A. 
Words and phrases. Whenever any words and phrases are used in this chapter, the meaning respectively ascribed to them in Subtitle 1 of Title 39 of the revised Statutes of New Jersey shall be deemed to apply to such words and phrases used herein.
B. 
Official time standards. Whenever certain hours are named in this chapter, they shall mean either Eastern Standard Time or Eastern Daylight Savings Time as may be in current use.
A. 
The Franklin Township Police Department or, in the event of its absence, disability or inability to act, then the Mayor of the municipality, is hereby authorized to provide by regulation for the closing of any street or portion thereof to motor vehicle traffic on any day or days during specified hours, on any day or days whenever it finds that such closing is necessary for the preservation of the public safety, health or welfare for a period not exceeding 48 consecutive hours.

B. 
Any regulations promulgated by the Franklin Township Police Department and in accordance with Subsection A above shall provide for the posting of proper warning signs of such closing of any street or portion thereof during the time the same is closed in pursuance thereof.

C. 
Any violation of this regulation promulgated thereunder shall be punished by a fine not to exceed $50.
D. 
Any regulation adopted that mandates the closing of any street for a period greater than 48 consecutive hours shall not become effective unless and until it has been submitted to and approved by the Commissioner of the Department of Transportation of the State of New Jersey.

Any vehicle parked in violation of this chapter shall be deemed a nuisance and a menace to the safety and proper regulation of traffic, and any Franklin Township police officer may provide for the removal of such vehicle. The owner shall bear the reasonable costs of the removal and storage which may result from such removal before regaining possession of the vehicle.
Unless another penalty is expressly provided by New Jersey statute, every person convicted of a violation of a provision of this chapter or any supplement thereto shall be liable to a penalty in accordance with § 1-15 of the Code of the Borough of Buena.
All former traffic ordinances of the Borough of Buena are hereby repealed, and all ordinances or parts of the ordinances in conflict with or inconsistent with the provisions of this chapter are hereby repealed, except that this repeal shall not affect or prevent the prosecution or punishment of any person for any act done or committed in violation of any ordinance hereby repealed prior to the taking effect of this chapter.
The provisions of this chapter imposing a time limit on parking shall not relieve any person of the duty to observe other, more restrictive provisions prohibiting or limiting the stopping or standing or parking of vehicles as set forth in N.J.S.A. 39:4-8, N.J.S.A. 39:4-197 and any other New Jersey statute or as hereinafter provided.
A. 
In accordance with N.J.S.A. 39:4-8, 39:4-197.3 and 40:67-16.9, upon the declaration of an emergency, there shall be no parking upon streets or sections of streets where temporary "emergency no parking" signs are displayed. The Director/OIC or, in his absence, the ranking police officer is authorized to declare an emergency and to direct the posting of "emergency no parking" signs when weather conditions, accidents, road construction, fire or public celebrations dictate or require avoidance of hazards or other conditions which interfere with the free flow of traffic. Notification that "emergency no parking" signs are being or will be posted shall be given to the operator or owner of any vehicle which has been parked prior to the posting of the signs.
B. 
The effectiveness of this section is contingent upon the signs being erected as required by law.
A. 
Removal. Whenever snow has fallen and the accumulation is such that it covers the streets or highways, an emergency shall exist and no vehicle shall be parked on the streets or highway portions thereof indicated. The above parking prohibitions shall remain in effect after the snow has ceased until the streets have been plowed sufficiently and to the extent that parking will not interfere with the normal flow of traffic.
B. 
Any unoccupied vehicle parked or standing in violation shall be deemed a nuisance and a menace to the safe and proper regulation of traffic, and any police officer may provide for the removal of such vehicle. The owner shall pay the reasonable costs of the removal and storage which may result from such removal before regaining possession of the vehicle.

