As used in this chapter, the following terms shall have the meanings indicated:
ARTIFICIAL BATHING PLACE
An artificially constructed impounding basin for surface water which is to be used for bathing or swimming by a considerable number of persons other than the immediate family of the owner or proprietor.
PUBLIC BATHING ESTABLISHMENT
As used in this chapter, shall include the grounds, bath houses, toilets and other appurtenances of any bathing establishment on or near any stream, natural or artificial pond, or tidal water, where bath houses for the use of the public are maintained either for free or for hire.
PUBLIC POOL
An artificial basin constructed of concrete, steel, fiberglass or other relatively impervious material intended for recreational bathing, swimming, diving, or therapeutic purposes which is located either indoors or outdoors and is provided by a controlled water supply and which is not used or intended to be used as a pool at a single-family residence. The term also includes a pool located at a single-family residence which is used or intended to be used for commercial or business purposes. The term "public pool" includes any related equipment, structures, areas, and enclosures that are intended for the use of the pool patrons or pool staff, such as toilet, dressing, locker, shower, and pool equipment rooms. Public pools shall be classified as follows:
A. 
PUBLIC SWIMMING POOLSConventional pools used or intended to be used for recreational bathing, swimming and water recreation activities.
B. 
PUBLIC WADING POOLSPools principally used or intended to be used for wading and recreational bathing by small children.
C. 
PUBLIC SPAS, WHIRLPOOLS or HOT TUBSPools used for recreational bathing which are used in conjunction with high-velocity air systems, high-velocity water recirculation systems, hot water, cold water, mineral baths or any combination of these items.
D. 
PUBLIC DIVING POOLSPools used only for diving or the training and practice of diving techniques.
E. 
SPECIAL PURPOSE PUBLIC POOLSPools used exclusively for a particular purpose, including but not limited to water flumes, pools for scuba diving instruction, therapeutic pools, hydrotherapy pools, flotation vessels and pools used in aquatic programs for handicapped persons.
A. 
No person, firm, corporation or institution shall operate a public pool, as defined in this chapter, within the City of West Haven without first obtaining or renewing a permit to operate same from the Health Department of the City of West Haven.
B. 
No permit to operate a public pool within the City of West Haven shall be issued until an inspection has been conducted by the Health Department of the City of West Haven certifying that said public pool is in compliance with Section 19-13-B33b, Public pools, of the Regulations of Connecticut State Agencies.
C. 
Every pool shall be under the immediate supervision of a swimming pool operator at least 18 years of age who shall be held responsible for compliance with all provisions and regulations relating to equipment, pool operation, maintenance, testing and safety of bathers. A certificate of competency obtained by having attended and successfully completed a swimming pool operator's training course acceptable to the Director of Health shall be presented by each operator as evidence of compliance with this section commencing July 1, 2018. The Director of Health may require that the pool operator obtain additional training if inspection(s) of the pool demonstrate that the pool operator lacks the knowledge required to properly and safely operate the pool. Information on how to contact the swimming pool operator shall be posted at the swimming pool whenever the operator is not on the premises where the public pool is located. The name(s) of the swimming pool operator(s) shall be submitted to the Director of Health at the time of application for a permit and shall be kept updated whenever there is a change in personnel.
A. 
No artificial bathing place shall be constructed within the limits of the City of West Haven until the location is approved by the Director of Health of the City of West Haven.
B. 
No person, firm, corporation or institution shall operate an artificial bathing place, as defined in this chapter, within the City of West Haven without first obtaining or renewing a permit to operate same from the Health Department of the City of West Haven.
C. 
No permit to operate an artificial bathing place shall be issued until an inspection has been conducted by the Health Department of the City of West Haven certifying that said artificial bathing place is in compliance with Section 19-13-B34, Artificial bathing places without controlled water supply, of the Regulations of Connecticut State Agencies.
A. 
No person, firm, corporation or institution shall operate a public bathing establishment, as defined in this chapter, within the City of West Haven without first obtaining or renewing a permit to operate same from the Health Department of the City of West Haven.
B. 
No permit to operate a public bathing establishment within the City of West Haven shall be issued until an inspection has been conducted by the Health Department of the City of West Haven certifying that said public bathing establishment is in compliance with Section 19-13-B36, Public bathing establishments, of the Regulations of Connecticut State Agencies.
A. 
Annual permit fee: $100.
B. 
West Haven High School and Carrigan School shall be excluded from any fees.
