A certain document, three (3) copies of which are on file in the office of the City Clerk of the City of Bolivar, being marked and designated as the International Residential Code, 2021 Edition, including Appendix Chapters AA, AB, AC, AD, AE, AG, AH, AM, AN, AO, AP, AR and AS, as published by the International Code Council, be and is hereby adopted as the Residential Code of the City of Bolivar, in the State of Missouri, for regulating and governing the construction, alteration, movement, enlargement, replacement, repair, equipment, location, removal and demolition of detached one- and two-family dwellings and multiple single-family dwellings (townhouses) not more than three (3) stories in height with separate means of egress as herein provided; providing for the issuance of permits and collection of fees therefore; and each and all of the regulations, provisions, penalties, conditions and terms of such Residential Code on file in the office of the City of Bolivar are hereby referred to, adopted and made a part hereof as if fully set out in this Article, with the additions, insertions, deletions and changes, if any, prescribed in Section 500.070 of this Article. Notwithstanding the foregoing provisions, Chapter 11 of the International Residential Code will retain 2009 standards for required insulation, three (3) copies of which will remain on file with the City Clerk of the City of Bolivar.

The following amendments to the International Residential Code, 2021 Edition, are hereby adopted:
R506.2.3 — Amend/Replace "10-mil" with "6-mil."
N1102.1.2 Greater increases to required thermal values of doors and windows.
Amend — Replace table with IRC 2009 values
N1102.1.3 Greater increases to required R-values of insulation and building envelope.
Amend — Replace table with IRC 2009 values. See note above.
N1102.4 Air leakage/blower door test requirement. Remove/Delete Section
N11104, N1105 & N1107 — Various additional building performance requirements. Remove/Delete Sections
E3606.5 Whole home surge protection required. Remove/Delete Section
E3902 — Expansion of GFCI (Ground Fault Circuit Interrupter) to 250 volt receptacles in various locations.
Recommendation, Amend: Add as follows: "Exception 250 volt receptacles do not require GFCI protection except in wet locations as defined by the National Electric Code."
E3902.5 — GFCI requirement expanded to finished basements. Remove/Delete Section
E3902.17 Arc Fault Requirements.
Amend: Section 3902.17 "Branch circuits that supply 120-volt, single phase, 15- and 20-ampere outlets installed in bedrooms and similar rooms or areas shall be protected by any of the following: Items 1-6 of 2021 IRC Section E3902.17 shall remain.

Nothing in this Article or in the code hereby adopted shall be construed to affect any suit or proceeding impending in any court, or any rights acquired, or liability incurred, or any cause or causes of action acquired or existing, under any act or ordinance hereby repealed as cited in Section 500.090 of this Article; nor shall any just or legal right or remedy of any character be lost, impaired or affected by this Article.

All other ordinances or parts of ordinances in conflict herewith are hereby repealed.

A person commits the ordinance violation of "failure to comply with building codes" if he/she shall violate any provisions of the codes adopted pursuant to the provisions of this Article and as those codes may be modified from time to time. Failure to comply with building codes shall upon conviction be punishable by a fine not to exceed five hundred dollars ($500.00) or a term of incarceration not to exceed ninety (90) days or by both such fine and incarceration. Each day or fraction thereof that a person shall be in violation of the provisions of the Residential Code or any supplements thereto shall be deemed a separate offense. In addition to all other penalties hereunder, the City of Bolivar may seek injunctive relief, either mandatory or prohibitory, to enforce compliance with the provisions of the Residential Code and supplements thereto.
