A. 
Right-of-way to pedestrians. A person propelling or riding a skateboard or in-line skates, commonly known as "roller blades," or roller skates upon a sidewalk or other area used by pedestrians shall yield the right-of-way to any pedestrian. The operator of such skateboard shall dismount from the skateboard and shall pass or overtake pedestrian on foot, or wait until the pedestrian passes, prior to remounting the skateboard. A person on skates will slow down and/or stop until the pedestrian is clear.
B. 
Prohibited location: business districts. A person shall not ride a skateboard or inline skates, commonly known as "roller blades," or roller skates or propel a skateboard upon a sidewalk or roadway in the business district within the Borough of Honesdale. Said business district, for purposes of this chapter, is described as follows: the territory contiguous to and including a highway when, within any 600 feet along the highway, there are buildings in use for business or industrial purposes, including but not limited to hotels, banks or office buildings, railroad stations and public buildings which occupy at least 300 feet of frontage on one side or 300 feet collectively on both sides of the highway.
C. 
Prohibited times. It shall be unlawful for any person to ride a skateboard or in-line skates, commonly known as "roller blades," or roller skates or propel a skateboard upon any public thoroughfare, street, sidewalk and municipal lot in the Borough:
(1) 
Between sunset and sunrise on any day.
(2) 
At any other time when, due to insufficient light or unfavorable atmospheric conditions, persons are not clearly discernible from a distance of 100 feet.
D. 
Obedience of persons engaged in riding a skateboard or in-line skates, commonly known as "roller blades," or roller skates or propelling a skateboard skateboarding to traffic-control devices and regulations.
(1) 
A person engaged in skateboarding or skating shall obey the instructions of a police officer or other appropriately attired people authorized to direct, control or regulate traffic.
(2) 
A person engaged in skateboarding or skating shall obey traffic and pedestrian control signals as provided under Pennsylvania Motor Vehicle Code § 3112 (relating to traffic-control signals) and § 3111 (relating to pedestrian control signals).
E. 
Right-of-way to motor vehicles. No person engaged in riding a skateboard or in-line skates, commonly known as "roller blades," or roller skates or propelling a skateboard skateboarding shall suddenly leave a curb, sidewalk, berm or street or any other place of safety and ride upon or propel any skateboard into or toward the path of a vehicle which is so close as to constitute a hazard. Where there are no pedacycle lanes, persons engaged upon skateboarding upon a roadway shall ride as near to the right of the roadway as practical, exercising due care when passing a standing vehicle or one proceeding in the same direction.
F. 
Ramps and devices. No person shall place a ramp, half-pipe or other structure used for skateboarding or skating in a public thoroughfare, street, upon a sidewalk or municipal parking lot within the Borough.
Any person, who shall violate any of the provisions of this chapter shall, upon conviction thereof:
A. 
First offense. The skateboard used in violation of this resolution shall be impounded by the Police Department of the Borough of Honesdale for a period not exceeding 15 days. If the person violating this chapter is a minor, in addition to the confiscation of the skateboard as aforementioned, the Borough Police shall notify the parents, guardian, or other person having legal custody of said minor of the violation of this chapter and the impounding of the skateboard. In addition, said individual shall be provided with a copy of this chapter.
B. 
Second and/or subsequent offense. The skateboard of any person violating the provisions of this chapter for the second and/or subsequent time shall be impounded by the Police Department of the Borough for a period not exceeding 30 days, and said person shall, upon conviction, be sentenced to pay a fine of $25 and costs. In the event said person is a minor, the skateboard of said minor shall be impounded by the Police Department of the Borough for a period not exceeding 30 days and the parent, guardian, or other person having legal custody of said minor shall, upon conviction, be sentenced to pay a fine of $25 and costs.
