§ 84-1 Soliciting contributions permitted.

The Borough of Buena shall permit charitable organizations, as defined in Section 3 of the Charitable Registration and Investigation Act,[1] N.J.S.A.45:17A-18 et seq., to solicit contributions in the streets and highways of the Borough of Buena in accordance with the provisions of this chapter.

§ 84-2 Request to be filed.

All charitable organizations which are domiciled or which have offices in the Borough of Buena or which provide services to residents of the Borough of Buena and which wish to solicit contributions in the streets and highways of the Borough of Buena shall file a request with the Borough Clerk and with the Chief of the Borough of Buena Police Department specifying the following information:
A. 
The name of the charitable organization.
B. 
The address of the organization.
C. 
The organization's telephone number.
D. 
A contact person for such organization.
E. 
The location of the proposed charitable solicitation.
F. 
The dates and times of the proposed charitable solicitation.
G. 
If said request involves a county roadway and/or highway, said request shall include a copy of an authorization from the Atlantic County Board of Chosen Freeholders to permit said charitable solicitation.
H. 
If said request involves a state roadway and/or highway, said request shall include a copy of an authorization from the State of New Jersey, Commissioner of Transportation, to permit said charitable solicitation.
I. 
A list of all proposed safety regulations, safety devices and training for individuals who shall participate in the charitable solicitation and/or a report as to the procedures to be used to ensure the safety of the members of the public who will be traversing the roadways and/or highways of the Borough of Buena.

§ 84-3 Review of request; report to be filed.

The request required by § 84-2 of this chapter shall be reviewed by the Director of Public Safety of the Borough of Buena along with the Chief of Police, or his designee, and the Director shall make a recommendation to the Mayor and Council of the Borough of Buena as to the relative aspects of the request, including a review of the location, dates and times of the request and a review of the safety procedures and/or methods to be employed by said charitable organization. The Director of Public Safety shall thereafter forward a report to the Mayor and Council of the Borough of Buena, a copy of which shall be placed on file with the Borough Clerk, as to his or her recommendation of the granting, rejecting or modification of any proposed charitable solicitation.

§ 84-4 Use of minors in solicitation prohibited.

In no event shall any charitable organization requesting authorization from the Borough of Buena for a charitable solicitation on the Borough's streets or highways use any individual under the age of 18 years to perform any function or task associated with such charitable solicitation.

§ 84-5 Compliance with other provisions.

Any charitable organization requesting authorization from the Borough of Buena for a charitable solicitation on the Borough's streets or highways shall comply with all of the terms and conditions provided for in N.J.S.A. 39:4-60, as amended, together with any regulations adopted by the Department of Transportation to regulate or control the solicitation of charitable contributions on streets and highways in the State of New Jersey.

§ 84-6 Statutory regulations; when effective.

This chapter is adopted pursuant to N.J.S.A. 39:4-60, as amended, and shall take effect upon final passage and publication, in accordance with all applicable laws, and upon the effective date of N.J.S.A. 39:4-60, as amended by P.L. 1997, c. 82, as approved April 30, 1997.
