A certain document, three copies of which are on file in the office of the Borough of Middleburg, being marked and designated as the "International Property Maintenance Code/2018," as published by the International Code Council, Inc., be and is hereby adopted as the Property Maintenance Code of the Borough of Middleburg, Snyder County, Pennsylvania, for the control of buildings and structures as herein provided, and each and all of the regulations, provisions, penalties, conditions and terms of said International Property Maintenance Code are hereby referred to, adopted and made a part hereof as if fully set out in this Part, with the additions, insertions, deletions and changes, if any, prescribed in § 5-402 of this Part.

The International Property Maintenance Code/2018 is amended and revised in the following respects:

Section 101.1. Insert: [Borough of Middleburg].
2. 
Section 103.5. Insert: [fee schedule shall be adopted by resolution of the Borough Council].
3. 
Section 112.4. Insert: [$300] and [$1,000].
4. 
Section 302.4. Insert: [12 inches]. Additionally, insert: [A notice of violation issued pursuant to this section shall require the property owner to remediate the violation within five days of the notice of violation.]

Nothing in this Part or in the International Property Maintenance Code/2018 hereby adopted shall be construed to affect any suit or proceeding impending in any court, or any rights acquired, or liability incurred, or any cause or causes of action acquired or existing, under any act or ordinance hereby repealed as cited in § 5-406 of this Part, nor shall any just or legal right or remedy of any character be lost, impaired or affected by this Part.

If any section, subsection, sentence, clause or phrase of this Part is, for any reason, held to be unconstitutional, such decision shall not affect the validity of the remaining portions of this Part. The Borough of Middleburg hereby declares that it would have passed this Part, and each section, subsection, clause or phrase thereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses and phrases be declared unconstitutional.

This Part and the rules, regulations, provisions, requirements, orders and matters established and adopted hereby shall take effect and be in full force and effect immediately from and after the date of its final passage and adoption in accordance with laws and regulations.

Ordinance No. 327 of the Borough of Middleburg is hereby repealed, in its entirety, and all ordinances or parts of ordinances in conflict herewith are hereby repealed to the extent that they are in conflict herewith.

1. 
A violation of a provision of the code shall be a criminal summary offense and he enforced in accordance with the Pennsylvania Rules of Criminal Procedure and 8 Pa.C.S.A. § 3321(b)(2). The Borough Administrator/Secretary, Middleburg Borough Police Department and any duly appointed officer or agent shall have the authority to enforce this provision.
2. 
Three hundred dollars per offense per day shall be the minimum penalty or fine for violation of a provision of the code or failure to comply with any of the requirements of the code, and $1,000 per offense per day shall be the maximum penalty or fine, plus assessment of court costs and reasonable attorneys' fees.
