GENERAL REFERENCES
Zoning — See Ch. 550.
As used in this chapter, the following terms shall have the meanings indicated:
OPEN BURNING
Any outdoor fire or smoke-producing process from which air contaminants are permitted directly into the outdoor atmosphere.
GARBAGE
The animal and vegetable waste resulting from the handling, preparation, cooking and serving of food.
RECYCLABLE MATERIALS
Source-separated recyclable materials, including materials listed in Section 1501 of Act 101,[1] and materials identified by the Borough of Greenville to be recycled.

REFUSE
All waste material, including but not limited to, garbage, rubbish, incinerator residue, street sweepings and dead animals.
RUBBISH
Solid or liquid waste material, including but not limited to paper and paper products; rags; trees or leaves, needles and branches therefrom; vines; lawn and garden debris; furniture; cabins; crockery; plastic cartons; chemicals; paint; grease; sludge; oils and other petroleum products; wood; sawdust; demolition materials; tires; and automobiles and other vehicles and parts, for junk, salvage or disposal.

Except as permitted in § 194-3, no person shall burn, cause, suffer, allow or permit the burning of garbage; refuse; rubbish; rubbish generated by residential activities; rubbish generated by industrial or commercial activities, rubbish generated by land clearing or demolition for any structure or the construction and modification of any highway, railroad, power or communication line, or pipeline; or for the development or modification of a recreational area or park; or any open burning that will produce offensive or objectionable smoke or odor emission within the Borough of Greenville.

Open burning, provided it is not contrary to any other federal, state or local law, ordinance rule or regulation, will be permitted as follows.
A. 
At a publicly sponsored celebration or event or at a public or private school sponsored event in accordance with a permit issued by the Fire Chief and subject to any conditions or restrictions which shall be imposed by said permit for the safety of life and property.

D. 
Open burning of charcoal or wood for cooking purposes, provided such charcoal or wood fire is confined in a cooking utensil commonly referred to as a grill, hibachi, freestanding fireplace and grill, spit, or other cooking utensil designed for the open cooking charcoal or wood.
(1) 
Location. The location for permitted open burning shall not be less than 50 feet from any structure and provisions shall be made to prevent the fire from spreading to within 50 feet of any structure. Exceptions:
(a) 
Fires in approved containers that are not less than 15 feet from a structure.
(b) 
The minimum required distance from a structure shall be 25 feet where the pile size is three feet or less in diameter and two feet or less in size in height.
(2) 
Attendance. Open burning, bonfires or recreational fires shall be constantly attended until the fire is extinguished. A minimum of one portable fire extinguisher with a minimum 4-A rating or other approved on-site fire-extinguishing equipment such as dirt, sand, water barrel, garden hose or water truck, shall be available for immediate utilization.
Either the Fire Chief or Police Chief of the Borough of Greenville and such firefighting or law enforcement personnel under their command as they shall designate are hereby vested with authority to enforce the provisions of this chapter. The Fire Department is hereby authorized to extinguish any open burning being conducted in violation of any of the provisions of this chapter or deemed to be a health, safety or fire hazard.
Any person who shall violate any provision of this chapter or fail to comply therewith, and is found guilty of a summary offense shall be punishable by a fine of $100 for the first offense, $500 for the second offense and $1,000 thereafter.
