A. 
Owners and operators. No licensee holding a plenary retail liquor distribution license for on-premises or off-premises consumption shall allow any person to remove an opened original container of any alcoholic beverage or other open container containing any alcoholic beverage from the licensed premises.[1]

B. 
Individuals.
(1) 
No individual shall carry on his person an open alcoholic beverage in its original container or any alcoholic beverage in any other container on the streets, sidewalks or any other unlicensed area of the Borough of Milford.
(2) 
No individual shall carry an open alcoholic beverage in its original container or any alcoholic beverage in any other container in any motor vehicle while said motor vehicle is on the streets, parking areas or any other unlicensed area of the Borough of Milford.
C. 
Exceptions. The provisions of Subsections A and B shall not apply to any residential owner, lessor or guest of an owner or lessor of property carrying an open alcoholic beverage in its original container or any other container while said person is on the premises owned or leased by such person.
A. 
Licensee. Any licensee holding a plenary retail license for either on-premises or off-premises consumption of alcoholic beverages shall be strictly liable for any persons removing an alcoholic beverage from the licensed premises in either the opened original container or any other open container.
B. 
Person carrying beverage. In addition to the liability imposed on any licensee holding a plenary retail license for on-premises or off-premises consumption, the person carrying said alcoholic beverage shall also be in violation of this article.
In the event that any licensee shall provide live entertainment, on such evenings when live entertainment is supplied, the licensee shall have at least one private security guard to prevent disorder either within or without the licensed premises.
A violation of this article shall be punishable by a fine of not more than $500 or by imprisonment of not more than 30 days, or by both such fine and imprisonment, in the discretion of the court.
