A. 
Establishment. The Legal Department of the City heretofore created is hereby continued.
B. 
City Solicitor to Supervise Department; Salary; Duties; Term of Office.
(1) 
The administration of the Legal Department of the City shall be and is hereby placed under the supervision and control of the City Solicitor, subject to the orders and direction of the City Council.
(2) 
The salary of the City Solicitor shall be in such amount as shall be fixed by ordinance, plus such expenses as he may incur in and about the performance of his duties and approved by the City Council.
(3) 
The salary shall include all services necessary to be performed by him as City Solicitor of whatever kind of character, included in which, among other things, shall be attendance at all meetings of the City Council, as required, and of the City and such other duties as may be prescribed by the City Council, except litigation.
(4) 
The term of the City Solicitor shall be a period of one year from January 1 of each year. Appointments on an interim basis shall be for the unexpired term.
A. 
Duties and salary.
(1) 
The office of Municipal Prosecutor be and the same is hereby created and established in the Legal Department of the City of Absecon City.
(2) 
The City Solicitor is hereby authorized to assign and delegate the duties of the Prosecutor. The Prosecutor shall represent the City of Absecon City in Municipal Court or other courts as directed by the City Solicitor or the Judge of the Municipal Court involving violations of the ordinances of the City of Absecon City and the laws of the State of New Jersey.
(3) 
The remuneration of the Prosecutor shall be by an hourly rate agreed by the City Solicitor and the City Council. The remuneration shall be paid from the Legal OE Expenses in the annual budget.
(4) 
The term of the Prosecutor shall be for one year to coincide with the term of the City Solicitor.
