This part shall be known and may be cited as the "Solid Waste Management Ordinance" of the Township of Lower Southampton.

It is hereby declared to be the purpose of this part to coordinate and to regulate the storage, collection, transportation, process and disposal of all solid waste materials as herein defined in order to protect the public safety, health and welfare of the people of the Township of Lower Southampton, hereinafter referred to as "Township."

For the purpose of this part, the following words and phrases shall have the meaning given herein:
ABANDONED VEHICLES
Motor vehicles and trailers that are discarded on public or private property. Any vehicle having an expired license which is not in a protective enclosure or in an area for stripping, processing or scrapping shall be considered abandoned. Vehicles with currently valid licenses should be considered abandoned when they remain in or on the public thoroughfare in nonworkable condition for 48 hours or longer.
ACT 97
The Pennsylvania Solid Waste Management Act of 1980, P.L. 380, No. 97, July 7, 1980, 35 P.S. § 6018.101 et seq.
ACT 101
The Pennsylvania Municipal Waste Planning, Recycling and Waste Reduction Act of 1988, Act 1988-101, July 28, 1988, 53 P.S. § 4000.101 et seq.
ASHES
The residue resulting from the burning of wood, coal or other combustible material. This definition excludes ashes resulting from industrial processes.
AUTHORIZED COLLECTOR
A person, individual, partnership or corporation or employer or agent thereof authorized by contract with the Township to collect solid waste from residential, commercial and institutional properties, as herein defined, under the terms and conditions of this part. In the event of municipal collection, this definition shall include the Board of Supervisors and employees thereof.
BOARD OF SUPERVISORS
The elected officials of the Township.
BULKY WASTE
Large items of refuse, including, but not limited to, appliances, large auto parts, furniture, and large trees and branches, which require collection in other than conventional compactor refuse collection vehicles.
COLLECTOR or WASTE HAULER
Any person, firm, partnership, corporation or public agency who is engaged in the collection and/or transportation of municipal waste and/or source-separated recyclable materials.
COMMERCIAL PROPERTIES
All properties used for industrial, commercial, business or office purposes, provided that apartment complexes of four or more residential units and condominium associations having a valid contract with a private hauler for solid waste collection and disposal as of January 2, 1989, for purposes of this part, shall be treated as commercial properties.
COMPOSTING
A controlled microbial degradation of organic waste to produce a relatively nuisance-free product of potential value as a soil conditioner.
COMPOSTABLE MATERIAL
Organic waste which is capable of undergoing composting. This material include leaves and leaf waste and other yard waste.
COMPOSTING PLANT
A facility at which composting is done.
CONTAINER
Can, bag, mechanical bin, box or disposable container used for storage of refuse.
COORDINATOR
The individual designated by the Board of Supervisors to be responsible for solid waste management within the Township.
COUNTY
The County of Bucks, Pennsylvania.
DEAD ANIMALS
Those animals, not exceeding 10 pounds, that die naturally, from disease or are accidentally killed. Condemned animals or parts of animals from slaughterhouses or similar places are not included in this term but are regarded as industrial refuse.
DEPARTMENT or DEP
The Pennsylvania Department of Environmental Protection.
DETACHABLE CONTAINER or MECHANICAL BIN
Any metal container which may be mechanically lifted and emptied into the collection vehicle.
DISPOSAL
The deposition, injection, dumping, spilling, leaking or placing of solid waste into or on the land or water in a manner that the solid waste or a constituent of the solid waste enters the environment, is emitted into the air or is discharged to the waters of this Commonwealth. Disposal facilities include, but are not limited to, municipal waste landfills and construction/demolition waste landfills as defined by Act 101, 53 P.S. § 4000.101 et seq.; Act 97, 35 P.S. § 6018.101 et seq.; and/or DEP rules and regulations, e.g., 35 Pa. Code Chapters 75 and 271.
DISPOSAL SITE
A site, location, tract of land, area or premises used or intended to be used for solid waste disposal.
DUMP
A site for the consolidation of waste from one or more sources which has little or no management.
FARM PROPERTY
A parcel or parcels of land devoted to agriculture, either to raising crops, livestock, poultry or pasture.
GARBAGE (FOOD WASTE)
Animal or vegetable waste resulting from the handling, preparation, cooking and serving of foods. It does not include wastes from industrial processing or manufacturing of food products, bodies of dead animals, or human and animal excrement.
HAZARDOUS WASTE
Solid waste that is especially harmful or potentially harmful to public health. This shall include, but not be limited to, explosives, toxic materials and medical waste. For purposes of this part, "hazardous waste" does not include small quantities of such waste available on a retail basis to the homeowner, e.g., aerosol cans, pesticides, fertilizers, etc.
