A.
The maximum authorized speed of travel on all residential streets
and streets within business districts of the Township shall be 25
mph. The maximum authorized speed of travel on collector streets is
shall be 35 mph, unless provided otherwise by ordinance enacted by
the Board of Supervisors.
B.
West 20th Street, Powell Avenue and Marshall Drive.
(1)
Notwithstanding the provisions of the above subsection, the maximum
authorized speed limit on West 20th Street from its point of tangency
with the east line of Powell Avenue eastwardly a distance of 2,445.30
feet to the point of curvature at which a reduced speed limit sign
shall be posted shall be 45 mph and, from that point eastwardly along
the curve to its end, the maximum authorized speed limit shall be
25 mph.
(2)
Powell Avenue, between West Lake Road and Oxer Road and from its
intersection with West 20th Street south to West Ridge Road, shall
be deemed a collector street and, from West Lake Road northward to
its north end, shall be deemed a residential street.
(3)
Marshall Drive shall be deemed a residential street northwardly from
the northeasternmost point of West 20th Street for its entire length
northward.
C.
It shall be unlawful for any person to drive a vehicle at a higher
speed than the maximum prescribed for that street or part of a street.

Posting of notice. To the extent not previously done, official signs
giving notice of the established speed limit shall be erected and
maintained on all streets. Official signs shall be erected on all
streets proposed to be opened and/or accepted as Township streets
after the date of this ordinance (August 28, 2012) prior to such streets'
being opened and/or accepted.
E.
Violation prohibited. No person shall operate any vehicle at a speed
in excess of the posted and established speed limit, and it shall
be unlawful to operate any vehicle thereon at a speed in excess of
the posted and established speed limit.
F.
Penalty for violation. Any person or persons who shall violate any
of the provisions of this section shall, upon conviction before a
Magisterial District Judge, be sentenced to pay a fine in accordance
with the provisions of Section 3362 of the Vehicle Code, 75 Pa.C.S.A.
§ 3362, as the same may in the future be amended, as well
as costs of prosecution for each separate offense. To the extent permitted
by state law, such fine shall be paid over to the Millcreek Township
Treasurer.
G.
Speed-timing devices. Millcreek Township Police and any other duly
authorized police officers are hereby authorized to use all speed-monitoring
devices approved by PennDOT for the enforcement of the speed provisions
of the Vehicle Code and ordinances of Millcreek Township. This authorization
includes any timing devices authorized by PennDOT or the Commonwealth
after this ordinance's enactment (August 28, 2012) for use by local
police forces. Any device used shall be operated in accordance with
the guidelines or requirements set by PennDOT.
H.
Effect on consistent prior ordinances and future streets. All prior ordinances consistent with the regulations of this section shall be deemed incorporated in this section without being restated. The regulations of this section shall govern the maximum speed of travel on all streets opened and/or accepted after the date of this section without the need for individual ordinances or resolutions; provided, that if the Board of Supervisors should determine that a maximum speed other than those established in Subsection A of this section should be established, such regulations shall be established by ordinance.

B.
Every driver of a vehicle approaching the intersection on the first-named
or stop street, in the direction of travel indicated in each of the
above cases, shall stop the vehicle as required by Section 3323(b)
of the Pennsylvania Vehicle Code, 75 Pa.C.S.A. § 3323(b),
and shall not proceed into or across the second-named or intersecting
or through street until he or she has followed all applicable requirements
of that section of the law.
C.
Any person or persons who shall violate the terms of this section or § 137-15 shall, upon conviction before a Magisterial District Judge, be subject to a fine as provided in the Vehicle Code as set forth in 75 Pa.C.S.A. § 101 et seq., as well as costs of prosecution for each separate offense. To the extent permitted by state law, such fine shall be paid over to the Millcreek Township Treasurer.
The intersections described in this section (in addition to
intersections with the through streets established by this chapter)
are hereby established as yield intersections, and official yield
signs shall be erected in such a position upon the first-named street
as to face traffic approaching the second-named street in the direction
or directions indicated. Every driver of a vehicle approaching any
such intersection upon the first-named street, in the direction or
directions indicated in each case, shall slow down or stop the vehicle
and then yield the right-of-way to any vehicle in the intersection
or approaching on the second-named street so closely as to constitute
a hazard during the time that the driver is moving across or within
such intersection.

B.
Penalty for violation. Any person or persons who shall violate any of the provisions of §§ 137-16 and/or 137-17 shall, upon conviction before a Magisterial District Judge, be sentenced to pay a fine in accordance with the provisions of Section 4902 of the Vehicle Code, 75 Pa.C.S.A. § 4902, as the same may in the future be amended, as well as costs of prosecution for each separate offense. To the extent permitted by state law, such fine shall be paid over to the Millcreek Township Treasurer.
