]

(4) 
Governmental structures.

Educational facilities.

All places of assembly.
B. 
All newly constructed structures subject to this article shall have the key lock box installed and operational prior to final inspection and occupancy. All existing buildings subject to this article shall have the key lock box installed and operational on or before January 1, 2005.
C. 
The Fire Chief shall designate the type of key lock box system to be implemented within the Village and shall have the authority to require all structures to use the designated system.
D. 
The owner or operator of a structure required to have a key lock box shall at all times keep keys in the lock box that will allow for access to the following:
(1) 
Keys to locked points of egress, whether on the interior or exterior of such buildings;
(2) 
Keys to locked mechanical equipment rooms;
(3) 
Keys to locked electrical rooms;
(4) 
Key to elevator controls;
(5) 
Keys to the other areas as directed by the Greenville Fire Department.
E. 
The Fire Chief shall be authorized to implement rules and regulations for the use of the lock box system.
All Knox Boxes® (and/or Knox® locking vaults) shall be recess-mounted into the building/structure at a height of not less than six feet above the ground (surface grade) nor more than eight feet above the ground (surface grade). The face plate of the Knox Box® shall be flush with the exterior facade of the structure/building. All Knox Boxes® (and/or Knox® locking vaults) shall be located directly above (or as close as reasonably possible to) the main entrance to the structure/building.
Enforcement of this article shall be accomplished through citations issued by the Fire Chief or his/her designee or by the Village of Greenville Building Inspector or Zoning Administrator.

Any violation of this article shall be punishable by a forfeiture that shall be set from time to time by ordinance in the Fine and Forfeiture Schedule of the Village of Greenville.[1] Each day the violation exists/continues shall be considered as a separate offense.

This article is adopted pursuant to authority conferred in § 101.14, Wis. Stats., and Chapter SPS 314, Wis. Adm. Code.
The Chief of the Greenville Fire Department shall be responsible for having all public buildings and places of employment within the Village of Greenville inspected for the purpose of ascertaining and causing to be corrected any conditions liable to cause fire or any violations of any law or ordinance relating to fire hazards or to the prevention of fires (Chapter SPS 314, Wis. Adm. Code).
Fire prevention inspections shall be conducted at least once in each nonoverlapping six-month period per calendar year, or more often if ordered by the Chief.
The scope of inspections and standards for inspections shall be as set forth in Chapter SPS 314, Wis. Adm. Code, which is incorporated herein.
A. 
Whenever necessary to make an inspection to enforce any of the provisions of this article, or whenever the Fire Chief or authorized representative has reasonable cause to believe that there exists in any building or upon any premises any condition which makes such building or premises unsafe, the Fire Chief or authorized representative may enter such building or premises at all reasonable times to inspect the building or premises or to perform any duty imposed upon the Fire Chief by this article.
B. 
If such building or premises is occupied, the Fire Chief or authorized representative shall first present proper credentials and demand entry. If such building or premises is unoccupied, the Fire Chief shall first make a reasonable effort to locate the owner or other persons having charge or control of the building or premises and demand entry. If such entry is refused, the Fire Chief or authorized representative shall have recourse to every remedy provided by law to secure entry.
C. 
If the owner or occupant denies entry, the Fire Chief or authorized representative shall obtain a proper inspection warrant or other remedy provided by law to secure entry. No owner or occupant or any other persons having charge, care or control of any building or premises shall fail or neglect, after proper request is made as provided herein, to promptly permit entry therein by the Fire Chief or authorized representative for the purpose of inspection and examination pursuant to this article.
Whenever an inspection reveals a fire hazard or the violation of any law or ordinance relating to fire hazards, or to the prevention of fires, the Fire Chief or authorized representative shall provide notice, in writing, upon the owner or occupant, giving the owner or occupant sufficient time to remove the hazard or abate the violation.

No person shall occupy or change the occupancy of any building or structure covered under Chapters SPS 361 to 366, Wisconsin Building Code, used for public assembly, industrial, institutional, multifamily (public spaces), office, or mercantile purposes, until the building or structure has been inspected.
The Fire Department shall make and keep records of all inspections, including the owner/occupant name, address, occupancy type, structural information, hazards, and all communications regarding the occupancy, including orders to comply or abate violations. Fire inspection reports shall be on a form provided by the Wisconsin Department of Safety and Public Services or on a form approved by the Village Board.
After each inspection, the Fire Chief shall make the report available to the Village Board. The Fire Chief and Fire Inspector may commence enforcement actions after notification to the Village Board.

Any owner or occupant that fails to comply with an order to comply or abate a violation of any applicable code or standard shall, upon conviction, be subject to a forfeiture in an amount listed in the Fine and Forfeiture Schedule that shall be set from time to time by ordinance by the Village of Greenville.[1] Each calendar day during which an owner or occupant fails to comply or abate shall constitute a separate offense.
