Any property owner aggrieved by any right-of-way or roadway ditch condition may make application to the Village for alterations or improvements. The application shall include the date, name and address of the owner, and the nature of the condition. The application shall be reviewed by the Village Department of Public Works, and an investigation and inspection of the condition shall be made by the Department of Public Works. The inspection and investigation may include conditions on adjacent or neighboring properties.
The Village may approve improvements deemed necessary or desirable to ameliorate the condition, subject to the following guidelines and limitations:
A. 
There shall be no ditch filling or use of drain tile or drainpipes within one foot of any driveway or roadway culvert.
B. 
The extent of ditch filling, use of ditch liners, or use of rocks in ditches shall be limited as far as practicable because of impacts on water quality management. The Village may consider alterations and improvements previously made by adjacent property owners.
C. 
Any alteration or improvement in the right-of-way or roadway ditch shall require Village approval of detailed plans and shall require a Village permit. Any alteration or improvement inconsistent with the approved plan is unauthorized.
D. 
The approved alteration or improvement shall be made by the property owners at their expense.
The Village will only fund right-of-way and roadway ditch alterations and improvements which meet the following criteria:
A. 
There is a condition which poses an immediate threat (emergency) to public health and safety.
B. 
There is a condition which could pose a threat to public health and safety if left unresolved.
C. 
There is a condition which, when ameliorated, would benefit the area as a whole, rather than just one or a small group of property owners.
D. 
There is a condition which constitutes a material detriment to quality of life, that will continue to affect residents if not abated.
E. 
There is a condition which a property owner was required to ameliorate or abate, but failed to do so. The Village may seek cost recovery from the property owner.
F. 
There is a condition recognized as having a direct benefit to property owners, but which is an alteration or improvement that should be coordinated by the Village. The Village may seek full cost recovery from the property owners.
