1. 
The Fire Prevention Code shall be enforced by the Township Fire Marshal.
2. 
The Fire Marshal shall be appointed by the Board of Supervisors at its annual reorganization meeting for a term of one year.
3. 
The Fire Marshal may detail such members of the fire companies as assistants and as inspectors as from time to time shall be necessary.
4. 
The Fire Marshal shall enforce all ordinances relating to the following subjects:
A. 
Inspection of potential fire hazards.
B. 
Abatement of existing fire hazards.
C. 
Investigation of the cause, origin and circumstances of fires.
D. 
Control and use of flammable liquids and flammable articles.
E. 
The enforcement of the provisions of the International Fire Code as may be adopted by the Township.
5. 
A report of the Fire Marshal shall be made annually and transmitted to the Board of Supervisors of the Township of Lower Southampton with such statistics, recommendations and suggested amendments as the Fire Marshal may desire to include therein.

The Fire Marshal shall have the power to modify any of the provisions of the International Fire Code upon application, in writing, by the owner or lessee or a duly authorized agent when there are practical difficulties in the way of carrying out the strict letter of the code, provided that the spirit of the code shall be observed, public safety secured and substantial justice done. The particulars of such modification, when granted or allowed, and the decision of the Fire Marshal thereon shall be entered upon the records of the Township, and a signed copy shall be furnished to the applicant.

Whenever the Fire Marshal shall disapprove an application, refuse to grant a permit applied for, or shall issue an order to eliminate a dangerous or hazardous condition, or when it is claimed that the provisions of the code do not apply or that the true intent and meaning of the International Fire Code have been misconstrued or wrongly interpreted, the applicant or person against whom such order has been issued may appeal from the decision of the Fire Marshal to an appeal board composed of the Chiefs and Deputy Fire Chiefs of the fire companies housed in Lower Southampton Township within 10 days from the date of the decision of such action by the Fire Marshal.
