Section 715.010 Collection and Disbursements.

A. 
The user charge system shall generate adequate annual revenues to pay the costs of annual operation and maintenance including replacement and to pay the costs of debt obligations associated with financing the water system.
B. 
That portion of the total user charge collected which is designated for the operation and maintenance including replacement purposes shall be deposited in a separate non-lapsing fund known as the Operation, Maintenance and Replacement Fund and will be kept in two (2) primary accounts as follows:
1. 
The Operation and Maintenance Account shall be an account designated for the specific purpose of defraying operation and maintenance costs (excluding replacement) of the water system.
2. 
The Replacement Account shall be an account designated for the purpose of ensuring replacement needs over the useful life of the water system. Deposits in the Replacement Account shall be made at least annually from the replacement revenue in the amount of thirty-four thousand one hundred ninety-six dollars ($34,196.00).
C. 
Fiscal year-end balances in the Operation and Maintenance Account and the Replacement Account shall be carried over to the same accounts in each subsequent fiscal year and shall be used for no other purposes than those designated for these accounts. Monies which have been transferred from other sources to meet temporary shortages in the Operation, Maintenance and Replacement Fund shall be returned to their respective accounts upon appropriate adjustment of the user charge rates for operation, maintenance and replacement. The user charge rate(s) shall be adjusted such that the transferred monies will be returned to their respective accounts within the fiscal year following the fiscal year in which the monies were borrowed.

Section 715.020 Rate Structure.

A. 
Each user shall pay for the services provided by the City based on their use of the water system as determined by water meter(s) acceptable to the City.
B. 
All monthly user charges will be based on monthly water usage. This usage shall be determined by the individual water meter.
C. 
The schedule of water rates as previously adopted by Ordinance No. 943 is hereby amended and shall be replaced with the user charges as hereinafter provided.

D. 
For the period beginning May 1, 2014, and running through June 30, 2015, for users located within the corporate limits of the City of New Haven, the following user charges shall apply, per month:

1. 
The minimum charge for all users shall be eight dollars and zero cents ($8.00).
2. 
In addition each user shall pay a user volume charge as follows:
a. 
For the first zero (0) to three thousand (3,000) gallons, or portion thereof: two dollars and thirty-five cents ($2.35) per one thousand (1,000) gallons.
b. 
For the next seven thousand (7,000) gallons, or portion thereof: three dollars and fifty-five cents ($3.55) per one thousand (1,000) gallons.
c. 
For the next forty thousand (40,000) gallons, or portion thereof: two dollars and seventy-five cents ($2.75) per one thousand (1,000) gallons.
d. 
For the next fifty thousand (50,000) gallons, or portion thereof: two dollars and five cents ($2.05) per one thousand (1,000) gallons.
e. 
For every one thousand (1,000) gallons thereafter, or portion thereof: one dollar and fifty-five cents ($1.55) per one thousand (1,000) gallons.
E. 
For the period beginning July 1, 2015, and running through June 30, 2016, for users located within the corporate limits of the City of New Haven, the following user charges shall apply, per month:

1. 
The minimum charge for all users shall be eight dollars and zero cents ($8.00).
2. 
In addition each user shall pay a user volume charge as follows:
a. 
For the first zero (0) to three thousand (3,000) gallons, or portion thereof: two dollars and forty cents ($2.40) per one thousand (1,000) gallons.
b. 
For the next seven thousand (7,000) gallons, or portion thereof: three dollars and sixty-two cents ($3.62) per one thousand (1,000) gallons.
c. 
For the next forty thousand (40,000) gallons, or portion thereof: two dollars and eighty-one cents ($2.81) per one thousand (1,000) gallons.
d. 
For the next fifty thousand (50,000) gallons, or portion thereof: two dollars and ten cents ($2.10) per one thousand (1,000) gallons.
e. 
For every one thousand (1,000) gallons thereafter, or portion thereof: one dollar and sixty cents ($1.60) per one thousand (1,000) gallons.
F. 
Effective July 1, 2016, for users located within the corporate limits of the City of New Haven, the following user charges shall apply, per month:

1. 
The minimum charge for all users shall be eight dollars and zero cents ($8.00).
2. 
In addition each user shall pay a user volume charge as follows:
a. 
For the first zero (0) to three thousand (3,000) gallons, or portion thereof: two dollars and forty-five cents ($2.45) per one thousand (1,000) gallons.
b. 
For the next seven thousand (7,000) gallons, or portion thereof: three dollars and sixty-nine cents ($3.69) per one thousand (1,000) gallons.
c. 
For the next forty thousand (40,000) gallons, or portion thereof: two dollars and eighty-seven cents ($2.87) per one thousand (1,000) gallons.
d. 
For the next fifty thousand (50,000) gallons, or portion thereof: two dollars and fifteen cents ($2.15) per one thousand (1,000) gallons.
e. 
For every one thousand (1,000) gallons thereafter, or portion thereof: one dollar and sixty-five cents ($1.65) per one thousand (1,000) gallons.
G. 
For water users located outside the corporate limits of the City of New Haven, the monthly minimum charge shall be 1.5 times (150 percent) the current minimum charge for users located inside the corporate limits, and the monthly user volume charge shall be 1.5 times (150 percent) the current user volume charge for users located inside the corporate limits.

Section 715.025 Wastewater User Charge Adjustment.

