GENERAL REFERENCES

This article shall be known as the "Fairview Township Fire Hydrant Ordinance."
The purposes of this article are:
A. 
To provide for the health, safety and welfare of the residents of Fairview Township by insuring the efficient operation of Fairview Township's fire protection system;
B. 
To prohibit deceptive practices which would hamper the ability of Fairview Township firefighters to perform their duties.
For the purposes of this article, the following terms, phrases or words shall have the meaning ascribed to them in this section, except where the context in which the word is used clearly indicates otherwise.
NONFUNCTIONING FIRE ALARM
A device which purports to be a fire alarm or fire warning system which in fact is inoperative and cannot be used to warn of a fire in an emergency or otherwise.
NONFUNCTIONING FIRE HYDRANT
A fire hydrant which is not connected to any water system, well, or any other water source.
PERSON
Any individual, partnership, association, institution, cooperative enterprise, or any other legal entity whatsoever which is recognized by law as the subject of rights and duties. It shall also mean owner, lessee, or occupants of a residential dwelling, commercial establishment or institutional establishment. In any provisions of this article prescribing a fine, imprisonment, or penalty, or any combination thereof, the term "person" shall include the officer and directors of any corporation or other legal entity having officers and directors and the partners of any partnership or other legal entity having partners.
TOWNSHIP
Fairview Township, York County, Pennsylvania.
It is unlawful for any person to:
A. 
Maintain a nonfunctioning fire hydrant in a location which may be viewed from any point in a Township right-of-way.
B. 
Maintain a nonfunctioning fire alarm in any location which may be viewed from a Township right-of-way.

A. 
Any person, firm or corporation who is found to be in violation of any provision of this article shall pay a fine of not more than $600 on the first offense, $700 upon the second offense and $1,000 upon a third or each subsequent offense and/or undergo imprisonment for a term not to exceed 90 days. Each day's continuation of a violation of this article shall constitute a separate and distinct offense.
