Property maintenance — See Ch. 290.
From and after the passage of this chapter, it shall be unlawful for any person or persons, company or corporation to use or allow his, her, their or its property to be used, either real or personal, in such a manner as to constitute a nuisance, as defined in this chapter, within the limits of said Township.
As used in this chapter, the following terms shall have the meanings indicated:
NUISANCE
Any activity or use of property that is injurious to health or an obstruction to the free use of property so as to interfere with the comfortable enjoyment of life or property by others or which could be classified as an unreasonable or unwarrantable or unlawful use by the person of their property, either real or personal, or such a use that produces material annoyance, discomfort or hurt to others or the public generally.
[Amended 6-11-1985 by Ord. No. 124]
In the event any person, persons, company or corporation shall violate any of the provisions of this chapter, the Board of Commissioners of Aleppo Township shall order the removal of any such nuisance from public or private property after 15 days' written notice to the owners or occupants of the premises to do so, and, upon default, the Board of Commissioners may abate or remove the same and collect the cost of such removal, together with the penalty of $100, from the owners or occupants.
[Amended 6-11-1985 by Ord. No. 124]
Any person who shall violate any of the provisions of this chapter shall, upon conviction thereof, be sentenced to pay a fine of not more than $250, and costs of prosecution, and, in default of payment of such fine and costs, to imprisonment of not more than 30 days. Each day's continuance of the violation shall constitute a separate offense. Such fine and costs may be in addition to the costs and expenses of abatement and any penalty authorized to be charged in cases where abatement thereof is done by the Township.
Nothing contained herein shall in any way affect the right of the Township to pursue whatever remedies they may have in law or equity in the abatement and regulation of nuisances.