No motor vehicle exceeding 20 feet in length, or seven feet in width, or eight feet in height, or exceeding a gross weight in excess of 12,000 pounds shall be parked upon any alley or street within the Borough, except as provided herein. This section is not intended to prohibit the parking of motor vehicles commonly known as pickup trucks with or without cargo caps.
A. 
Adjacent resident exception. This parking restriction shall not apply to vehicles actively engaged in delivering products or rendering services requested by a property owner or resident adjacent to any alley or street.
B. 
Emergency vehicle exception. This parking restriction shall not apply to vehicles actively engaged in rendering emergency services such as ambulances, fire trucks and vehicles plowing snow.
C. 
Loading and unloading exception. This parking restriction shall not apply to vehicles actively engaged in the loading or unloading of passengers, merchandise for a business or materials for a job site during the period of construction.
D. 
Public improvement exception. This parking restriction shall not apply to vehicles owned, operated or authorized by the City, county or state which are actively engaged in the installation, maintenance or repair of public improvements or streets or the rendering of other governmental services.
E. 
Public utility exception. This parking restriction shall not apply to vehicles owned or operated by a public utility company actively engaged in the installation, maintenance or repair of public utilities.
Pursuant to N.J.S.A. 40:67-16.1, the streets or parts of streets as described are hereby designated as routes for vehicles over four tons. All trucks having a total combined registered gross weight of vehicle plus load in excess of four tons shall be excluded from all streets, except from those streets listed which form a part of the system of truck routes. Vehicles will be permitted on all streets for the purpose of the pickup and delivery of materials.

The owners of the premises referred to in the above sections shall provide and install signs and pavement markings for use by handicapped persons, which signing and marking shall be in accordance with the Manual on Uniform Traffic Control Devices. The cost of the procurement and installation of the signs to be paid by the owner of said property. The purpose of this article is to establish controls and regulations directed toward the safe and expeditious movement of traffic through construction and maintenance zones throughout the Borough of Buena and to provide for the safety and compensation of the workforce performing these operations.
A. 
The Borough of Buena Council hereby finds and declares that problems of traffic control occur when traffic must be moved through or around street construction, maintenance operations and utility work, above and below ground, which requires blocking streets and obstructing the normal flow of traffic, and that such obstructions are or can become dangerous when not properly controlled. In order to better promote the public health, safety, peace and welfare, it is necessary to enact such guiding principles whereas the aforementioned potential problems may be prevented and avoided.
B. 
The Borough of Buena Council in the County of Atlantic and State of New Jersey does hereby adopt the current Manual on Uniform Traffic Control Devices, as published by the American Traffic Safety Services Association (ATSSA) hereafter known as "MUTCD," except as hereby supplemented and amended, as it controls and regulates whenever construction, maintenance operations or utility work obstructs the normal flow of traffic. A person, contractor or utility that fails to comply with the provisions of MUTCD while performing such work is in violation of this article.
C. 
Statutory authority. In accordance with the provisions of N.J.S.A. 39:4-197.3, the governing body of the Borough is authorized to adopt special traffic regulations by resolution when declaring an emergent or temporary condition that warrants special traffic regulations. These regulations may be provided for a period of time not to exceed three months from the effective date of the resolution. Notice of these regulations shall be given as required by N.J.S.A. 39:4-198. Approval of an emergency resolution is required from the Commissioner of Transportation to be effective pursuant to N.J.S.A. 39:4-202.
D. 
Director authorized to perform certain actions.
(1) 
Pursuant to N.J.S.A. 39:4-98.2, the Director is designated as the official authorized to reduce the regular speed limit on streets under local jurisdiction for up to 72 hours for the purpose of street maintenance and repairs.
(2) 
Traffic detours shall be permitted and traffic directors shall be posted at all construction or maintenance sites when it is determined by the Director/OIC that it is necessary for the health, safety and welfare of the public.

It shall be the responsibility of the person, contractor, or utility wishing to conduct work on, under or above the roadway to contact the Franklin Township Police Department in order to arrange a preconstruction meeting to submit plans for the safe movement of traffic during the period of construction of work. The Franklin Township Police Department has the authority to dictate the number of certified police officers required to ensure the safe movement of traffic in the construction zone. Any person, contractor or utility who fails to comply with this article prior to the start of such work and whose plans are not approved by the Franklin Township Police Department is in violation of this article.

The person, contractor or utility shall provide the Franklin Township Police Department with at least two emergency contact phone numbers to be called in the case of any emergency at the construction or maintenance site prior to the start of any work. If for any reason the emergency contact person cannot be reached or if the emergency person does not respond to the call from the Franklin Township Police Department to correct the hazardous situation, the Borough may respond and correct such hazardous conditions. The reasonable fees for such emergency service by the Borough shall be charged to the person, contractor or utility responsible for such conditions.

