No person shall engage in the business of operating, conducting or maintaining a food market whereon one or more concessions or departments are rented or leased in any building, structure or premises within the limits of the City of Absecon City, New Jersey, without first obtaining a license therefor.

As used in this chapter, the following terms shall have the meanings indicated:
FOOD MARKET
Any store, building, structure or premises wherein food, foodstuffs, groceries, canned goods, fruit, produce, meats, delicatessen products, fish or other food commodities of any type or description are offered or exposed for sale.
PERSON
For the purpose of this chapter, shall mean and include persons, firms, partnerships and corporations.

The license fee for such a food market shall be the sum of $1,000 per year for each and every concession or department rented, leased or operated in any such building, structure or premises. The license fee fixed by this chapter is for the purpose of revenue.

All license fees shall be due and payable to the City on the first day of July in each year, and all such licenses shall expire on the 30th day of June of the following year.

No license obtained pursuant to this chapter shall be transferable.

This chapter shall not be held to apply to any municipal market.

Each day's operation, conduct or maintenance of such business without a license shall constitute a separate violation of this chapter.

Any person violating any of the provisions of this chapter shall, on conviction in the Municipal Court of Absecon City, be punished for each offense by a fine not to exceed $200 or by imprisonment for any term not exceeding 90 days in the County jail or in any place provided by the municipality for the detention of prisoners, or both. The Municipal Judge before whom any person is convicted of violating this chapter shall have power to impose any fine or term of imprisonment not exceeding the maximum fixed in the above chapter.
