A. 
A certain document, three (3) copies of which are on file in the office of the City Clerk of the City of Bolivar, being marked and designated as the International Building Code, 2021 Edition, including Appendix Chapters A, C, E, H, I, J and K, as published by the International Code Council, be and is hereby adopted as the Building Code of the City of Bolivar in the State of Missouri; for regulating and governing the conditions and maintenance of all property, buildings and structures; by providing the standards for supplied utilities and facilities and other physical things and conditions essential to ensure that structures are safe, sanitary and fit for occupation and use; and the condemnation of buildings and structures unfit for human occupancy and use and the demolition of such structures as herein provided; providing for the issuance of permits and collection of fees therefor; and each and all of the regulations, provisions, penalties, conditions and terms of said Building Code on file in the office of the City Clerk of the City of Bolivar are hereby referred to, adopted and made a part hereof, as if fully set out in this Article, with the additions, insertions, deletions and changes, if any, prescribed in Section 500.020 of this Article.
B. 
A certain document, three (3) copies of which are on file in the office of the City Clerk of the City of Bolivar, being marked and designated as the International Existing Building Code, 2021 Edition, as published by the International Code Council, be and is hereby adopted by the City of Bolivar in the State of Missouri; and each and all of the regulations, provisions, penalties, conditions and terms of said International Existing Building Code on file in the office of the City Clerk of the City of Bolivar are hereby referred to, adopted and made a part hereof, as if fully set out in this Article, with the additions, insertions, deletions and changes, if any, prescribed in Section 500.020 of this Article.

The following Sections of the Building Code adopted in Section 500.010 hereof are hereby revised:
Section 101.1. Insert: City of Bolivar.
Section 1612.3. Insert: City of Bolivar.

Section 3412.2. Insert: December 31, 2009.
Section 903.2.8. The following provisions are hereby added to and incorporated into Section 903.2.8:
Exception: Group R-2 dwellings in existing structures meeting all of the following conditions shall be permitted to comply with an NFPA 13D Residential Fire Sprinkler in the R-2 dwelling area:
1. This Exception shall only apply to Existing Structures at the time of adoption of this code provision.
2. Maximum of six (6) dwelling units per fire area.
3. Sprinkler Separations shall be provided from adjoining occupancies per current Edition of IBC (Table 508.4).
4. Integrated Smoke/Fire Alarm that automatically detects and initiates occupant notification in all habitable areas. Installed according to NFPA 72. (Residential dwellings and adjoining uses.)
5. Alarm shall be monitored and report directly to the jurisdictions dispatch. Monitoring shall also incorporate a flow alarm installed on the NFPA 13D sprinkler system serving any portion of the fire area.

A. 
Purpose And Intent. The intent of this Section is to provide for the issuance of building permits subject to the Building Code regulations of the City of Bolivar, Missouri, and to provide a schedule by which building inspection fees shall be calculated and assessed. The Building Inspector may approve or disapprove the issuance of a building permit in accordance with the following regulations.
B. 
Application Procedures.
1. 
Prior to the residential erection, construction, remodel or reconstruction of any residence or structure or any structural alteration of an existing residence or structure within the City of Bolivar, Missouri, an application for a building permit shall be submitted to the Building Department.
2. 
Commercial applications must be accompanied by three (3) complete sets of blueprints and one (1) set of building specifications all of which have been signed, sealed and dated by a professional architect or engineer, registered in the State of Missouri. Within fifteen (15) days of the submission of a pre-application for building permit with all applicable accompanying documentation, the Building Inspector shall calculate and determine a building inspection fee, plumbing inspection fee, mechanical inspection fee and electrical inspection fee in accordance with the provisions of Subsection (C) of this Section. A building permit may be issued provided the applicant has satisfied all conditions and requirements of the Building and Zoning regulations of the City of Bolivar, Missouri, and the applicant's payment of all inspection fees and building permit fees.
C. 
Inspection Fees. For purposes of this Subsection, the construction cost shall be equal to the building gross area within a structure or building multiplied by the appropriate square foot construction cost as specified on Schedule "B" of the schedule of residential and commercial fees and permit costs, as amended from time to time, on file in the office of the City Clerk. The permit fee multiplier shall be .00291 for residential and one- and two-family dwellings. The permit fee multiplier for all commercial structures and buildings shall be .00291 for the first five thousand (5,000) square feet, .00145 for the next twenty-five thousand (25,000) square feet and .00055 for any additional square footage over a total of thirty thousand (30,000) square feet.

As shown on Schedule "A" of the schedule of residential and commercial fees and permit costs, as amended from time to time, on file in the office of the City Clerk.
2. 
Plumbing Inspection Fees. The plumbing inspection fee for any structure or building shall be equal to twenty-five percent (25%) of the building inspection fee for said structure or building.
3. 
Mechanical Inspection Fees. The mechanical inspection fee for any structure or building shall be equal to twenty-five percent (25%) of the building inspection fee for said structure or building.
4. 
Electrical Inspection Fees. The electrical inspection fee for any structure or building shall be equal to twenty-five percent (25%) of the building inspection fee for said structure or building.
D. 
Certificate Of Occupancy. No structure or building erected, constructed or reconstructed or any structural alteration of an existing building or structure within the City of Bolivar, Missouri, shall be occupied or otherwise used until such owner of said structure or building is issued a certificate of occupancy by the Zoning Administrator and the Building Inspector.

Fee schedules for residential fees and permit costs and fee schedules for commercial fees and permit costs will be proposed by the City Administrator from time to time, with the advice and input of the Zoning Administrator, Building Inspector or Director of Public Works, as the City Administrator deems necessary. Such fee schedules, as proposed by the City Administrator, will not become effective until approved by a majority of the Board of Aldermen then voting on the question. Nothing herein will preclude the Board of Aldermen from establishing such fee schedules on its own initiative from time to time with a majority vote of the Board then voting on the question. The fee schedules pursuant to this Section will remain at all times on file with the City Clerk for public inspection.

Nothing in this Article or in the code hereby adopted shall be construed to affect any suit or proceeding impending in any court, or any rights acquired, or liability incurred, or any cause or causes of action acquired or existing, under any act or ordinance hereby repealed as cited in Section 500.040 of this Article; nor shall any just or legal right or remedy of any character be lost, impaired or affected by this Article.

All other ordinances or parts of ordinances in conflict herewith are hereby repealed.

A person commits the ordinance violation of "failure to comply with building codes" if he/she shall violate any provisions of the codes adopted pursuant to the provisions of this Article and as those codes may be modified from time to time. Failure to comply with building codes shall upon conviction be punishable by a fine not to exceed five hundred dollars ($500.00) or a term of incarceration not to exceed ninety (90) days or by both such fine and incarceration. Each day or fraction thereof that a person shall be in violation of the provisions of the Building Code or any supplements thereto shall be deemed a separate offense. In addition to all other penalties hereunder, the City of Bolivar may seek injunctive relief, either mandatory or prohibitory, to enforce compliance with the provisions of the Building Code and supplements thereto.