A. 
A customer's wastewater usage bill may be adjusted in the event of a water line break on or about the customer's property. The following policy shall apply:
1. 
The customer must have experienced a water line break at the customer's water service location.
2. 
The customer must provide sufficient evidence and / or documentation that a water line break has occurred. The City reserves the right to inspect the customer's water service to determine the circumstances of the water line break.
3. 
The customer must file a written request for user charge adjustment with the City.
4. 
Upon review of the information provided by the customer, the City may adjust the wastewater user charges in the following manner:
a. 
The customer's wastewater usage for the previous three (3) months will be totaled, and an average usage per month will be determined. The customer will be charged for this average usage amount for the month in which the water line break occurred.
b. 
In the event a customer has not established service for three (3) or more months prior to the water line break, the City shall adjust wastewater charges by estimating the usage for an average customer in the same customer class as that of the customer requesting adjustment.
c. 
The customer shall remain responsible for all water charges which are incurred as a result of the water line break. The adjustment as herein authorized shall apply to wastewater charges only.

Section 715.030 Review of System.

The City shall review the user charge system annually and revise user charge rates as necessary to ensure that the system generates adequate revenues to pay the costs of operation and maintenance including replacement and to pay the costs of debt obligations associated with financing the water system.

Section 715.040 Collection and Disbursements.

A. 
The user charge system shall generate adequate annual revenues to pay the costs of annual operation and maintenance including replacement and to pay the costs of debt obligations associated with financing the wastewater system.
B. 
That portion of the total user charge collected which is designated for the operation and maintenance including replacement purposes shall be deposited in a separate non-lapsing fund known as the Operation, Maintenance and Replacement Fund and will be kept in two (2) primary accounts as follows:
1. 
The Operation and Maintenance Account shall be an account designated for the specific purpose of defraying operation and maintenance costs (excluding replacement) of the water system.
2. 
The Replacement Account shall be an account designated for the purpose of ensuring replacement needs over the useful life of the water system. Deposits in the Replacement Account shall be made at least annually from the replacement revenue in the amount of twenty-seven thousand six hundred sixty-two dollars ($27,662.00).
C. 
Fiscal year-end balances in the Operation and Maintenance Account and the Replacement Account shall be carried over to the same accounts in each subsequent fiscal year and shall be used for no other purposes than those designated for these accounts. Monies which have been transferred from other sources to meet temporary shortages in the Operation, Maintenance and Replacement Fund shall be returned to their respective accounts upon appropriate adjustment of the user charge rates for operation, maintenance and replacement. The user charge rate(s) shall be adjusted such that the transferred monies will be returned to their respective accounts within the fiscal year following the fiscal year in which the monies were borrowed.

Section 715.050 Rate Structure.

A. 
Each user shall pay for the services provided by the City based on its use of the wastewater collection and treatment works as determined by water meter(s) acceptable to the City.
B. 
For residential contributors, monthly user charges shall be a flat fee based on average monthly water usage during the months of January, February and March. This average winter water use shall be used to compute residential sewer billings each April for the next twelve-month period. If a residential contributor has not established a January, February and March average, its monthly bill shall be the median charge of all other residential contributors. This provision shall go into effect with the April 2016 billing cycle.
C. 
For industrial and commercial contributors, user charges shall be based on water used during the current month. If a commercial or industrial contributor has a consumptive use of water, or in some other manner uses water which is not returned to the wastewater collection system, the user charge for that contributor may be based on wastewater meter(s) or separate water meter(s) installed and maintained at the contributor's expense, and in a manner acceptable to the City.
D. 
For all users of the City wastewater system, for the period beginning November 1, 2015, and running through June 30, 2016, the following user charges shall apply:
1. 
The minimum charge per month shall be $12.00.
2. 
In addition, each contributor shall pay the following user charge(s):
a. 
For the first one hundred thousand (100,000) gallons of monthly water consumption, a rate of three dollars and fifty-one cents ($3.51) per one thousand (1,000) gallons, or fraction thereof.
b. 
For all monthly water consumption in excess of one hundred thousand (100,000) gallons, a rate of three dollars and thirteen cents ($3.13) per one thousand gallons, or fraction thereof.
E. 
For all users of the City wastewater system, for the period beginning July 1, 2016, and running through June 30, 2017, the following user charges shall apply:
1. 
The minimum charge per month shall be $13.00.
2. 
In addition, each contributor shall pay the following user charge(s):
a. 
For the first one hundred thousand (100,000) gallons of monthly water consumption, a rate of three dollars and fifty-six cents ($3.56) per one thousand (1,000) gallons, or fraction thereof.
b. 
For all monthly water consumption in excess of one hundred thousand (100,000) gallons, a rate of three dollars and eighteen cents ($3.18) per one thousand gallons, or fraction thereof.
F. 
For all users of the City wastewater system, for the period beginning July 1, 2017, and running through June 30, 2018, the following user charges shall apply:
1. 
The minimum charge per month shall be $14.00.
2. 
In addition, each contributor shall pay the following user charge(s):
a. 
For the first one hundred thousand (100,000) gallons of monthly water consumption, a rate of three dollars and sixty-one cents ($3.61) per one thousand (1,000) gallons, or fraction thereof.
b. 
For all monthly water consumption in excess of one hundred thousand (100,000) gallons, a rate of three dollars and twenty-three cents ($3.23) per one thousand gallons, or fraction thereof.
G. 
Any user which discharges any toxic pollutants which cause an increase in the cost of managing the effluent or the sludge from the City's treatment works, or any user which discharges any substance which singly or by interaction with other substances causes identifiable increases in the cost of operation, maintenance, or replacement of the treatment works, shall pay for such increased costs. The charge to each user shall be as determined by the responsible plant operating personnel and approved by the Board of Aldermen.
H. 
The user charge rates established in this article apply to all users of the City's treatment works, regardless of the user's location.

Section 715.060 Review of System.

The City shall review the user charge system annually and revise user charge rates as necessary to ensure that the system generates adequate revenues to pay the costs of operation and maintenance including replacement and to pay the costs of debt obligations associated with financing the water system.
