A.
A person commits the offense of abandonment of an airtight or semi-airtight
container if he or she knowingly abandons, discards, or permits to
remain on premises under his or her control, in a place accessible
to children, any abandoned or discarded icebox, refrigerator, or other
airtight or semi-airtight container which has a capacity of one and
one-half (1 1/2) cubic feet or more and an opening of fifty (50)
square inches or more and which has a door or lid equipped with hinge,
latch or other fastening device capable of securing such door or lid,
without rendering such equipment harmless to human life by removing
such hinges, latches or other hardware which may cause a person to
be confined therein.
B.
Subsection (A) of this Section does not apply to an icebox, refrigerator or other airtight or semi-airtight container located in that part of a building occupied by a dealer, warehouse operator or repair person.
D.
The offense of abandonment of an airtight or semi-airtight container
is an ordinance violation.
A person commits the offense of littering if he or she places,
deposits, or causes to be placed or deposited, any glass, glass bottles,
wire, nails, tacks, hedge, cans, garbage, trash, refuse, or rubbish
of any kind, nature or description on the right-of-way of any public
road or State highway or on or in any of the waters in this City or
on the banks of any stream, or on any land or water owned, operated
or leased by the State, any board, department, agency or commission
thereof or on any land or water owned, operated or leased by the Federal
Government or the City, or on any private real property owned by another
without the owner's consent.
A.
A person commits the offense of unlawful disposition of a dead animal
if he or she knowingly places or causes to be placed the carcass or
offal of any dead animal:
A.
A person
commits the offense of tampering with a water supply if he or she
purposely:
1.
Poisons, defiles or in any way corrupts the water of a well, spring,
brook or reservoir used for domestic or municipal purposes; or
2.
Diverts, dams up and holds back from its natural course and flow
any spring, brook or other water supply for domestic or municipal
purposes, after said water supply shall have once been taken for use
by any person or persons, corporation, town or city for his/her, their
or its use.
B.
The
offense of tampering with a water supply is an ordinance violation.
A.
The
term "fireworks", herein referred to, means all types
of fireworks except sparklers.
B.
It
shall be unlawful for any person to discharge or cause to be discharged
any fireworks as described in this Section except as stated below:

1.
New Year's Eve at Midnight.
2.
From July 2nd up to and including July 6th:
a.
July 3rd and 4th from 10:00 a.m. to 11:00 p.m. (regardless of the
day of the week).
b.
When July 2nd, July 5th and July 6th falls on Sunday, Monday, Tuesday,
Wednesday, or Thursday fireworks can be legally discharge from 10:00
a.m. to 10:00 p.m.
c.
When July 2nd, July 5th and July 6th falls on a Friday or Saturday
fireworks can be legally discharge from 10:00 a.m. to 11:00 p.m.
C.
It
shall be lawful for a person, legal entity, company or business to
sell fireworks within the City limits of Truesdale, provided they
meet all Federal, State, County and City laws referencing licensing,
days and hours of operation, and the collecting of the applicable
taxes.
D.
It
shall be unlawful for any person to discharge or cause to be discharged
any fireworks of any kind from a motor vehicle or towards a motor
vehicle.

A.
Permit.
Each permit for a temporary firework stand shall require a City of
Truesdale Business License.
B.
Application.
An application for a temporary firework stand permit must be applied
for each year by June 1. Applications are to be reviewed and approved
by Board of Aldermen during the first meeting in June. It will be
required to have a letter from the property owner approving the location
of the stand.
C.
Transfer
Of Permits. All temporary firework stand permits approved and issued
by the Board of Aldermen are personal to the applicant and are non-transferable.
The sale of fireworks or operations of a facility for the sale of
fireworks by someone other than the license holder shall void the
permit and cause forfeiture of the permit and permit fee.
D.
Permit
Fee. Any person, firm, or corporation making application for a temporary
fireworks stand permit shall accompany said application with a fee
of two hundred fifty dollars ($250.00) plus the normal fee for a business
license. If the Board of Aldermen does not approve the application,
the permit fee shall be returned to the applicant. If the application
is approved, the total fee shall be retained by the City of Truesdale,
and the fee collected shall go to the General Fund of the City.
E.
A permit
for a temporary fireworks stand shall be valid for sixty (60) days
but sales are restricted to dates from June twentieth (20th) to July
tenth (10th) and shall not exceed State Statutes.
F.
Any
person, firm or corporation making the application for a temporary
fireworks stand shall provide a certificate of insurance showing general
liability of five hundred thousand dollars ($500,000.00)/one million
dollars ($1,000,000.00) and naming the City as an additional insured.
G.
Inspection
and approval from the Fire Department and the City's building inspector
is required prior to opening the stand.
H.
The
stand must be located a minimum of twenty (20) feet from any other
temporary or permanent building and a minimum of one hundred (100)
feet from residential housing or units.
I.
The
stand is to be a minimum of three hundred (300) feet from another
firework stand.
J.
A certificate
or other evidence of acceptance by an organization of recognized standing
or manufacturer verification that any tent fabric material has been
treated with a flame-resistance material.
K.
No
alcoholic beverages should be consumed on the premises of the firework
stand.
L.
Requirement
For Fire Extinguishers. Every firework stand shall have a minimum
of two (2) ABC fire extinguishers of at least ten (10) pounds each
which shall be kept in the firework stand. Every firework stand shall
have one (1) fire extinguisher for every seventy-five (75) feet of
display counter.
M.
No
Smoking Signs. "No Smoking" signs shall be placed every fifteen (15)
feet along the exterior and interior of the fireworks stand.
