No employee or member of the Police or Fire Department shall engage in partisan political activities on behalf of any candidate or issue, nor shall he/she solicit votes or contributions on behalf of any candidate or issue, or display political posters or advertising of any kind or description. Any employee or member of the Police or Fire Department who violates this Section shall immediately be dismissed from the Police or Fire Department.

A. 
Camera Registration Program. Any resident in multi-family properties or single-family properties within the City of Berkeley can voluntarily enroll in the camera registration program by completing the required application with the Inspection Department or the Police Department; and, can remove themselves from the program at anytime by submitting a cancellation form through the Crime Free Housing Coordinator.
B. 
Definitions. The following words, terms and phrases, when used in this Section, shall have the meanings ascribed to them in this Section, except where the context clearly indicates a different meaning:
BUSINESS
A sole proprietorship, partnership, joint venture, corporation, or any other business entity, either for-profit or not-for-profit, including retail establishments where goods or services are sold; professional corporations and other entities where legal, medical, dental, engineering, architectural, personal services, food services, or other professional services are delivered, and, including private clubs.

CAMERA
Doorbell cameras, exterior cameras, interior cameras that would potentially capture images of a person or vehicle outside your home.
CHIEF OF POLICE
The Chief of Police of the City of Berkeley or designee.
CITY
The City of Berkeley.
CRIME FREE HOUSING COORDINATOR
The person, designated by the Chief of Police, who maintains records of all landlords, owners of non-owner-occupied residential properties, and/or designated agent/manager.
DWELLING
A structure, or portion thereof, which is wholly or partly designed for or used for human habitation.
DWELLING UNIT
Two (2) or more rooms or part thereof in a structure usable for occupancy by one (1) family for living purposes and having its own permanently installed cooking and sanitary facilities.
DWELLING, DUPLEX
A detached building designed for or occupied by two (2) families living independently of each other.
DWELLING, MULTIPLE
A building or portion thereof used or designed as a residence for three (3) or more families living independently of each other and doing their own cooking in said building, including apartments, apartment hotels and group houses.
DWELLING, ONE-FAMILY
A detached building designed for or occupied exclusively by one (1) family.
OCCUPANCY
The person or persons residing in or in possession or control of a residential property.
PERMIT
To suffer, allow, consent to, and acquiesce by failure to prevent, or expressly assent or agree to the doing of an act.
PERSON
Any natural person, association, partnership, corporation, or other entity capable of owning, occupying, or using property in the City.
PERSON IN CHARGE
Any person in actual or constructive possession of a property, including, but not limited to, an owner, occupant of property under his or her ownership or control.
PROPERTY
Any real property, including land and that which is affixed, incidental, or pertinent to land, including, but not limited to, any premises, room, house, building, or structure, or any separate part or portion thereof, whether permitted or not.
REGISTRATION
Residential and commercial property occupants shall complete the required form allowing police to review camera footage.
SINGLE-FAMILY
Single-family residences.
C. 
Registration.
1. 
Registration is completely voluntary and can be withdrawn at any time (for residents, but mandatory for new businesses and businesses renewing their business licenses). The Police Department personnel and/or Berkeley Information Technology Department, with your consent, will enter the home or business and make a copy of the video to assist the Police Department when there is a need to canvas the area for information that would help solve crimes.
2. 
All registered information is kept confidential and will only be viewed by Law Enforcement personnel during criminal investigations. The Berkeley Police Department does not monitor or control any cameras registered within this program.
3. 
Every commercial business, new and existing shall provide the following information when installing and registering a security camera system with the Berkeley Police Department. (Registration form, "Exhibit A," is held on file in the City offices.)

Name.
b. 
Address (if a business please add the name of your business).
c. 
Primary/Secondary Contact information (Phone number, Email address).
d. 
How long will your system store video footage before it's deleted?
e. 
What areas does your camera system cover? (i.e., front yard, backyard, overlooks City streets.)
The Police Department through the Crime Free Housing Coordinator will maintain a list of residents and businesses that have camera systems and what areas in the community they may be capturing. This list shall be updated as often as needed; and produced when asked by the Police Chief and Police Command.
D. 
Camera Equipment. Participants purchasing a video surveillance system, please consider the following :
1. 
The higher the resolution of the video the better results that will be yielded;
2. 
A minimum of thirty (30) days storage of information is recommended;
3. 
Camera placement is extremely important;
4. 
Camera(s) should face entrance and exit points; and
5. 
Camera(s) should be located on private property only.

A. 
The City of Berkeley is hereby authorized to obtain, take and receive all money and property authorized by any State or Federal law to be forfeited to or for the benefit of the City of Berkeley, Missouri.
B. 
The City Manager is hereby empowered to authorize the initiation of or participation in any legal proceedings by the City necessary or appropriate to effectuate the City's rights with respect to any forfeiture of any property.
C. 
The City Manager is hereby authorized and empowered to receive any funds or property forfeited to or for the benefit of the City and to take, manage and dispose of such money or property as provided by law.
D. 
The City Manager is hereby authorized and empowered to sell on behalf of the City any forfeited property which may be received by the City at public auction advertised at least one (1) time in a newspaper of general circulation in the City at least one (1) week prior to such auction. The City Manager shall obtain from each person purchasing any item at such auction a receipt for each item purchased, containing a description of the item or items, the amount paid for each item and the name and address of the purchaser.
E. 
The City Manager shall place all funds received by the City as forfeited property or from the sale of forfeited property in appropriate accounts of the City.
F. 
All forfeited funds or funds from forfeited property received by the City shall be paid into the general revenues of the City unless the applicable law relating to such forfeited funds or property requires the use thereof for a specific purpose. Any forfeited funds, property or proceeds thereof required by law to be used for a specified purpose are herein called Special Purpose Property or Funds. The City shall use Special Purpose Property or Funds only for the purposes specified in the law authorizing the City to receive such forfeited funds or property.
G. 
The City Manager may approve the use or expenditure of any Special Purpose Property or Funds for the purpose specified by law in an amount or value not to exceed three thousand dollars ($3,000.00). Authorization of the use or expenditure of Special Purpose Property or Funds in an amount or value of more than three thousand dollars ($3,000.00) shall be made by the City Council by resolution or ordinance.
H. 
The City Manager and all other appropriate officers of the City are hereby authorized and empowered to sign any applications, documents, or other papers and to do any and all things necessary or appropriate to obtain any forfeited funds or property on behalf of the City.

A fee not to exceed one hundred twenty-five dollars ($125.00) shall be charged to all individuals who do not reside in the City of Berkeley who are rendered emergency medical care, within the City limits by the City of Berkeley, Missouri, Fire Department.

A. 
No member of the Fire Department having the rank of captain or above may be a member of the same collective bargaining unit as a private nor in the same collective bargaining unit in which a subordinate, over which they have actual supervisory authority, is also a member.
B. 
No member of the Police Department having the rank of Corporal or above may be a member of the same collective bargaining unit as a private nor in the same collective bargaining unit in which a subordinate, over which they have actual supervisory authority, is also a member.
