DRIVEWAY
MOTOR VEHICLE
RESIDENTIAL PREMISES
YARD SALE
As used in this Chapter, the following
definitions shall apply:
A minor way commonly providing vehicular access from a street,
alley, or other easement or access, to an off-street parking space
on the residential premises.
Any self-propelled vehicle not operated exclusively on tracks.
A property that is improved with a residential dwelling or
dwellings.
A sale of used household and/or personal items. This term
includes, but is not limited to, garage sale, tag sale, and estate
sale.
B.
The City Clerk, or his/her designee, shall
be authorized to issue permits in compliance with this Chapter and
shall be authorized to develop and update permit applications to obtain
relevant information and/or documentation to show compliance with
the requirements of this Chapter.
A.
Yard Sale Permit Required. A yard sale
is permitted on any residential premises in the City following the
issuance of a yard sale permit, at no cost, by the City Clerk and
with the following conditions:
1.
Yard sales shall only be conducted
by a person or persons residing on the residential premises where
the yard sale is held.
2.
Temporary signs advertising the yard sale are only permitted in compliance with Chapter 430, Supplemental Uses and Regulations, Article IV, Signs, specifically Section 430.290(A)(4) and (5) and Section 430.300(A)(1).
3.
Not more than four (4) yard sales
shall be conducted per calendar year on any residential premises.

Each yard sale event conducted pursuant
to this Chapter shall only be permitted between the hours of 7:00
A.M. and 6:00 P.M. on any day of the week and shall not exceed more
than two (2) days within a seven-day period.
A.
Motor Vehicle Sales Permit Required. The
display of a motor vehicle for sale is permitted on a residential
premises after the issuance of a motor vehicle sales permit, at no
cost, by the City Clerk and with the following conditions:
1.
The motor vehicle displayed for sale
is titled and owned by a person residing on the residential premises
in which the motor vehicle is displayed for sale.
2.
The motor vehicle for sale shall
only be displayed on the driveway of the residential premises.
3.
The motor vehicle displayed for sale
must be operable, registered or currently licensed, and shall not
be in a state of major disassembly or disrepair, or in the process
of being dismantled.
4.
The motor vehicle sales permit shall
be displayed in either the window of the motor vehicle or in a window
of a dwelling on the residential premises and shall visible from the
street.
5.
The motor vehicle sales permit will
expire sixty (60) days from the date of issuance.
6.
Motor vehicle sales permits shall
be limited to no more than two (2) per residential premises per calendar
year.
