A. 
It shall be unlawful for any person, firm or corporation to sell, possess, offer for sale, expose for sale, use, discharge or explode within the City any consumer fireworks or special fireworks as defined in Section 320.106, RSMo., except as provided in Subsection (B); provided however, that the term "fireworks" shall not include toy pistols, toy canes, toy guns or other devices in which paper caps are used containing not in excess of an average of twenty-five hundredths (.25) of a grain of explosive compound per cap. The sale, possession and use of such caps shall be permitted at all times.
B. 
Exceptions. Nothing contained in this Section shall prohibit the sale, possession or use of sparklers, colored flares, cylindrical fountains with a handle, base or spike which do not emit balls or a globe of fire, colored cone of fire, box fire and torches, wheels, magic snakes, cone fountains and colored mines and shells not designated to produce an audible effect; or the sale, possession and use of blank cartridges for theatrical purposes, for signal purposes at athletic contests or sporting events; or items for the use of police or military organizations; or flares used by railroads or other public or private transportation agencies for signaling purposes. In addition thereto, nothing contained in this Section shall prohibit any resident wholesaler, dealer or jobber from possessing fireworks for the purpose of selling at wholesale, provided said fireworks are delivered or shipped directly outside that portion of the City for which this Section is applicable; nor shall this Section prohibit the sale, possession or use of fireworks for pyrotechnic displays given by any organization, amusement park, officials in charge of a public park or group of individuals, provided that they have first obtained a permit from the City.
C. 
Permits For Display. Permits for pyrotechnic displays shall be issued by the Board of Aldermen, and all applications for such display permits shall be filed with the City Clerk for the attention of the Board of Aldermen not less than thirty (30) days prior to the effective date of the permit. Before issuing said permit, the Board of Aldermen shall investigate the application and upon a finding that the public safety will not be endangered, shall direct the City Clerk to issue a permit.
D. 
Permits For The Sale Of Fireworks. Permits for the sale of the types of fireworks designated and described in Subsection (B) shall be issued by the City Clerk. Each selling outlet or location shall require a permit which shall be displayed at such location in a prominent place visible to the public. The charge for such permit shall be twenty-five dollars ($25.00) which shall be collected at the time of the issuance of the permit by the City Clerk and shall be paid into the General Revenue Fund.
E. 
When Sale Permitted. No person, firm or corporation shall sell, offer for sale or expose fireworks for sale to individuals at retail before the twenty-fifth (25th) day of June or after Midnight on the sixth (6th) day of July of any year.
F. 
Interference With Inspection Or Testing. The City Clerk and the duly authorized personnel of his/her office or any Policeman of the City shall have the right to enter into and shall have full access to all places, buildings and conveyances wherein fireworks are produced, stored, transported or kept for sale, and shall have full power of inspection and testing of all fireworks in the possession, custody or under the control of any person. Any person who willfully or intentionally interferes with the City Clerk or any of the duly authorized personnel from the Clerk's office or with any Police Officer of the City in the performance of any duty enjoined by this Section shall be guilty of a violation of the terms and provisions of this Section and, upon conviction of such offense, shall be punished as hereinafter provided for.
G. 
Penalty For Violation. Any person, firm or corporation violating any of the provisions of this Section shall be deemed guilty of an ordinance violation.
H. 
Other Laws Applicable. Nothing contained herein shall be construed so as to relieve any person, firm or corporation from the application of any other laws or ordinances of the City of Edmundson, as the same may apply thereto.

A. 
It shall be unlawful for any person to smoke or use tobacco products within any public building located in the City of Edmundson. For purposes of this Chapter, "tobacco product" means any substance containing tobacco leaf, including, but not limited to, cigarettes, cigars, pipe tobacco, snuff, chewing tobacco or dipping tobacco.
B. 
It shall be unlawful for any person to smoke or use tobacco products within any vehicle owned by the City of Edmundson.
C. 
Any person who violates this Section shall be fined in accordance with the general sentencing provisions of the Code of the City of Edmundson.

A. 
All so called "garage sales" or "yard sales" or other sales involving the offering for sale of multiple items of personal property on property zoned and occupied as a residence shall be subject to the following rules and regulations:
1. 
No one shall accept or take in for sale any goods from any commercial business or enterprise on a consignment basis.
2. 
The property owner may install one (1) sign advertising sale on the residential lot on which such sale is to be held and one (1) sign on a corner property providing permission is obtained from property owner. Said signs shall not exceed two (2) feet by three (3) feet. Such signs shall be erected not sooner than one (1) day prior to the date of the sale, and shall be removed at the end of the last day upon which sale is held. Both signs shall identify the name and address of the property owner holding the sale.
3. 
Not more than four (4) such sales per annum shall be held at the premises if occupied by the same family or any member of such family.
4. 
Any sale conducted pursuant to the provisions hereof shall be confined to the period between 8:00 A.M. and 6:00 P.M. of any day and shall not extend in excess of two (2) days within the same week, but not necessarily consecutive days.
B. 
Any person violating any of the provisions of this Section shall be deemed guilty of an ordinance violation and, upon conviction thereof, shall be punished in accordance with Section 100.220 of the Code of the City of Edmundson.
