This Part 3C shall be known and may be cited as the "Lower Southampton Township Planning Commission Ordinance."
2. 
The purpose of this Part 3C is to create and establish a planning commission for the Township of Lower Southampton pursuant to the provisions of the Pennsylvania Municipalities Planning Code, 53 P.S. § 10101 et seq.

There is hereby created and established in the Township of Lower Southampton a planning commission to be known as the "Lower Southampton Township Planning Commission" (hereinafter referred to as the "Planning Commission"), consisting of nine members who shall reside within the Township and who shall serve without compensation but may be reimbursed for necessary and reasonable expenses.

The members of the Planning Commission shall be appointed by the Board of Supervisors. The terms of members appointed after January 1, 1969, to a vacancy created by the expiration of a term shall be for four years or until a successor is appointed and qualified. Of the two members first appointed to the positions created by Ord. 350, one appointee shall serve until the first Monday of January 1989, and the second appointee shall serve until the first Monday of January 1990, or until their successors are appointed and qualified.

The Planning Commission shall have all the powers and duties conferred and imposed upon it as set forth in the Pennsylvania Municipalities Planning Code, 53 P.S. § 10101 et seq., as the said Act of Assembly may hereafter be amended and supplemented, and as may hereafter be conferred upon such commissions by Acts of Assembly of the Commonwealth of Pennsylvania.

The Planning Commission shall have appropriated to its use from the general fund of the Township of Lower Southampton by the Board of Supervisors, in the same manner as other appropriations are made, such money as in the opinion of the Board of Supervisors is necessary and is available for the work of the Planning Commission for the year in which the appropriation is made.

The Board of Supervisors of the Township of Lower Southampton may establish as the Official Map of the Township any part of a development plan prepared and adopted by the Planning Commission established hereunder with respect to the location and width of streets, highways and parkways and the location and extent of public parks and playgrounds. Establishment of the Official Map shall be by ordinance, after public hearing, with notice of such public hearing to be published in a newspaper of general circulation in the Township at least 10 days prior to the hearing. Such map, subject to amendments as hereinafter provided, is to be deemed official and conclusive and is hereby declared to be established to conserve and promote the public health, safety, morals and general welfare.

The Board of Supervisors may, whenever and as often as it may deem it for the public interest, change or add to the Official Map of the Township in the manner and by the methods set forth in the Pennsylvania Municipalities Planning Code, 53 P.S. § 10101 et seq., or as otherwise provided by law.

For the purpose of preserving the integrity of the Official Map of the Township, no person shall be issued a permit for any building in the bed of any street shown or laid out on the Official Map, except that, when the property of an applicant of which such reserved location forms a part cannot yield a reasonable return to the owner unless such permit be granted, the Zoning Hearing Board may, in a specific case, by a vote of a majority of its members, grant a permit for a building in such street which will, as little as practicable, increase the cost of opening such street or tend to cause a change of the Official Map, and the Zoning Hearing Board shall impose reasonable requirements as a condition of granting the permit so as to promote the health, morals, safety and general welfare of the public.
4. 
No public sewer, water main or other Township street, utility or improvements shall be constructed in or so as to serve any street, highway, parkway, playground or park until the street, highway, parkway, playground or park is duly placed on the Official Map.

The Board of Supervisors, before approving plans for proposed subdivisions of land, shall refer such plans to the Planning Commission for its recommendation. If the Planning Commission shall not make its recommendation thereon within 30 days after such reference, the Planning Commission shall be deemed to consent thereto.