Generally, there shall be no construction, Borough maintenance operations or utility work on any roadway in the Borough before the hour of 7:00 a.m. or after 5:00 p.m. This time limit may be adjusted to permit work prior to 7:00 a.m. or after 5:00 p.m. by the Franklin Township Police Department if reasonable conditions apply and after thoroughly reviewing such request.

Road closings and/or traffic detours shall not be permitted unless approved by the Franklin Township Police Department.
Traffic directors, i.e., those police officers certified by Rutgers University as knowledgeable of the Manual on Uniform Traffic Control Devices, shall be posted at all construction or maintenance sites when determined by the Director/OIC, or his designee, that same is necessary to provide for the safe and expeditious movement of traffic.
The Director/OIC or his designee shall have the authority to stop work, including effecting the removal of equipment and vehicles, stored material within the street right-of-way, backfilling of open excavations and/or other related work, in order to abate any nuisance and/or safety hazard or for any violation of this article. The Borough may respond and correct any such hazardous and/or nuisance conditions. The reasonable fees for such emergency service by the Borough shall be charged to the person, contractor or utility responsible for such conditions.
No materials, vehicles or equipment are to be placed in the roadway or sidewalk area until all construction, signs, lights, devices and pavement markings are installed.
A. 
Payment for all certified police officers working all construction highway details for directing the appropriate movement of traffic flow may be coordinated by the Director/OIC or designee. The payment shall be the appropriate rate designated by the Police Department with an additional appropriate percentage fee for fringe benefits, to include but not be limited to social security, unemployment insurance, workers' compensation and an administrative fee of 5% added to the subtotal for all of the expenses that are required. The aforementioned fees shall be waived for nonprofit organizations, local government, local government authorities or other special districts of government and any other just cause and determined by the Director/OIC and affirmed through resolution by Borough Council.
(1) 
Rate: $50 per hour to be paid to each officer from 7:00 a.m. to 5:00 p.m.
(a) 
Hours worked between 5:00 p.m. and 7:00 a.m. will be at a rate of $60 per hour.
(2) 
Administrative fee: $10 per hour for each officer to be retained by the Borough to recover costs associated.
(3) 
Minimum block of time: A minimum of four hours will be paid for each officer working each detail regardless of the actual time worked.
(4) 
Special administrative cost. In the event a serious personnel matter occurs requiring the intervention of the personnel officer of the Borough of Buena, Subsections A(1), (2) and (3) shall apply to compensation of the personnel officers regardless of his/her non-sworn status.
B. 
In the event the Director/OIC or designee determines that the use of a police motor vehicle is necessary, a fee of $50 per day or any part thereof for the use of said vehicle will be charged and made payable to the Borough of Buena. Reference is made to Borough of Buena Code concerning third-party Police Department overtime.
C. 
All payments for road detail assignments shall be paid in advance through an off-duty police escrow account to be known as the "police overtime account," and all funds collected for services rendered shall be paid by and through such account. Reference is made to Borough of Buena Ordinance for third-party overtime. The Director/OIC with consent of the Mayor may waive the prepayment requirement or may amend prepayment requirement to partial deposit.
The person, contractor or utility company shall provide the Borough of Buena Administrator a certificate of insurance naming the Borough of Buena as an additional insured on a general liability insurance policy having policy limits not less than $1,000,000 per occurrence.

Any person, contractor or utility company shall complete an application for a traffic director, which said application shall contain an agreement to indemnify and hold harmless the Borough of Buena for any claims or actions brought as a result of the use of Franklin Township Police Department police officers by said party, including all attorney fees.
A. 
Any person, contractor, or utility who commits a violation of this article shall, upon conviction thereof, for the first offense, pay a fine of not less than $500 nor more than $1,000 and/or may be imprisoned in the county jail for a term not exceeding 90 days, or both; for a second offense, upon conviction thereof, pay a fine of not less than $1,000 nor more than $2,500 and/or may be imprisoned in the county jail for a term not exceeding 90 days, or both.
B. 
A separate offense shall be deemed committed on each day or on which each violation occurs or continues to occur.
