As used in this Chapter, the following words have the meanings indicated:
FARMERS' MARKET
A market held in an open area or in a structure where farmers' market vendors offer for sale to the public such items as unprocessed foodstuffs, produce, home-processed food products, homemade handicrafts, and items customarily sold or dispensed at farmers' markets from booths or vehicles on-site.
FARMERS' MARKET VENDOR
The individual farmers, producers or such other persons selling unprocessed foodstuffs, produce, home-processed food products, homemade handicrafts, and items customarily sold or dispensed at farmers' markets on a seasonal basis in a farmers' market.
HANDICRAFTS
Items made by hand, often with the use of simple tools, and are generally artistic and/or traditional in nature. They are also objects of utility and objects of decoration.
PRODUCE
Fruits, vegetables, honey, eggs, grain, flowers, herbs, plants, and other similar items. Produce does not include live animals of any sort, slaughtered animals, unrefrigerated meat, fish, and poultry.

The Board of Aldermen of the City of Marshfield established a Farmers’ Market for the promotion of trade and commerce in the City of Marshfield pursuant to Section 79.450.7, RSMo.; said market is deemed to be in the best interest of the trade and commerce of the City of Marshfield.

A. 
In addition to the rules established by the farmers' market manager, it shall be the responsibility of the individual farmers' market vendors to ensure that:
1. 
All produce sold at the farmers' market is in a fresh and healthy condition.
2. 
The sale of produce by commercial growers or producers is expressly prohibited.
3. 
The farmers' market is not used by persons offering goods or produce for resale.
4. 
No animals or livestock are offered for sale at the farmers’ market.
5. 
At the close of the business day, each farmers’ market vendor in the farmers’ market clears the area assigned him/her and removes all refuse.

It is unlawful for any person to fail to comply with the provisions of this Chapter. Any person violating any provision of this Chapter shall be deemed guilty of a misdemeanor and may be punished by a fine not less than five dollars ($5.00) and not more than five hundred dollars ($500.00).
