[1997 Code § 300-1]
This Article shall be known and may be cited as the "Refuse Collection Service Regulations of the City of Absecon City."

For the purposes of this Article, the following terms, phrases, words and their derivations shall have the meanings given herein. When not inconsistent with the context, words used in the present tense include the future, words in the plural number include the singular number, and words in the singular number include the plural number. The word "shall" is always mandatory and not merely directory.
CHAIRMAN
The Chairman of the Committee or his duly authorized representative.
COMBUSTIBLE WASTE
Yard trimmings, rags, waste wood or cardboard and other combustible waste solids of a nonvolatile or explosive nature.
COMMITTEE
The Council Committee on Public Health, Safety and Sanitation.
GARBAGE
All refuse, entrails and waste of animals and fish and all vegetable matter which has been or was intended to be used as food; all clam, oyster, crab and lobster shells; and all other items that are construed as garbage by the rules, regulations or specifications of the New Jersey State Board of Health.
NONCOMBUSTIBLE WASTE
All solid waste material which does not burn.
PERSON
Any person, firm, partnership, association, corporation, company or organization of any kind.
REFUSE
All putrescible and nonputrescible solid wastes, including garbage, rubbish, ashes, street cleanings, dead animals and market, commercial and industrial wastes.
RUBBISH
Nonputrescible solid waste consisting of both combustible and noncombustible wastes, such as paper, wrappings, cigarettes, cardboard, tin cans, yard clippings, leaves, wood, glass, bedding, crockery and similar materials.
TRADE WASTE
The by-products of building contractors or demolition contractors engaged in the business of constructing homes or other buildings or structures or the demolition of buildings or structures or those engaged in the clearing of land for the purpose of preparing the same for use as the site for a building or structure or for roadways or similar purposes.

A. 
All refuse, except trade wastes, accumulated in the City shall be collected, conveyed and disposed of by the City or its duly authorized contractor for such purposes (hereinafter collectively referred to as the "collector"). No other person shall collect, convey over any of the streets or alleys of the City or dispose of any refuse accumulated in the City, except in strict compliance with the provisions of this Article and any other applicable law, rule, regulation or ordinance.
B. 
This Article shall not prohibit the actual producers of refuse, or the owners of premises upon which refuse has accumulated, from personally collecting, conveying and disposing of such refuse, provided that such producers or owners comply with the provisions of this Article and with any other applicable law, rule, regulation or ordinance.
C. 
This Article shall not prohibit persons from collecting refuse from outside of the City and hauling such refuse over City streets, provided that such persons comply with the provisions of this Article and with any other applicable law, rule, regulation or ordinance.

All refuse accumulated in the City shall be collected, conveyed and disposed of by the collector under the supervision of the Committee. The Committee shall have the authority to make necessary and reasonable rules and regulations concerning the days and hours of collection, type and location of waste containers and such other matters pertaining to the collection, conveyance and disposal of refuse, trade wastes, body wastes and other materials as it shall find necessary and to change and modify the same after notice.

A. 
Refuse shall be mixed and placed in proper containers in accordance with the provisions hereof.
B. 
All garbage, before being placed in the container for collection, shall have drained from it all free liquids and must be securely wrapped in paper.
C. 
All rubbish shall be drained of liquid before being deposited in the container for collection.
D. 
Tree trimmings, hedge clippings and similar material need not be placed in a container but shall be cut to a length not to exceed four feet and securely tied in bundles not more than two feet thick before being deposited for collection.

A. 
Refuse containers shall be provided by the owner, tenant, lessee or occupant of the premises. Refuse containers shall be maintained in clean, safe and good condition. Any container that does not conform to the provisions of this Article or that may have ragged or sharp edges or any other defect liable to hamper or injure the person collecting the contents thereof shall be promptly replaced upon notice. The Committee shall have the authority to refuse collection services for failure to comply herewith.
B. 
The refuse container shall be of galvanized metal or of plastic composition, shall not exceed 30 gallons in capacity, shall have a tight-fitting lid or cover and shall have two sturdy handles.
C. 
Wooden, cardboard, composition paper or fiber or similar containers are specifically prohibited for use as refuse containers. The collector may, at his election, refuse to collect refuse in such container or remove such container and dispose of it as refuse. Permission for the use of special-type containers may be obtained upon application to the Committee and upon the Committee's finding that such special containers are not prohibited by law, rule, regulation or the ordinances of Absecon City; will not unduly impair the intent or purpose of this Article; will not cause litter; will not unduly impair the collection or disposal of refuse; and will not otherwise impair the public health, welfare or safety.
D. 
No container, when loaded with refuse and placed for collection, shall exceed a gross weight of 60 pounds. The authorized City contractor may, at his discretion, refuse to collect refuse in containers the combined gross weight of which exceeds 60 pounds.

A. 
No person shall place any refuse in any street, alley or other public place or upon any private property, whether owned by such person or not, within the City except in proper containers for collection. Neither shall any person throw or deposit any refuse in any stream or other body of water.
B. 
Any accumulation of refuse on any premises, except in the manner herein provided, is hereby declared to be a nuisance and is prohibited.
C. 
No person shall cast, place, sweep or deposit anywhere within the City any refuse in such a manner that it may be carried or deposited by the elements upon any street, sidewalk, alley, sewer, parkway or other public place or into any occupied premises within the City.

Each owner or occupier of premises in the City of Absecon desiring to have his refuse collected by the collector shall place same in proper containers at the curbline in front of his premises not later than 7:00 a.m., prevailing time the day of the collection, nor earlier than 6:00 p.m. on the days prior to those designated for collection of refuse as designated by the Committee. Each owner or occupier of premises in the City of Absecon placing containers in any public area for collection shall remove all such containers from the public area(s) not later than 24 hours subsequent to the date designated for collection by the Committee. Any person, firm, or corporation which violates any of the provisions of this section or any regulations promulgated pursuant thereto shall be subject to a fine not to exceed $1,000, with each day for which any such violation shall persist to be considered an additional violation.

A. 
The removal of wearing apparel, bedding or other refuse from homes or other places where highly infectious or contagious diseases have prevailed shall be performed under the supervision and direction of the Committee. Such refuse shall not be placed in containers for regular collection.
B. 
Highly flammable or explosive materials shall not be placed in containers for regular collection but shall be disposed of as directed by the Committee at the expense of the owner or possessor thereof.
C. 
The Committee is hereby authorized and directed to promulgate rules and regulations for the disposal of waste material not included within the definition of "refuse" where such waste material originates within Absecon City. Any person desiring to dispose of such waste shall do so in strict accordance with such rules and regulations and in accordance with the statutes of New Jersey and the rules and regulations of the New Jersey State Board of Health and the New Jersey Department of Conservation and Economic Development.
D. 
The actual producers of refuse or the owners of premises upon which refuse is accumulated who desire personally to collect and dispose of such refuse, persons who desire to dispose of waste material not included in the definition of "refuse" and collectors of refuse from outside of the City who desire to haul over the streets of the City shall use a watertight vehicle provided with a tight cover and so operated as to prevent offensive odors escaping therefrom and refuse or waste material from being blown, dropped or spilled therefrom.

Ownership of refuse set out for collection or deposited on the sanitary landfill site shall be vested in the City.

Any person who shall violate any of the provisions of this Article shall, upon conviction, be punished for each offense by a fine not to exceed $500 or by imprisonment for a term not to exceed 90 days in the County jail, or both.
