This article may be cited as the "Park Ordinance of 2013."
As used in this article, the following terms shall have the meanings indicated:
AUTHORIZED REPRESENTATIVE
The Township Manager or other employees or officials authorized by the Board of Supervisors of the Township to administer and enforce provisions of this article.
PARK(S)
Includes all public parks located in Manor Township.
TOWNSHIP
Manor Township.
It shall be unlawful for any person to commit or do any of the acts described below within the limits of any Township park or Township property:
A. 
Hours: to be in Township parks between sunset and sunrise unless authorization is given by the Manor Township Office.
B. 
Animals.
(1) 
To permit any dog or other animal except wildlife to run at large.
(2) 
To fail to pick up and dispose of any dog or other animal defecation.
C. 
Gambling. To engage in any unlawful gambling.
D. 
General guidelines.
(1) 
To commit any public nuisance.
(2) 
To swim, wade or bathe at any place.
(3) 
To skateboard or roller blade.
(4) 
To use profane language within a park, or use threatening language, or conduct themselves in any lewd, immoral or commonly objectionable manner within a park, or conduct themselves so as to annoy any other person using a park for recreational purposes.
(5) 
To engage in camping.
(6) 
To hit golf balls.
(7) 
To use metal detectors or other related devices.
(8) 
To violate any posted rules for or misuse any picnic area, court, ballfield or other recreational area.
(9) 
To use park trash receptacles for trash not generated in the course of using the park.
(10) 
To post or erect any bills, notices or advertising matter of any kinds, provided this shall not apply to notices placed by employees of Manor Township engaged in the performance of their duties.
E. 
Firearms.
(1) 
To throw stones, launch missiles or model rockets or operate radio-controlled toys.
(2) 
To hunt for, shoot at, chase, catch, or intentionally injure or kill or attempt to shoot at, or chase, catch or intentionally injure or kill any bird or animal.
(3) 
To discharge firearms, fireworks, bows and arrows, air or spring rifles, slings or any other weapons.
F. 
Injuring or destroying property.
(1) 
To break, cut, deface, disturb, injure, take, gather, or remove any flower, fruit, plant, tree, shrub, bench, building, fence, monument, or other structure or apparatus of any property of Manor Township.
(2) 
To gather or remove any wood, turf, grass, soil, rock, sand or gravel.
(3) 
To throw or deposit cans, bottles, broken glass, paper or rubbish of any description except in the containers provided for the same or to discard any refuse, dead animal or offensive matter or substance of any kind.
G. 
Smoking and alcohol.
(1) 
Smoking of any kind is prohibited in and on Township property.
(2) 
To discard lighted matches, cigars, cigarettes in any area.
(3) 
To smoke or kindle fire except in picnic stoves or fireplaces or grills provided for that purpose.
(4) 
To possess, drink, be drunk or be under the influence of alcoholic beverages.
H. 
Vehicles.
(1) 
To polish, wash or repair any motor vehicle except for emergency repairs.
(2) 
Speed: maximum 10 miles per hour.
(3) 
To stand or park any vehicles except at those places designated therefor.
(4) 
To operate unlicensed motor vehicles, snowmobiles, minibikes, or go-carts. Motorized vehicles for handicapped access are permitted.
(5) 
To operate any vehicle or bicycle at any place other than roadways or special areas designated for operation of such vehicles.
(6) 
To park or let stand any vehicles in any area of any Township park between 12:00 midnight and 6:00 a.m. without permission from Manor Township.
(7) 
To abandon any vehicle within the limits of any park.
I. 
Groups and concessions.
(1) 
To have any organized group conduct activities or foot races of any kind without having first secured a permit from the Manor Township Office.
(2) 
To sell or offer for sale any merchandise, article, or thing whatsoever, provided this shall not apply to authorized concessionaires.
(3) 
To have any musical, theatrical, or other entertainment therein without a permit or written permission from the Manor Township Office.
(4) 
To congregate in or block off any area which will hamper the free movement of pedestrians.
J. 
Manor Township rail trail.
(1) 
To operate motorized vehicles on the trail except for the use of emergency and maintenance vehicles or authorized by the Manor Township Office.
(2) 
To have, bring, ride or walk equine and/or equine accessories of any kind on Manor Township property.
(3) 
To deviate from the trail surface.
(4) 
To climb in undesignated areas.
(5) 
To leave trash anywhere on the trail. It is a carry-in/carry-out facility. Trash and recycling containers are not provided.
A. 
Whenever authorization is required by this article, such shall be sought from the Township Manager or other employee or employees authorized by the Board of Supervisors from time to time and shall be subject to rules and regulations adopted from time to time. Any such authorization shall be subject to such rules and regulations as fully as though the same were inserted in the specific authorization granted to permit the proposed use.
B. 
Any person or persons who have received such authorization, by reservation or otherwise, shall be liable for any loss, damage or injury sustained by any person or to any Township property by reason of the negligence or intentional conduct of the person or persons to whom the authorization was granted or by such person's agent, employees or invitees.
C. 
It shall be unlawful for any person receiving authorization to the park to make an alteration to such authorization.
D. 
Specific portions of this article or any rules or regulations adopted under it may be waived only upon written approval of the Board of Supervisors or their designee.
E. 
The Board of Supervisors may from time to time, by separate resolution, establish reasonable fees and deposit arrangements for the use of the park therein and may adopt reasonable rules and regulations consistent with the provisions of this article.
Any person who violates or permits a violation of this article shall, upon conviction in a summary proceeding brought before a Magisterial District Judge under the Pennsylvania Rules of Criminal Procedure, be guilty of a summary offense and shall be punishable by a fine of not more than $1,000, plus costs of prosecution. In default of payment thereof, the defendant may be sentenced to imprisonment for a term not exceeding 90 days. Each day or portion thereof that such violation continues or is permitted to continue shall constitute a separate offense, and each section of this chapter that is violated shall also constitute a separate offense.
