As used in this Chapter, the following terms shall have the meanings set out herein:
ALARM SYSTEMS
Any single device or assembly of equipment designed to signal the occurrence of an illegal entry, existence of fire or other emergency activity requiring immediate attention and to which public safety personnel are expected to respond.
FALSE ALARM
An alarm signal requiring a response by public safety personnel when a situation requiring an immediate response does not in fact exist.
An alarm will not be considered a false alarm if it is determined that the alarm was caused by:
1. 
Natural or man-made catastrophe, or an act of God. Such events include tornadoes, floods, earthquakes or other similarly violent conditions.
2. 
Vandalism causing physical damages to the premises.
3. 
Electrical service interruption verified in writing by an authorized electric utility representative within seven (7) days of the occurrence.
4. 
Severe weather causing physical damage to the premises.
5. 
Attempted entry of a location causing visible, physical or other evidence of damage to the location.
GRACE PERIOD
After the effective date of this Chapter, December 6, 1990, false alarms reported, or caused to be reported, within the first thirty (30) days following installation of the alarm system shall not be considered for any purposes.
PUBLIC SAFETY PERSONNEL
Members of the Lake Tapawingo Police Department, Jackson County Sheriff's Department and the Central Jackson County Fire Department.

An alarm user shall be notified in writing of each false alarm determination.

It shall be unlawful to use an alarm system which reports, or causes to report, three (3) or more false alarms within a year.

A. 
Any person convicted of violating any provision of this Chapter shall be punished by a fine of not less than twenty-five dollars ($25.00) nor more than two hundred fifty dollars ($250.00).
B. 
Any person convicted of using an alarm system which reports, or causes to report, three (3) or more false alarms within a year, shall be fined in accordance with the following schedule:
1st offense
4th false alarm
$25.00
2nd offense
5th false alarm
$50.00
3rd offense
6th false alarm
$100.00
4th offense
7th false alarm
$125.00
5th offense
8th false alarm
$175.00
6th or any subsequent offense
$250.00
C. 
Each day of violation of any provision of this Chapter shall constitute a separate offense.
