Editor's Note — Ord. no. 833 ch. one — ch. eleven, adopted September 13, 2005, repealed sections 500.010 "adoption of international building code 2000", 500.020 "adoption of international plumbing code", 500.030 "adoption of international residential code 2000 for one- and two-family homes", 500.040 "international mechanical code 2000", 500.050 "adoption of international fire code 2000", 500.060 "adoption of national electric code 1999" and 500.070 "penalty" and enacted the provisions set out herein. Section 500.010 International Building Code.

A. 
A certain document, being marked and designated as the "International Building Code, 2009 Edition", including Appendix Chapters A, C, G and I as published by the International Code Council, one (1) copy of which is on file in the office of the City Clerk of the City of New Haven, be and is hereby adopted as the Building Code of the City of New Haven in the State of Missouri for regulating and governing the conditions and maintenance of all property, buildings and structures; by providing the standards for supplied utilities and facilities and other physical things and conditions essential to ensure that structures are safe, sanitary and fit for occupation and use; and the condemnation of buildings and structures unfit for human occupancy and use and the demolition of such structures as herein provided; providing for the issuance of permits and collection of fees therefor; and each and all of the regulations, provisions, penalties, conditions and terms of said Building Code on file in the office of the City Clerk of the City of New Haven are hereby referred to, adopted and made a part hereof, as if fully set out in this Section, with the additions, insertions, deletions and changes prescribed in Subsection (B) of this Section.
B. 
Amendments. The following Sections are hereby amended as shown:

101.1 Title. Insert: "City of New Haven" for "Name of Jurisdiction".

101.4.6 Energy. Delete this Section in its entirety.

Add new Section: 907.11.5.1 Where required. In use groups R-2, R-3, R-4 and I-1, which relies on fuel gas or combustible liquid or wood burning appliance for heat, ventilation or hot water or has a garage attached to the structure, shall be equipped with at least one (1) approved carbon monoxide detector alarm in operating condition within fifteen (15) feet of every room used for sleeping purposes.
Add new Section: 907.11.5.2 Responsibility. It is the responsibility of the owner of the premises to supply and install all required carbon mosoxide detectors to manufacturer's specification. It is the responsibility of the tenant to test and provide general maintenance for the detectors and to notify the owner or authorized agent of the owner in writing of deficiencies that the tenant cannot correct. The tenant shall provide the owner or the authorized agent of the owner with access to the premises to correct any deficiencies in the carbon monoxide detector that has been reported.
Add new Section: 907.11.5.3 Type of alarm. The required carbon monoxide detector(s) shall be one of the following: 1. In new construction, required carbon monoxide detectors shall receive their primary power from the building wiring where such wiring is served from a commercial source and shall be equipped with a battery back-up. 2. In existing structures, carbon monoxide detectors may be AC power plug-in unit with battery back-up, or can be battery operated unit.

C. 
Penalties. Any person violating any provision of this Section or any of the codes adopted in this Section shall be deemed guilty of a misdemeanor and upon conviction thereof shall be fined in an amount not exceeding five hundred dollars ($500.00) or be imprisoned in the City or County Jail for a period of not exceeding ninety (90) days, or both such fine and imprisonment. Each day such violation is committed or permitted to continue shall constitute a separate violation.

Section 500.020 International Residential Code.

A certain document, being marked and designated as the "International Residential Code, 2009 Edition," including Appendix Chapters A, B, C, E, G, H, J, N, P and Q as published by the International Code Council, one (1) copy of which on file in the office of the City Clerk of the City of New Haven, be and is hereby adopted as the Residential Code of the City of New Haven in the State of Missouri for regulating and governing the construction, alteration, movement, enlargement, replacement, repair, equipment, location, removal and demolition of detached one- and two-family dwellings and multiple single-family dwellings (town houses) not more than three (3) stories in height with separate means of egress as herein provided; providing for the issuance of permits and collection of fees therefor; and each and all of the regulations, provisions, penalties, conditions and terms of said Residential Code on file in the office of the City Clerk of the City of New Haven are hereby referred to, adopted and made a part hereof, as if fully set out in this Section, with the additions, insertions, deletions and changes prescribed in Subsection (B) of this Section.
B. 
Amendments. The following Sections are hereby revised and amended:
1. 
R101.1 Title. Insert "City of New Haven" for "Name of Jurisdiction".
2. 
R105.2 Work Exempt from permit. Delete the following: Building subsection 1, subsection 2 and subsection 10.

R-202 Definitions. Add the following: Balcony, Exterior—An exterior floor projecting from and supported by a structure without additional independent supports.
Add the following: Decks — An exterior floor system supported on at least two opposing sides by adjoining structure and/or posts, piers or other independent supports.
Add the following: Confined Space — A room or space having a volume less than 50 cubic feet per 1,000 Btu/h (4.83L/W) of aggregate input rating of all fuel-burning appliances installed in that space.
Add the following: Unconfined Space — A space having a volume less than 50 cubic feet per 1,000 Btu/h (4.83L/W) of aggregate input rating of all fuel-burning appliances installed in that space.
Rooms communicating directly with the space in which the appliance is installed, through openings not furnished with doors, are considered a part of the unconfined space.
Add the following: Unusually Tight Construction — Construction meeting the following requirements: 1. Walls comprising the building thermal envelope have a continuous water vapor retarder with a rating of 1 perm [57.4ng/(s.m2.Pa)] or less with opening therein gasketed or sealed. 2. Doors and openable windows meet the air leakage requirements of IECC Section 502.1.4.1; and 3. Caulking or sealants are applied to areas such as joints around windows and door frames between sole plates and floors, between wall-ceiling joists, between wall panels, at penetrations for plumbing, electrical and gas lines, and at other openings.
5. 
Table R-301.2(1) Climatic and Geographic Design Criteria. Add new table as set out in Attachment 1 to this Chapter.[1]

It is the responsibility of the occupant of the dwelling unit to test and provide general maintenance for the detector(s) and to notify the owner or authorized agent of the owner in writing of any deficiencies that the occupant cannot correct. The occupant shall provide the owner or authorized agent with access to the dwelling unit to correct any deficiencies in the carbon monoxide detector(s) that have been reported.
17. 
R-317.1 Location required. Change subsection 2 to read as follows: "All sills or plates that rest on concrete or masonry slabs".

Motor vehicles
a. Except as provided for in other regulations, no inoperable motor vehicle or unlicensed vehicle of any kind shall be parked, kept or stored on any premises, and no vehicle shall at any time be in a state of major disassembly, disrepair, or in the process of being stripped or dismantled. Nothing in this Section shall apply to a vehicle which is stored within a completely enclosed building. Painting of vehicles is prohibited unless conducted inside an approved spray booth.
Exception: A vehicle of any type is permitted to undergo major overhaul, including body work, provided that such work is performed inside an enclosed building designed and approved for such purposes.
b. For purposes of this Section, a "vehicle" is defined as any machine propelled by power other than human power designed to travel along the ground or over water, including, but not limited to, automobiles, trucks, trailers, motorcycles, tractors, boats, buggies and wagons or any part thereof.
