The ground being and situated on Block Twenty (20) of the Original Plat of the City of Appleton City, Missouri, and bounded on the north by Fifth Street, on the west by Chestnut Avenue, on the south by Fourth Street, and on the east by Locust Avenue be and the same is hereby converted, set aside, and appropriated for a City park to be held and known as the City Park of the City of Appleton City, Missouri.

Every person who shall willfully and without the permission of the Mayor and the Board of Aldermen ride, drive, hitch or feed any horse, mule or other animal, ride or drive any automobile or other self-propelled vehicle in or upon the grounds of the City Park of Appleton City, Missouri, or in any way injure any trees, grass, building, or any other property growing or situated thereon by cutting, climbing, swinging, digging or otherwise shall be deemed guilty of an ordinance violation.

A. 
Definitions. As used in this Section, the following terms shall have the meanings indicated:
BUILDING
Free-standing structure enclosed by a floor, ceiling and walls on all sides that are continuous and solid except for closeable entry and exit doors and windows.
OPEN-AIR FACILITY
Structure that is not fully enclosed but may be partially enclosed (for example, structures with open sides).
SMOKING
Inhaling, exhaling, burning or carrying any lighted cigar, cigarette, pipe or tobacco like products in any manner or form.
B. 
Smoking Prohibited.
1. 
Parks. Smoking shall be prohibited at all times in all City of Appleton City public parks and playgrounds, including, without limitation:
a. 
Forest Park.
b. 
Donnohue Dugan Park.
c. 
Karlene May Park.
2. 
Smoking is prohibited at all parks and playground areas owned by the City and open to the public.
3. 
Smoking is prohibited in a building or open-air facility owned, leased or operated by the City of Appleton City.
C. 
At the entrance of each designated park, there shall be appropriated signage designating the prohibition.
D. 
Enforcement And Civil Penalties.
1. 
The Appleton City Police Department shall enforce this Section.
2. 
Any person observed violating this Section who has not been issued a written warning, shall be issued a verbal warning for a first offense.
3. 
Any person who has received a written warning and is observed violating this Section, shall be subject to a civil penalty of twenty-five dollars ($25.00) beginning with the second violation and not less than fifty-one dollars ($51.00a0 for each subsequent violation.
4. 
Appleton City Police Officers, City Code Officials, and the Parks Director shall have the authority to eject from a park facility any person observed violating this Section.
5. 
The name of any person issued a verbal warning shall be immediately reported to the Appleton City Police Department.

A. 
No person, without special permission from the Mayor or supervisor of the Appleton City swimming pool, shall enter said swimming pool or said swimming pool area between the hours of 8:00 A.M. and 9:00 A.M. or at any time when the said swimming pool is not open for operation.
B. 
No person shall break or otherwise injure or deface any gate, fence, building or other property of the swimming pool, or injure or molest in any manner or remove any property of any kind belonging to the City or to any other person and located in said swimming pool area.

A. 
There is hereby created within the City of Appleton City, Missouri, a Park Board, said Park Board to be formally known and designated as "Appleton City Park Board", and shall consist of nine (9) members each to serve a term of three (3) years. Members of the Park Board shall be appointed by the Mayor and confirmed by the majority of the Board of Aldermen of the City of Appleton City, Missouri, in a regular meeting of said Board.
B. 
The Park Board shall annually on or before, August fifteenth (15th), each year, submit to the Budget Officer and the Board of Aldermen of the City of Appleton City, Missouri, a budget and program plan for the new fiscal year starting the following October first (1st), to be incorporated with the City's annual budget and approved by the Board of Aldermen. All bills incurred by the Park Board will be approved by that body for payment from the separate Park Board Fund maintained by the City, and regular reports of status of that fund presented to the Park Board by the City Treasurer.
