Section 360.010 Riding On Motorcycles.

A person operating a motorcycle shall ride only upon the permanent and regular seat attached thereto and such operator shall not carry any other person nor shall any other person ride on a motorcycle unless such motorcycle is designed to carry more than one (1) person, in which event a passenger may ride upon the permanent and regular seat if designed for two (2) persons or upon another seat firmly attached to the rear or side of the operator and motorcycle must be equipped with footrests for passenger.

Section 360.020 Headgear Required — Motorcycles or Motortricycles.

A. 
Every person operating or riding as a passenger on any motorcycle or motortricycle, as defined in this Title, upon any highway of this City shall wear protective headgear at all times the vehicle is in motion. The protective headgear shall meet reasonable standards and specifications established by the Director of Revenue.
B. 
The penalty for failure to wear protective headgear as required by Subsection (A) of this Section shall be deemed an infraction for which a fine not to exceed twenty-five dollars ($25.00) may be imposed. Notwithstanding all other provisions of law and court rules to the contrary, no court costs shall be imposed upon any person due to such violation. No points shall be assessed pursuant to Section 302.302, RSMo., for a failure to wear such protective headgear.
C. 
Notwithstanding the foregoing provisions, this Section will not apply to the operation of any two-wheeled or three-wheeled device having an automatic transmission and a motor with a cylinder capacity of not more than fifty (50) cubic centimeters, which produces less than three (3) gross brake horsepower, and is capable of propelling the device at a maximum speed of not more than thirty (30) miles per hour on level ground.

Section 360.030 Requirements For Persons Leasing Such Vehicles.

A. 
It shall be unlawful for anyone to rent, lease or lend any motorcycle, motor scooter or motorbike to any person without first ascertaining that such a person or passenger is equipped with a safety helmet or headgear, the minimum standards for which have been determined by the Chief of Police as provided for in Section 360.020 above. If such person is not so equipped, he/she shall provide same before renting, leasing or lending any motorcycle, motor scooter or motorbike to such person.
B. 
Every motorcycle, motorbike or motor scooter leased, rented or loaned by any individual must have proper State registration.
C. 
No person shall rent, lease or lend any motorcycle, motor scooter or motorbike to any person without first ascertaining that such person possesses a valid State operator's license for the operation of a motor vehicle upon the public street.

Section 360.040 Requirement For Persons Operating Such Vehicles.

A. 
Except as otherwise provided for in this Section, no one shall operate any motorcycle, motor scooter or motorbike without possessing a valid State motorcycle license or endorsement.
B.
