A. 
The duties of the Department of Law shall include:
1. 
Representing the City in all matters in which it is a party or is interested;
2. 
Conducting all suits, actions and proceedings on behalf of the City, including prosecuting all violations of City ordinances;
3. 
Advising the Council or any members thereof, the Mayor, department heads, administrative personnel, and boards and commissions of the City concerning any legal questions affecting the City's interest;
4. 
Drafting proposed ordinances upon request of the Council, any member thereof or the Mayor;
5. 
Preparing or approving as to legal form all contracts, deeds, bonds and other documents to be signed in the name of or made to, by, with or for the benefit of the City;
6. 
Attending all Council meetings;
7. 
Maintaining a system of revision and codification of City ordinances;
8. 
Performance of such other legal duties as may be required by the Council or Mayor.

The Department of Law shall be headed by the City Attorney who shall be a licensed member of the Bar of the State. He/she shall be appointed by the Mayor upon approval of two-thirds (2/3) of the members of the Council. His/her duties and compensation shall be fixed by ordinance.

The Council may employ special counsel as it deems necessary and shall fix the duties and compensation of such special counsel by ordinance.

The Department of Prosecuting Attorney shall be headed by the Prosecuting Attorney who shall be a licensed member of the Missouri Bar. He/she shall be appointed by the Mayor. His/her duties and compensation shall be fixed by ordinance.

The Prosecuting Attorney shall represent the City in the prosecution of all violations of City ordinances in the City's Municipal Court as well as all appeals and jury trials of such prosecutions in the State court, except as otherwise directed by the Mayor. The Prosecuting Attorney may appoint such assistants as the duties of his/her office may require.
