No person, persons or corporation shall dig or excavate in, under, or over, or otherwise remove any surface or subsurface material from any public street within the City limits of the City of Palmyra, Missouri, unless a permit therefor has first been obtained from the Street Commissioner of said City.

It shall be the duty of the Street Commissioner of the City of Palmyra, Missouri, to investigate applications for permits under Section 515.010, and to determine whether or not the proposed digging, excavation or removal of material is reasonable and convenient or necessary, and, if so, upon deposit of the charge hereinafter provided to issue such permit.

No permit under this Chapter shall be issued until the person, persons, or corporation applying therefor has first paid into the treasury the minimum sum of two hundred fifty dollars ($250.00) as the permit fee to reimburse the City for costs of repairing the street after such digging or excavation; provided however, if the surface area of the proposed excavation is greater than fifty (50) square feet, the permit fee shall be the sum of two hundred fifty dollars ($250.00), plus five dollars ($5.00) for each additional square foot in excess of fifty (50) square feet.

Prior to excavation, the permittee shall cut the street with a concrete saw or asphalt saw completely through the surface to an ample depth. Before backfilling any hole or trench dug or excavated under such permit, the permittee shall timely notify the Street Commissioner so that before and during the backfilling the Street Commissioner may inspect the materials used in and the method of backfilling. The permittee shall backfill any hole or trench dug or excavated with three-quarter (¾) inch to one and a half (1½) inch base stone.

Any person, persons or corporation violating this Chapter shall be fined not less than twenty-five dollars ($25.00), nor more than five hundred dollars ($500.00).
