The term "officer", whenever used in this Chapter,
shall include any person holding any situation under the City Government
or any of its departments, with an annual salary, or for a definite
term of office, other than clerical or professional staff or members
of the Police Department.

A.
Except
as may be provided otherwise by these ordinances, any full-time City
employee may be hired by the City of Chaffee regardless of the place
of said employee's residence, provided said employee shall establish
his/her residence within twenty-five (25) miles of the City limits
of the City of Chaffee, Missouri, within one (1) year of the date
of his/her employment.
B.
Unless
otherwise required by these ordinances, part-time employees of the
City of Chaffee shall not be subject to a residency requirement.

A.
All officers,
except the City Attorney and the City Engineer, shall be at least
twenty-one (21) years of age prior to taking office, a citizen of
the United States, and an inhabitant of the City for one (1) year
next preceding his/her election, and a resident of the Ward from which
he/she is elected six (6) months next preceding his/her election.
No person shall be elected or appointed to any office who shall at
the time be in arrears for any unpaid City taxes, or forfeiture or
defalcation in office.
The Mayor, with the consent and approval of a majority of the
members elected to the City Council, shall have power to appoint a
Street Commissioner and such other officers as he or she may be authorized
by ordinance to appoint.

A.
The employees of the City of Chaffee (excluding officers as defined in Section 115.010 of the City ordinances) shall be classified as follows:
1.
Full-time
employees are all employees who consistently work thirty-two (32)
or more hours per week and whose services are not limited in duration
and are filling approved and regularly funded positions, except seasonal
employees shall not be considered full-time employees.
2.
Part-time
employees shall include seasonal employees and individuals employed
on an interim basis or employed on a consistent basis less than thirty-two
(32) hours per week, or for a specific period of time as designated
and approved by the City Council.
B.
For purposes
of construing this Section, employees working for the City of Chaffee
in more than one (1) department shall combine hours worked on a weekly
basis for each such department within which they are employed to determine
their respective status as full-time or part-time employee.
C.
Part-time
employees as defined herein are not eligible for benefits except when
required by an appropriate retirement system, health insurance plan,
Social Security administration or specific provisions of any Section
of these ordinances specifically relating to part-time employees.
Such benefits shall include, but be not limited to, vacation, sick
days, holidays or bonuses.
D.
All officers of the City of Chaffee as defined in Section 115.010 of the City ordinances shall be entitled to benefits of full-time employees and such other additional benefits as may be specifically authorized for such officials by the Statutes of the State of Missouri or specific ordinances of the City of Chaffee except for the following officers: Mayor, Council members, Police Court Clerk, City Attorney, Building Inspector, Treasurer, Fire Chief, Assistant Fire Chief, Fire Department Captain, Fireman, and Building Commissioner who shall be eligible for only those benefits as described by ordinances of the City of Chaffee for each such specific position. Members of City boards and commissions and non-compensated positions shall not be considered employees of the City for the purposes of Chapter 115 of the City ordinances of the City of Chaffee.
Every officer of the City and his/her assistants, and every
Council member, before entering upon the duties of his/her office,
shall take and subscribe to an oath or affirmation before some court
of record in the County, or the City Clerk, that he/she possesses
all the qualifications prescribed for his/her office by law, that
he/she will support the Constitution of the United States, and of
the State of Missouri, the provisions of all laws of this State affecting
Cities of this class, and the ordinances of the City, and faithfully
demean himself/herself in office, which official oath or affirmation
shall be filed with the City Clerk. Every officer of the corporation,
when required by law or ordinance, shall, within fifteen (15) days
after his/her election or appointment, and before entering upon the
discharge of the duties of his/her office, give bond to the City in
such sum and with such sureties as shall be designated by ordinance,
conditioned for the faithful performance of his/her duty, and that
he/she will pay over all monies belonging to the City, as provided
by law, that may come into his/her hands. If any person elected or
appointed to any office shall fail to take and subscribe such oath
or affirmation, or to give bond as herein required, his/her office
shall be deemed vacant. For any breach of condition of any such bond,
suit may be instituted thereon by the City, or by any person in the
name of the City for the use of such person.

Any failure on the part of any City Officer to pay into the
Treasury of the City the balance found to be due from him/her to the
City, upon the adjustment of his/her account, shall cause a forfeiture
of his/her office, and such balance shall bear interest at the rate
of eight percent (8%) per annum from the time it should have been
accounted for, until it shall be paid into the Treasury, unless otherwise
provided by law or ordinance. The Mayor shall immediately order suit
to be brought in the proper court against the delinquent officer and
his/her sureties for such balance.
