This chapter shall be known as the recycling ordinance for the Village of Darien.

The ordinance codified in this chapter is adopted as authorized under Wis. Stats. Section 287.09. The requirements of this chapter shall apply to all persons within the Village. The Village will be the responsible unit charged, with all the duties and responsibilities required by law unless the Village Board of trustees, by contract, designates another responsible unit per Section 287.09(1)(d), Wis. Stats.

It is not intended by this chapter to repeal, abrogate, annul, impair or interfere with any existing rules, regulation, ordinance or permits previously adopted or issued pursuant to law. However, whenever this chapter imposes greater restrictions, the provisions of this chapter shall apply.

The Village shall promote recycling, composting and resource recovery through the administration of an effective recycling program as provided in Section 287.11, Wis. Stats., and Chapter NR544, Wis. Administrative Code. Further, the Village adopts any subsequent amendments or repeals of the Wisconsin Statutes and Administrative Code relating to solid waste and recycling.

No person may dispose of the following:
A. 
An aluminum container;
B. 
Corrugated paper or other container board;
C. 
Foam polystyrene packaging;
D. 
A glass container;
E. 
A magazine or other material printed on similar paper;
F. 
A newspaper or other material printed on newsprint;
G. 
Office paper;
H. 
A plastic container;
I. 
A steel container;
J. 
A waste tire;
K. 
A container for carbonated or malt beverage that is primarily made of a combination of steel and aluminum.

The contract for services shall cover all functions required under Section 287.09(2), Wis. Stats., including provisions for financing and enforcing the recycling or other solid waste management programs.

A. 
Public education to inform residents of the reasons to recycle.
B. 
Require occupants of single-family residences, buildings containing two or more dwelling units and commercial, retail, industrial and governmental facilities to separate the materials identified in Section 8.32.040 and incineration restrictions per Section 287.07(4), Wis. Stats.
C. 
Require owners of buildings containing five or more dwelling units to do all of the following:
1. 
Provide adequate, separate containers for materials identified in Section 8.32.040 and incineration restrictions per Section 287.07(4), Wis. Stats.
2. 
Notify tenants at the time of renting or leasing the dwelling and semiannually thereafter of the programs under Section 8.32.040 and incineration restrictions per Section 287.07(4), Wis. Stats.
3. 
Provide for the collection of recyclable materials separated from solid waste by the users and occupants per Section 287.11(2)(e)(f)(g)(h)(i)(j), Wis. Stats.
