A. 
Policy. On November 4, 2003, the City of Vinita Park voters approved the proposition to assess up to fifty dollars ($50.00) per year on all residential property containing six (6) or fewer dwelling units to provide funds to pay the cost of certain repairs of defective lateral sewer service lines serving such dwelling units. The City has made an investigation and has concluded that, for 1999, these funds will allow the City to pay up to eighty percent (80%) of the cost of such repairs. As the repair fund grows, the City will review its actual experience and, for future years, may adjust the percentage of payment.

Effective as of October 21, 2002, the owner of a single-family home, duplex or apartment building containing not more than six (6) dwelling units may recover fifty percent (50%) of such owner's costs in repairing defective lateral sewer service lines serving the property of the owner, in compliance with the City policy, as set out herein.

A lateral sewer service line is the portion of the sewage system that carries household waste from the foundation to the sewer main. It does not include a sewer line located under any part of the building. A lateral sewer service line may be located in a front, side or rear yard and may pass through a neighboring yard.

If an owner is experiencing a problem with the lateral sewer service line, the owner should contact Vinita Park City Hall and fill out an application. The owner must also provide the City with a copy of the paid real estate tax bill for the property. The City will contract a plumbing company or a drain and sewer cleaning company to have the line televised. A copy of the televised survey will be given to the Vinita Park Public Works Department. Sometimes the problem is not with the sewer line, but it may have become clogged up from the entry of improper materials into the line. If it is found that this is the situation, the City of Vinita Park must be given written verification from a licensed plumber that the sewer line has been cabled and jetted. The costs of cleaning out the sewer line will be the property owner's responsibility.

If the televised survey discloses that there is a break in the lateral sewer service line, the City will pay fifty percent (50%) of the cost of the survey. In addition, if it is determined that the sewer service line is defective, the City may hire a contractor to perform the corrective work. Any such contractor must obtain any necessary permits from the City before the work commences.

The City will obtain a minimum of three (3) bids for the work in order to make sure that a contractor has given a fair, competitive bid. Bids will be reviewed and acceptance of a bid will be made by the Board of Aldermen of the City of Vinita Park based upon the recommendation of the Public Works Director.

Upon acceptance of a bid, the owner will be notified of the contractor hired to perform the work and the amount of the bid. Owner must pay his/her portion of the bid price, fifty percent (50%), to the City of Vinita Park in the form of a cashier's check prior to the contractor beginning work. The City of Vinita Park will not issue the contractor a notice to proceed until the owner remits his/her portion of the bid price to the City of Vinita Park.

If, during the work, unforeseen problems arise and additional work is required causing an increase in the original bid price, the owner will be notified by the City of Vinita Park. The owner will be responsible for fifty percent (50%) of the cost of the additional work. The City of Vinita Park will pay the remaining fifty percent (50%) of the cost of the additional work.

The corrective work which is subject to reimbursement is limited to excavation, repair or replacement of the line, backfilling, seeding and strawing the disturbed portion of the yard and restoring the property to minimum occupancy standards. Landscaping, fences, dog fences, sprinkler systems and other additional work are not reimbursable items.

Prior to backfill of the trench holding the lateral sewer line the owner and the contractor share the responsibility of having the work inspected by the Director of Public Works. There shall be no backfill authorized until such inspection is made and the work performed by the contractor approved by the Director of Public Works.

Upon completion of the corrective work and proper inspection by the Director of Public Works, the owner is to file an affidavit with the City of Vinita Park Public Works Department which shows that the work has been completed and the owners are satisfied with the performance of the contractor. The City will then review the affidavit and if the work is determined by the City to have been for the repair of a defective line as authorized under the contract, the City will pay fifty percent (50%) of such corrective work directly to the contractor.
11. 
The City has no obligation or responsibility for the performance by the contractor and no responsibility for any damages caused to the owner's property because of the sewer line defects.
12. 
The City of Vinita Park may periodically amend this policy in the best interests of the City and its homeowners, except as may be restricted by State law or City ordinance.
