No person shall smoke, ingest, or otherwise consume marijuana
or tetrahydrocannabinol (as defined in MGL c. 94C, § 1,
as amended) while in or upon any street, sidewalk, public way, footway,
passageway, stairs, bridge, park, playground, beach, recreation area,
boat landing, public building, schoolhouse, school grounds, cemetery,
parking lot, or any area owned by or under control of the Town, or
in or upon any bus or other passenger conveyance operated by a common
carrier within the Town, or in any place accessible to the public
within the Town.
Violation of § 117-1 is punishable by a fine of up to $300, enforceable through criminal indictment or complaint under MGL c. 40, § 21. Any penalty imposed under this bylaw shall be in addition to any civil penalty imposed under MGL c. 94C, § 32L.

Editor's Note: This bylaw was adopted subsequent to a
moratorium on recreational marijuana establishments imposed 5-9-2017
ATM by Art. 22.
Consistent with MGL c. 94G § 3(a)(2), all types of
nonmedical "marijuana establishments" as defined in MGL c. 94G § 1,
including marijuana cultivators, independent testing laboratories,
marijuana product manufacturers, marijuana retailers or any other
types of licensed marijuana-related businesses, shall be prohibited
in the Town of Boxford.