INCINERATOR
Any device used for the burning of solid waste where the factors of combustion, i.e., temperature, retention time, turbulence and combustion air, can adequately be controlled.
LEAF WASTE
Leaves, garden residues, shrubbery and tree trimmings, and similar material, but not including grass clippings.
MUNICIPAL WASTE
Any garbage, refuse, industrial lunchroom or office waste and other material, including solid, liquid, semisolid or contained gaseous material, resulting from operation of residential, municipal, commercial or institutional establishments and from community activities, and any sludge not meeting the definition of residual or hazardous waste under Act 97, 35 P.S. § 6018.101 et seq., from a municipal, commercial or institutional water supply treatment plant or air pollution control facility. This term does not include any source-separated recyclable materials.
OPERATOR
Any person who manages any solid waste storage, transfer, processing or disposal operation.
PERSON
Any individual, firm, partnership, association, corporation, institution or other entity.
PRIVATE COLLECTOR
A collector licensed by the Township to provide waste collection and waste handling and disposal services to commercial and/or institutional properties on a private contract basis.
PROCESSING
Any technology used for the purpose of reducing the volume or bulk of municipal or residual waste or any technology used to convert part or all of such materials for off-site reuse. Processing facilities include, but are not limited to, transfer facilities, recycling facilities, composting facilities, and resource recovery facilities.
RECYCLABLE MATERIALS
Those materials specified by the Township for separate collection in accordance with recycling regulations. Such materials may include, but not be limited to, aluminum products, ferrous containers, bimetal containers, glass containers, newspapers, magazines and periodicals, plastic containers and yard wastes.
RECYCLING
The separation, collection, processing, recovery and sale or reuse of metals, glass, paper, plastics and other materials which would otherwise be disposed of as solid waste.
REFUSE
All solid wastes, except body wastes; shall include, but is not limited to, garbage, ashes, bulky waste and rubbish; except that "refuse" shall specifically exclude hazardous waste.
RESIDENTIAL PROPERTY
Properties used as dwellings, including buildings having up to three dwelling units in one building. Multiple-dwelling residential buildings containing more than three dwelling units, as well as condominium associations having a valid contract with a private hauler for solid waste collection and disposal as of January 2, 1989, shall be treated as commercial properties, provided that such apartment complexes and/or associations utilize dumpster service.
RESIDUE
Solid materials remaining after burning, including, but not limited to, ashes, metals, glass, ceramic and unburned organic substances.
RUBBISH
Solid waste exclusive of garbage, e.g., nonrecyclable glass, metal, paper or plastic, and noncompostable plant material, wood or nonputrescible solid waste.
SALVAGE OPERATION
Any business, trade or industry engaged in whole or in part in salvaging or reclaiming any product or material, including, but not limited to, automobiles, metals, chemicals, shipping containers or drums.
SALVAGING
The controlled removal of reusable materials at a salvage operation.
SANITARY LANDFILL
A Pennsylvania DEP-approved method of disposing of refuse on land without creating nuisances or hazards to the public health or safety. This is done by confining refuse to the small practical volume and covering it with a layer of earth at the conclusion of each day's operation or at such more frequent intervals as may be necessary.
SCAVENGING
Uncontrolled or unauthorized removal of solid waste materials.
SOLID WASTE
Garbage, refuse and other discarded solid materials, including, but not limited to, solid waste materials resulting from industrial, commercial and agriculture operations and from community activities. Liquids, semisolids and contained gaseous materials are hereby defined as solid waste. It shall not include solids or dissolved material in domestic sewage or other significant pollutants in water resources, such as silt, dissolved or suspended solids in industrial wastewater effluents, dissolved materials in irrigation return flows, or other common water pollutants. In addition, it shall not include hazardous waste.
SOLID WASTE MANAGEMENT
The purposeful systematic control of the storage, collection, transportation, processing and disposal of solid waste.
SOURCE-SEPARATED RECYCLABLE MATERIALS
Materials, including leaf waste, that are separated from Township waste at the point of origin or generation for the purpose of recycling.
TOWNSHIP
The Township of Lower Southampton, Bucks County, Pennsylvania.
TRANSFER STATION
A fixed facility used for receiving refuse from collection trucks and placing it in large-volume, long-haul vehicles.
TRANSPORTATION
The off-site removal of any Township waste at any time after generation.
YARD WASTE
Prunings, grass clippings, weeds, leaves and general yard and garden wastes.

