A. 
All industrial users shall file with the Town wastewater information as deemed necessary by the Superintendent and as further described in this article for the determination of compliance with this chapter, the Town SPDES permit and state and federal laws. Such information shall be provided by completion of a questionnaire supplied by the Superintendent and supplements thereto as may be necessary. The time period for submission of the requested information shall be stated on the questionnaire and failure to submit all requested information by the stipulated date will be a violation of this chapter unless prior written permission is obtained from the Superintendent.
(1) 
The Superintendent may request this information whenever it appears necessary for the enforcement of this chapter, the Town SPDES permit and any state or federal laws.
(2) 
The Superintendent will require, on an individual basis where it is deemed necessary, discharge monitoring reports. These will be required at intervals as specified by the Superintendent.
B. 
Required information.
(1) 
The information required in discharge monitoring reports may include, but not be limited to:
(a) 
Nature of process.
(b) 
Flow volume (daily, weekly or annual).
(c) 
Time and duration of discharge.
(d) 
Average and peak wastewater discharge rates, including daily, monthly and seasonal variations, if any.
(e) 
Mass emission rates.
(f) 
Site plans, floor plans, mechanical and plumbing plans and details to show all sewers and appurtenances by size, location and elevation.
(g) 
Description of activities, facilities and plant process on the premises, including all materials processes and types of materials which are or could be discharged.
(h) 
Each product produced by type, amount and rate of production.
(i) 
Number and type of employees and hours of work.
(j) 
Wastewater constituents and characteristics.
(k) 
Other information which relates to the generation of waste.
(l) 
Records of pretreatment data such as chemicals added or dates and method of cleaning and disposing of grease from grease interceptors.
(2) 
Such reports may also include the chemical constituents and quantity of liquid or gaseous materials stored on site even though they may not normally be discharged. The Superintendent will evaluate the data furnished by the user. Additional information shall be supplied as required by the Superintendent.
C. 
Compliance with pretreatment requirements. Persons required to pretreat wastewater shall, along with their discharge report, provide a statement, reviewed by an authorized representative of the user and certified to by a qualified person indicating whether applicable pretreatment requirements are being met on a consistent basis and, if not, describe the additional operation and maintenance or additional pretreatment required for the user to meet the pretreatment requirements. If additional pretreatment or operation and maintenance will be required to meet the pretreatment requirements the user shall submit a plan (including schedules) to the Superintendent. The plan (including schedules) shall be consistent with applicable conditions of the Town's SPDES permit, or other local, state or federal laws.
D. 
The Superintendent has the right to obtain wastewater samples as required to verify the reported discharge characteristics.
A. 
All industrial users who discharge or propose to discharge wastewaters to the wastewater treatment system shall maintain such records of production and related factors, effluent (discharge) flows, and pollutant amounts or concentrations as are necessary to demonstrate compliance with the requirements of this chapter and any applicable state or federal pretreatment standards or requirements.
B. 
Such records shall be made available upon request by the Superintendent. All such records relating to compliance with pretreatment standards shall be made available to officials of DEC or EPA upon demand. A summary of such data indicating the industrial user's compliance with this chapter and any regulations promulgated pursuant thereto shall be prepared and submitted to the Superintendent. Where not otherwise specified, such reports must be submitted at least annually. The Superintendent, on written notice, may require more frequent reports.
C. 
The owner or operator of any premises or facility discharging industrial wastes into the public sewer system shall, when required by the Superintendent, install at his own cost and expense suitable monitoring equipment to facilitate the accurate observation, sampling, and measurement of the wastewater. Such equipment shall be maintained in proper working order and kept safe and accessible at all times. The sampling, analysis and flow measurement procedures, equipment and results shall be subject at any time to inspection by the Town.
D. 
The monitoring equipment shall be located and maintained on the industrial user's premises outside of the building. When such a location would be impractical or cause any undue hardship on the user, the Superintendent may allow such facility to be constructed within the building or in the public street or sidewalk area, with the approval of the public agency having jurisdiction over such street or sidewalk, and located so that it will not be obstructed by public utilities, landscaping or parked vehicles.
E. 
Whether constructed on public or private property, the monitoring facilities shall be constructed in accordance with the requirements of the Superintendent and all applicable standards and specifications as required in this chapter.
A. 
Sampling requirements. In performing the measurements, tests and analyses on the characteristics of wastewater as required by this chapter, the sampling methods, locations, times, durations and frequencies are to be determined on an individual basis subject to approval by the Superintendent.
B. 
Analysis of industrial wastewaters. Laboratory analysis of industrial wastewater samples shall be performed in accordance with the current edition of "Standard Methods for the Analysis of Water and Wastewater" published by the American Public Health Association or the "Annual Book of Standards, Part 23, Water, Atmospheric Analysis" published by the American Society for Testing and Materials. Analysis of those pollutants not covered by these publications shall be performed in accordance with procedures established by the New York State Department of Environmental Conservation.
C. 
Testing laboratory. The measurements, tests and analyses required by this chapter shall be performed by a laboratory certified by DEC.
A. 
All information and data on a user obtained from reports, questionnaires and monitoring programs from the inspections shall be available to the public or other governmental agency without restriction unless the user specifically requests on the questionnaire and is able to demonstrate to the satisfaction of the Superintendent that the release of such information would divulge information processes or methods which would be detrimental to the user's competitive position.
B. 
When requested by the person furnishing a report, the portions of a report which might disclose confidential information, trade secrets or secret processes shall not be made available for inspection by any person without providing the owner with the opportunity to protect such information, including the right to seek judicial review; provided, however, that such portions of a report shall be available for use by the state or any state agency in judicial review or enforcement proceedings involving the person furnishing the report. Wastewater constituents and characteristics will not be recognized as confidential information.
