The Mayor with the approval of a majority of the members of
the Board of Aldermen shall appoint a Chief of Police who shall perform
all duties required of the Marshal by law and any other Police Officers
found by the Board of Aldermen to be necessary for the good government
of the City. The Chief of Police shall be twenty-one (21) years of
age or older.

A.
The Police
of the City may be appointed in such numbers, for such times and in
such manner as may be prescribed by ordinance. They shall have power
to serve and execute all warrants, subpoenas, writs or other process
and to make arrests in the same manner as the Chief of Police. They
may exercise such powers in areas leased or owned by the municipality
outside the boundaries of such municipality. The Chief of Police and
Policemen shall be conservators of the peace and shall be active and
vigilant in the preservation of good order within the City.
B.
The Chief
of Police, in his/her discretion, may utilize reserve officers and
other volunteers depending on the need of the department and the effective
use of such volunteer services. Any reserve officers or other volunteers
utilized by the Police Department shall not be considered employees
of the City and shall not receive compensation.
The Board of Aldermen of the City may by ordinance enter into
a contract or agreement with any other political subdivision for the
provision of police services by one political subdivision to another
on request as provided for in Section 70.815, RSMo. The terms "Chief of Police", "Police", "Police Officer" and "Police Department", as used herein, shall refer
to Law Enforcement Officers of the contracting entity.

A.
All Peace
Officers employed by the City of Edmundson who have completed the
basic police training program as promulgated by Chapter 590, RSMo.,
shall have the authority to respond to an emergency situation outside
the boundaries of the City of Edmundson.
B.
As used
in this Section, "emergency situation" means any
situation in which the Police Officer has a reasonable belief that
a crime is about to be committed, is being committed, or has been
committed involving injury or threat of injury to any person, property,
or governmental interest and his/her response is reasonably necessary
to prevent or end such emergency situation or mitigate the likelihood
of injury involved in such emergency situation. The determination
of the existence of any emergency situation shall be in the discretion
of the Peace Officer making the response or in the discretion of a
Peace Officer or governmental officer of the political subdivision
in which the emergency situation is alleged to be occurring.
C.
As used
in this Section, "response" shall mean to take any
and all actions which the Peace Officer may lawfully take as if exercising
his/her powers within the City of Edmundson.
D.
The City
of Edmundson also authorizes Peace Officers meeting the above requirement
who are employed by the City of St. Ann or by the City of Woodson
Terrace to respond to emergency situations alleged to be occurring
within the City of Edmundson.
E.
In addition to the emergency response powers prescribed in Subsection (A) of this Section, any Peace Officer who has completed the basic peace training program pursuant to Chapter 590, RSMo., may arrest persons who violate any provision of State law.
F.
In addition to the powers prescribed in Subsections (A) and (E) of this Section, Section 544.216, RSMo., and any other arrest powers, a Law Enforcement Officer, may arrest on view, and without a warrant, at any place within this State, any person the officer sees asserting physical force or using forcible compulsion for the purpose of causing or creating a substantial risk of death or serious physical injury to any person or any person the officer sees committing a dangerous felony as defined in Section 556.061, RSMo. Any such action shall be deemed to be within the scope of the officer's employment.

A.
The Chief
of Police shall implement and maintain such policies, procedures and
general orders governing the functioning of the Police Department.
B.
The policies
and general orders shall cover the role and responsibility of the
department, personnel, administrative matters, property and materials,
field operations, investigative process, information systems, communication
systems, and support systems.
C.
Nothing
in this Section shall prevent the Police Chief or Board from adopting
additional regulations which may become necessary to adopt from time
to time.
D.
In the
event that any portion of the policies and general orders are in conflict
with an ordinance of the City of Edmundson, any Statute of the State
of Missouri, or any Federal Statute or constitutional provisions,
then the ordinance, Statute or constitutional provisions shall prevail
over the policies and general orders.

A.
Cataloguing And Keeping By Police Department. All unclaimed
property other than money or cash coming into the possession of the
Police Department from any source whatever and having any value shall
be properly marked or catalogued so as to show its source and date
of its receipt and shall be kept and disposed of as provided in this
Section.
B.
Annual Sale, Notice Of Sale Of Unclaimed Property In Possession Of
The Police Department — Disposition And Sale Of All Such Property
No Longer Used, Needed Or In Service By The City Of Edmundson. A date to be established by the Board of Aldermen at the April regular
Board meeting for a public auction during the month of June of each
year for the sale of all property which has remained unclaimed for
more than one (1) year, and the owner of which is unknown, shall be
sold at public auction by the Chief of Police and/or his/her assistant
at a suitable place at the City Hall. Any and all property no longer
used, needed or in service by the City of Edmundson may also be included
in said auction. Ten (10) days' notice of such sale shall be published
in a newspaper of general circulation in the City. Such notice shall
be published not more than three (3) weeks prior to the date of sale.
C.
Disposition Of Revenues From Sale, Destruction Of Unsold Items. All money received from the sale of unclaimed property in possession
of the Police Department and/or City property shall be turned over
to the City Treasurer to be deposited in the General Revenue Fund
of such City. All unclaimed property in the possession of the Police
Department, and property owned by the City of Edmundson for which
no bid has been received, shall be destroyed by the Chief of Police
and/or his/her assistant and City Treasurer in the presence of one
(1) member of the Police Department and one (1) Alderman and a certificate
of such destruction, signed by the Chief of Police and/or his/her
assistant, Alderman, Treasurer and Police Officer present, shall be
filed with the City Clerk.
D.
Disposition Of Unclaimed Money. All money or cash coming
into the possession of the Police Department from any source whatever
which has remained unclaimed and the owner unknown for a period of
at least one (1) year shall be turned over to the City Treasurer and
a record thereof kept by him/her. Should the ownership of the money
or cash be established within a period of five (5) years from the
date of its receipt, then the Treasurer shall turn the same over to
the owner. After a period of five (5) years it shall become a part
of the General Revenue Fund of the City.
E.
Any person claiming to be the owner of any impounded property as provided for herein shall make written application therefore to the Police Department on forms furnished by said department. Such person shall furnish such additional proof as may be required to establish such ownership. If he/she shall present to such department such proof of ownership of the unclaimed property prior to the date of actual sale pursuant to Subsection (B) herein, the property shall be delivered to the owner.