The Board of Supervisors shall be responsible for all aspects of solid waste management within the Township.
A. 
Residences. Recyclable materials shall be placed at curb separate from solid waste for collection at such times and dates as may be hereinafter established by regulation.
B. 
Commercial and industrial establishments. Recyclable materials shall be placed at the designated indoor or outdoor collection station for each respective establishment for collection as often as is required to prevent accumulation of the volumes generated and to avoid or prevent environmental problems, but no less than once per month by a private collector.

1. 
No person shall permit any solid waste to accumulate for a period of longer than seven days upon property owned or occupied by said person in the Township.
2. 
Owners and occupiers of residential property are hereby required to make accumulated solid waste available for collection as scheduled under the terms hereof.
3. 
Owners, occupiers and tenants of farm property are not subject to the provisions of Subsections 1 and 2.
4. 
All solid waste accumulated on any residential property in the Township shall be collected, conveyed and disposed of by the Township or by an authorized collector under contract with the Township or by private collector and in accordance with the provisions of this part; except that recyclable materials may be collected, conveyed and disposed of by property owners from their own property for the intended purpose of depositing such recyclables in recycling centers, provided they comply with the provisions of this part pertaining to refuse containers and vehicles, and providing they remove their recyclables to a site approved by the Township. Private collectors will be permitted to collect, convey and dispose of solid waste which has accumulated on residential property in the Township only in the circumstances where the Township or an authorized collector under contract with the Township does not collect, convey and dispose of solid waste which accumulates on residential properties in the Township.
5. 
All solid waste accumulated on commercial and institutional properties shall be collected, conveyed and disposed of by collectors under contract with or licensed by the Township. In such case where a commercial or institutional establishment contracts directly with a collector, the fee or payment shall be a matter of private agreement between the owners or occupiers and the collector. When approved by the Township, owners of nonresidential properties may collect, convey and dispose of privately generated solid waste by their own containers and/or trucks, providing they comply with the provisions of this part applicable thereto.
6. 
It shall be unlawful for any person to collect and dispose of any solid waste within the Township except as provided in this part.

1. 
It shall be unlawful to keep or allow in or about any dwelling or upon any land or other premises within the Township solid waste of any kind which is obnoxious or offensive by reason of dust or odor or which attracts insects and vermin, except in covered receptacles; the cover shall be tight and flyproof. It shall be unlawful to retain accumulations of any of said solid waste so as to constitute a menace to the health and safety, it being a presumption that such a menace exists when more than seven days have elapsed after such solid waste is originally retained, accumulated or permitted to accumulate, and nothing herein contained shall be construed to permit the retention of any solid waste which is or becomes obnoxious or offensive by reason of dust or odor or which attracts insects or vermin.
2. 
No volatile liquids, explosives, radioactive material or containers which would explode upon contact with heat or fire shall be placed for collection, except small (retail-sold) spray cans.
3. 
No hazardous waste shall be stored or placed for collection on residential properties except for small quantities of such waste normally found in the household and available on a retail basis to the homeowner.
4. 
In accordance with the Pennsylvania Municipal Waste Planning, Recycling and Waste Reduction Act, P.L. 556, Act 101 of 1988, 53 P.S. § 4000.101 et seq., after September 26, 1990, no yard wastes containing solely leaves, leaf waste or other material consisting primarily of dead leaves may be placed for collection by any person unless the leaves or leaf wastes are to be composted.

1. 
Every person shall provide sufficient approved containers for receiving and holding solid waste. Residential property owners within the Township will be required to use said containers for receiving and holding solid waste as well as for placing of same at curbside for collection by the authorized collector.
2. 
Garbage (food waste) and rubbish shall be stored in a container which shall have a tight-fitting cover, have suitable handles, be watertight and flyproof, and be able to be carried easily by the collector.
3. 
Garbage (food waste) shall be drained of liquids and wrapped securely in paper before being placed into the container.
4. 
Containers shall be kept tightly covered at all times. Rubbish which is too bulky to fit in the container shall be broken up so as to fit or may be securely tied in bundles not to exceed 50 pounds in weight nor three feet in length and placed next to the containers at the curb.
5. 
Containers shall be of not less than 20 gallons or more than 35 gallons in capacity for residential properties, except in a case where a waiver is granted by the Township.
6. 
Container shall be stored on the owner's property.
7. 
When mechanical bins or detachable containers are in use, they shall be easily accessible to the collection vehicle.
8. 
All solid waste shall be stored in containers, except yard waste and newspapers, magazines or books.
9. 
Yard waste may be placed next to containers if it is tightly secured, not more than four feet in length, no more than 20 inches in diameter, and not more than 45 pounds in weight.
10. 
Newspaper and magazines must be tied securely or placed in cardboard boxes or other suitable containers with a maximum weight of 50 pounds including container.
11. 
The Township specifically reserves the right to modify and to specifically provide for some other receptacle for the handling of solid waste which the Board of Supervisors may at some future time deem to be acceptable, appropriate and beneficial for handling of said solid waste material.

1. 
The Township shall collect solid waste acceptable for collection or it may contract with authorized collectors to provide the service. Homeowners may choose to contract directly with a collector who is licensed under the provisions of § 20-109 of this part[1] only if the Township does not collect residential solid waste or if the Township does not contract with an authorized collector to provide the service.

