A. No
water service shall hereinafter be furnished to any applicant and
no water meter shall be installed and connected for any applicant
until each such applicant for water service shall have first paid
a deposit in one (1) of the following applicable amounts:
1. Twenty-five dollars ($25.00) for an applicant who shall reside at
a dwelling unit owned by such person; or
2. Fifty dollars ($50.00) for an applicant who is a renter or a tenant
at any rental property.
B. The
deposit amount shall be retained by the City of Hermann to insure
payment of all water bills. If service to such applicant is permanently
discontinued, this deposit, less any amount still due the City of
Hermann for water service, shall be refunded without interest.
C. Renters
or property owners that have never paid a deposit and who are in good
standing and shall move from one dwelling to another dwelling shall
not be subject to this deposit requirement.
D. The
Collector shall receive all deposits required hereby and shall issue
a receipt for such deposit and shall apply and refund such deposit
as herein provided.

In the event water service is terminated because the user is delinquent, service shall not be re-connected until such user or applicant shall have first paid the water service deposit herein provided in Section
705.070 above in addition to a re-connection charge of ten dollars ($10.00), plus payment of any unpaid or delinquent water account. All such sums shall be paid in cash or by a cashier's check, certified check, or money order. No personal checks will be accepted for restoration of service after termination because of delinquency or violation by the user or customer of other rules provided in this Chapter.

In the event any water user discontinues water service and there remains a balance due the City of Hermann for water service, the City Collector shall apply the deposit against such unpaid water account of user and the excess of the deposit sum over the unpaid account, if any, shall be refunded to the water user, subject to the provisions of Section
700.020 of this Code.

The water service deposit shall remain with the City of Hermann
for a period of two (2) years and shall be returned after that time,
without interest, to all depositors, provided that they are in good
standing and are not considered a delinquent account and make application
for refund to the City Collector.

Application for water services shall be made in writing to the
City Collector or other person designated by the Board of Aldermen
by the owner or occupant of the property to be served and upon approval
of such application, which shall be accompanied by a minimum charge
of four hundred dollars ($400.00), the City shall make the line tap
and install and provide the corporation stop and the meter. The person
making the application must provide and install all other materials
needed to provide the services required. The curb stop must be purchased
from the City at the City's cost. The City reserves the right to charge
and collect for installations utilizing two (2) inch or larger pipes,
up to the actual costs incurred in making such installation.

A. There
is hereby imposed upon each customer of the City of Hermann Waterworks
System, an annual fee for each water service connection in the following
amounts:

1. The annual fee per customer service connection for unmetered customers
and customers with meters not greater that one (1) inch in size shall
be five dollars and twenty-eight cents ($5.28).
2. The annual user fee for customers having meters greater than one
(1) inch but less than or equal to two (2) inches in size shall be
twenty-one dollars ($21.00).
3. The annual user fee for customers having meters greater than two
(2) inches but less than or equal to four (4) inches in size shall
be one hundred two dollars ($102.00).
4. The annual user fee for customers having meters greater than four
(4) inches in size shall be one hundred ninety-eight dollars ($198.00).
B. Customers
of the City's waterworks system served by multiple connections shall
pay an annual user fee based on the above rates for each water service
connection, except that no single facility served by multiple connections
shall pay more than a total of seven hundred dollars ($700.00) per
year.
C. Fees
imposed pursuant to this Section and said Statute shall be payable
by each customer of the City's waterworks system on or before the
due date specified on the utility billing statement issued by the
City of Hermann to such customer on June first (1st), or on the business
day closest to said date, of each year, and if not paid by such due
date, the account shall be deemed delinquent. Said annual fee shall
be enumerated separately from all other charges set forth on said
monthly utility billing statement. Such fees shall be State fees and
shall be transferred to the Director of the Department of Revenue
on or before the date provided by State law, less the portion thereof
authorized by said Statute to be retained by the City as reimbursement
of billing and collection expenses.
D. The
imposition and collection of the annual fee authorized in this Section
shall be suspended or shall expire, as may be applicable, pursuant
to the provisions of Subsections 8 and 9 of said Section 640.100,
RSMo.

A. All
new water installations in the City of Hermann installed after July
15, 1968, shall have a check valve installed on the water main side
of the water meter of suitable size and capacity and in conformity
with other building ordinances of this City.
B. The
Water and Sewer Superintendent shall inspect each new installation
to find if such valve has been installed as required.
C. The
Water and Sewer Superintendent shall not turn on the water to the
installation until the inspection has been made and the check valve
installed.

A. All
water mains constructed after November 10, 1986, shall be not less
than six (6) inches in diameter and shall be constructed of cast iron,
ductile iron, Schedule 160 or Schedule 200 polyvinyl chloride pipe
or other materials comparable in strength and durability upon approval
by the Board of Aldermen. In the event the Master Water Plan for the
City of Hermann, prepared in 1984, as the same may subsequently be
amended or superseded, provides for a water main in excess of six
(6) inches in diameter such water main shall be constructed by using
the minimum diameter of pipe specified in said Master Water Plan.
No water main shall be constructed within the City of Hermann except
in accordance with plans and specifications approved in advance by
the City of Hermann and by the Missouri Department of Natural Resources.
B. All
water mains and service lines to the curb stop shall be constructed
only within a public street right of way or within a public utility
easement of not less than ten (10) feet in width which has been dedicated
to the City of Hermann. Curb stops shall be located on the sidewalk
side of the curb or future curb line.
C. All
water main and service line extensions for which pipe, fittings, valves
and other components (including fire hydrants on extensions more than
two hundred (200) feet in length) not more than six (6) inches in
diameter are permissible, as provided herein, shall be made at the
expense of the owners of property served by such extension, assessed
in proportion to the front foot of each lot or parcel served by such
extension and including all such components used in the extension.
D. Whenever
said Master Water Plan requires the installation of pipe, fittings,
valves and fire hydrants or other components in excess of six (6)
inches in diameter, the difference in cost between that of the pipe
and other components actually used and the cost of six (6) inch diameter
pipe and components shall be paid by the City of Hermann.
E. The
owner or occupant of any lot or parcel or improvement within the City
served by the City water system shall be responsible for excavating
to expose the sewer main. The City or its water department or any
contractor so authorized by the City shall tap the main. The City
shall provide a main saddle, curb stop and curb stop box. The owner
shall pay the City for these items. The owner shall be responsible
for constructing all pipes, components and other fittings from the
main to the serviced premises, subject to and under the supervision
and inspection of the City's Water and Sewer Superintendent and in
compliance with applicable City ordinances. Each such property owner
or customer of the City water system shall be responsible for all
repairs or expenses incurred because of such person's failure to provide
a safe and protected location of the water meter and for injury to
the same on account of freezing or other hazard.
F. After
completion of construction of any such water main or service line
extension and after acceptance thereof by the City of Hermann, the
City of Hermann will maintain and assume responsibility for all fire
hydrants and for all main and service lines to and including the curb
stop. The property owner shall be responsible for maintenance of the
service line and appurtenances from the curb stop to the premises
served.
