Township of West Donegal, PA Article V Snow and Ice Emergency

§ 220-46 Definitions.

The following words, when used in this article, shall have the following meanings unless the context clearly indicates a different meaning:

SNOW

Any precipitation depositing any accumulation on the streets, including snow, sleet, hail, ice and freezing rain.

SNOW REMOVAL CONDITION

All snow accumulation of two inches or greater.

VEHICLE

Any self-propelled motorized vehicle licensed to travel upon the streets, roads and highways of the Township.

§ 220-47 Declaration of snow and ice emergency.

In order to facilitate the movement of traffic and to combat the hazards of snow and ice on the snow emergency routes named in § 220-49 this article, the Township Manager/Assistant to the Township Manager, in his/her discretion, may declare a snow and ice emergency (designated in this article as a "snow emergency"). Information on the existence of a snow emergency shall be given by West Donegal Township through radio, newspaper or other available media, and information on the termination of the emergency may be given by use of the same media.

§ 220-48 Prohibitions and restrictions during snow emergency and snow removal conditions.

During any snow removal condition or after any snow emergency is declared, it shall be unlawful at any time during the continuance of the snow emergency or snow removal condition for any person to:

A. Park a motor vehicle or allow that vehicle to remain parked anywhere designated in § 220-49 of this article.

B. Drive any motor vehicle on any snow emergency route unless that vehicle is equipped with snow tires or chains.

C. Deposit snow or ice on any Township road/street, whether or not such road/street has been plowed.

§ 220-49 Snow emergency routes and parking prohibition areas designated.

A. The following are designated as snow emergency routes:

	Miller Road	Route 241 and Stone Mill Road
	Nolt Road	Colebrook Road and Harrisburg Pike
	Rutts Road	Route 241 and West Ridge Road
	Stone Mill Drive	Maytown Road and Bossler Road
	West Ridge Road	Maytown Road and Miller Road
	Zeager Road	Market Street and the Township municipal boundary

B. The following streets or portions of streets are areas where parking is prohibited during any declared snow emergency or snow removal condition:

(1) All turnaround areas of cul-de-sac streets, including the entire diameter of a cul-de-sac bulb and the entire area of any hammerhead turnaround.

§ 220-50 Violations and penalties.

A. If, at any time during a period of snow emergency declared under § 220-47 of this article, a person shall park a vehicle or allow a motor vehicle to remain parked anywhere upon a snow emergency route, that person shall be guilty of a violation of this article and, upon conviction, shall be sentenced to pay a fine of not more than $100 plus costs.

B. If, at any time during a period of snow emergency declared under § 220-47 of this article, a person shall drive a vehicle upon a snow emergency route without having that vehicle equipped with snow tires or chains, that person shall be guilty of a violation of this article and, upon conviction, shall be sentenced to pay a fine of $ 100 plus costs.

C. At any time during a period of snow emergency declared under § 220-47 of this article, the owner of any vehicle that becomes disabled on any part of a snow emergency route that requires towing will be required to pay any and all costs associated with the towing.

D. In all cases where a police officer or parking enforcement agent first gives notice to a person of any violation of this article, either by personal service to the offending operator or by affixing to the vehicle in violation a ticket noting the date, time and location of the offense, nature of the offense charged, and license registration of the vehicle in violation, prosecution shall not be instituted for 72 hours thereafter. If, during said seventy-two-hour period, the offending operator voluntarily, either in person at the Police Department office or by mail, enters a plea of guilty and pays a penalty of $50 for violating any provision of this article, no prosecution for said offense shall thereafter be brought so long as the envelope is postmarked within 72 hours of the violation.
