§ 168-1 Election to administer and enforce.

The Board of Supervisors of Manor Township hereby elect to administer and enforce the provisions of the Pennsylvania Construction Act, Act 45 of 1999,[1] as amended from time to time, and its regulations.

§ 168-2 Standards adopted by reference.

The Uniform Construction Code Act contained in 34 Pa. Code, Chapters 401 to 405, as amended from time to time, is hereby adopted and incorporated herein by reference as the Municipal Building Code of Manor Township.

§ 168-3 Methods of administration and enforcement.

Administration and enforcement of the Code and its regulations within Manor Township shall be undertaken by either the designation of an employee of Manor Township to serve as the Municipal Code Official or by retention of one or more Construction Code Officials or third-party agencies to act on behalf of Manor Township.

§ 168-4 Board of Appeals.

A. 
A Board of Appeals shall be established by ordinance of Manor Township in conformity with the requirements of the relevant provisions of the General Local Government Code, 53 Pa.C.S.A. § 2301 et seq., by establishing a joint board of appeals in conjunction with the seven municipalities that are members of the Lancaster Intermunicipal Municipal Committee, which joint board of appeals should be known as the "Central Lancaster County Uniform Construction Code Board of Appeals" through an intermunicipal agreement. The seven municipalities that are members of the Lancaster Intermunicipal Committee are: East Petersburg Borough, Manor Township, Millersville Borough, Mountville Borough, Pequea Township, West Hempfield Township, and West Lampeter Township.
B. 
Appeals pertaining to the accessibility requirements of the code shall not be heard by the Board of Appeals, but shall be filed with and considered by the Pennsylvania Department of Labor and Industry for project modification approval.

§ 168-5 Effect on prior ordinances.

A. 
All building code ordinances or portions of ordinances which were adopted by Manor Township on or before July 1, 1999 (including Ordinance No. 4-89, relating to fire prevention and fire protection in rental units and/or multiple-family dwelling units), and which equal or exceed the requirements of the code and its regulations, shall continue in full force and effect until such time as such provisions fail to equal or exceed the minimum requirements of the code and its regulations, as amended from time to time.
B. 
All building codes or portions of building codes which are in effect as of the effective date of this chapter and whose requirements are less than the minimum requirements of the Pennsylvania Construction Code Act and its regulations shall be amended to conform with the comparable provisions and regulations of the Pennsylvania Construction Code Act.
C. 
All relevant ordinances, regulations, and policies of Manor Township not governed by the Pennsylvania Construction Code Act and its regulations shall remain in full force and effect.

§ 168-6 Fees.

Fees assessable by Manor Township for the administration and enforcement undertaken pursuant to this chapter and the Pennsylvania Construction Code Act shall be established by the governing body by resolution from time to time.

§ 168-7 Effective date.

This chapter shall be effective on July 7, 2004.
