Pursuant to the authority granted by the Wisconsin State Statutes, there is established a Municipal Court for the Village of Darien, Wisconsin.

Pursuant to the authority granted by the Wisconsin State Statutes, there is created the office of Judge of the Municipal Court for the Village of Darien, Wisconsin.

The Municipal Judge shall be elected at large at the spring election, commencing with the April 1987 election, for a term of four years commencing on May 1 succeeding the election.

The Municipal Judge shall receive such salary as the Village Board shall establish by resolution and shall be payable in the manner set forth, such salary to be in lieu of fees and costs for such Judge. Such salary may be increased by the Board before the start of the second year of the term of the Judge but shall not be decreased during a term. No salary shall be paid to the Judge for any time during his or her term for which he or she has not executed and filed his or her official bond and oath as required by Section 2.24.050.

The Municipal Judge shall execute and file with the Clerk of Courts for Walworth County the oath prescribed by Wisconsin State Statutes and an official bond in such amount as shall be fixed by the Village Board. However, the requirement for a bond is hereby eliminated per 2017 WI Act 51, provided that the Village of Darien maintains an employee dishonesty insurance policy with a limit of at least $10,000.

A. 
The Municipal Judge shall have jurisdiction as provided by Wisconsin State Statutes. Appeals shall be made in the manner provided by Wisconsin State Statutes.
B. 
The Municipal Judge shall have such county-wide jurisdiction as provided by Section 755.05 Wis. Stats., and exclusive jurisdiction over actions in which a forfeiture(s) is (are) sought for violations of municipal ordinances, except as otherwise provided in Section 755.045, Wis. Stats.
C. 
Jurisdiction Over Juveniles Aged 12 or Older.
1. 
Pursuant to Section 938.17(2), Wis. Stats., the Municipal Court shall have jurisdiction over juveniles aged 12 or over for violations of municipal ordinances. The citation procedures described in Ch. 800, Wis. Stats., shall be used.
2. 
If a citation is issued to a juvenile, the issuing agency shall, within seven days, notify the juvenile's parent or guardian.

A. 
The Municipal Court shall be open as determined by the order of the Municipal Judge, but not less than one stated evening each month.
B. 
The Municipal Judge shall hold his or her court in the Village Hall, Village of Darien. Wisconsin.
C. 
The procedure in Municipal Court shall be as provided by Wisconsin State Statues and this chapter.
D. 
Collection of Moneys. The Municipal Judge shall collect all fines and taxable costs in any actions or proceedings before him or her and shall pay over such moneys to the Village Treasurer monthly. At such time the Municipal Judge shall pay over to the Treasurer all forfeitures collected by him or her in actions for violation of Village ordinances.
E. 
The Village Board may by resolution authorize appointment of Clerk and deputy Clerk(s) who, in that event, shall be appointed in writing by the Judge and at such compensation as shall be fixed by the Board. Such Clerk(s) shall take and file the oath prescribed by Wisconsin State Statues and shall give such bond as the Board may require in its resolution.

The Municipal Court shall be governed by the provision of the Wisconsin State Statutes presently in effect and hereafter created pertaining to municipal courts.

A. 
The Village Municipal Judge may impose a sanction under Subsection B of this section for contempt of court as defined in Section 785.01(1) of the Wisconsin State Statues.
B. 
The Municipal Judge may impose a forfeiture for contempt under Subsection A of this section in an amount not to exceed $50 or, upon nonpayment of the forfeiture and penalty assessment, a jail sentence not to exceed seven days.

No person shall conduct themselves in the presence of the Municipal Court in a way which interferes with any court proceeding or with the administration of justice or which impairs the respect due the Court. No party shall show disobedience, resistance or obstruct the authority, process or order of the Court. For the purposes of this section, the refusal of a person to appear as a witness, be sworn or answer a question or refusal to produce a record, document, or other object will also be considered contempt of court.