2. 
The collector shall provide service to all who desire service and have paid the required fees.
3. 
Collection requirements. All institutional, commercial and industrial solid waste shall be collected as often as required by generated volumes and environmental problems.

1. 
All vehicles used for collection of solid waste shall be equipped with compacting devices or equivalent types of closed bodies and shall have enclosed cargo space, unless such collection is done by private individuals from solid waste generated on private property, at which time appropriate containers shall be utilized and all other provisions of this part affecting such collection shall be adhered to.
2. 
It shall be unlawful to collect, haul, transport or convey solid waste in open, unclosed vehicles, unless such refuse is hauled from private property by the owner; except that open-type vehicles may be used only for collection of large items of debris which cannot, because of size, be collected by ordinary means in accordance with the provisions of Subsection 1.
3. 
All trucks or other vehicles used for collection and transportation of municipal waste and/or source-separated recyclable materials must comply with the requirements of Act 97 and Act 101 and the Department regulations adopted therein, including 25 Pa. Code Chapter 285, Subchapter B, regulations for the collection and transportation of municipal waste.
4. 
The collector shall furnish proof that he is the owner of the vehicle(s) to be used or he must produce in writing a lease or rental agreement between the title owner of the vehicle(s) and the collector.
5. 
Vehicles and equipment shall not be overloaded so that garbage or trash may spill or drop on the highways or streets, nor shall the equipment be so designed or maintained so as to permit the leakage of fluids. All trucks shall be regularly cleaned and kept in proper condition and shall bear the name and address of the contractor plainly visible on both cab doors.
6. 
All vehicles shall be inspected by a designated agent of the Township for compliance with the provisions of this part prior to the issuance of any license and shall thereafter be inspected every year on or before the anniversary date of said license.
7. 
Each truck shall be manned by at least one driver and one helper, except as approved by the Board of Supervisors, e.g., special collection vehicles, or under emergency conditions.
8. 
Each truck shall have at least one broom and shovel to clean up refuse that may be spilled or otherwise scattered during the process of collection.
9. 
The collector shall file with the Board of Supervisors a list of all vehicles and equipment with identification information thereon. Change in equipment shall be promptly reported to the Board of Supervisors so that at all times its records will be correct and accurate.
10. 
The collector, at his expense, shall store and park the equipment at a convenient and lawful place. No trucks or equipment may be parked or stored on any street within the Township, except during actual collection periods.

1. 
All storage of solid waste after collection and before disposal shall only be in transfer stations which conform to the regulations of the Commonwealth of Pennsylvania, the County of Bucks and the Township. The only exception shall be full or partially full collection vehicles which have made a final pickup for the day. In no case shall such collection vehicles be permitted to hold solid waste longer than 24 hours.
2. 
All plans and specifications for transfer stations shall be submitted for approval and permit issuance to the Township, the County of Bucks and to the Commonwealth of Pennsylvania. A permit must be received from the commonwealth before operation commences.
3. 
All storage of solid waste in transfer stations shall be limited to no more than 48 hours.
4. 
Operators of transfer stations must submit to the Township a contingency plan for the disposition of solid waste which is not able to be removed from the site within 48 hours because of an emergency situation.

1. 
It shall be unlawful for anyone to collect, dump, process, destroy, bury or otherwise dispose of solid waste within the jurisdictional limits of the Township except at facilities approved and permitted by the Township, the County of Bucks and the Pennsylvania Department of Environmental Protection.
2. 
All collectors shall dispose of the solid waste from the Township at a processing and/or disposal facility approved and permitted by the Pennsylvania Department of Environmental Protection and designated in the Bucks County Municipal Waste Management Plan.
3. 
The specific disposal site shall be designated by the Township in its contract and/or licenses with collectors.
4. 
All disposal regulations at the designated disposal site shall be adhered to by the collector(s).
5. 
All vehicles used for collection shall use, insofar as practical, state highways when proceeding to and from the designated disposal site, except when using roads or streets in those townships or boroughs where licensed to collect.

1. 
All solid waste processing shall be accomplished by approved methods in properly permitted facilities, including, but not limited to, incinerators, compost plants and salvage operations conforming to all the applicable laws, ordinances and zoning requirements.
2. 
All plans and specifications shall be approved by the commonwealth prior to the construction and operation of such processing facilities.
3. 
All incinerators shall be operated so that pollution of the air will not exceed the air quality standards established by the Pennsylvania Department of Environmental Protection.
4. 
Residues or discards from the processing facilities shall be disposed of at the Pennsylvania DEP-permitted facility.

1. 
It shall be unlawful for any person to scavenge any materials delivered and deposited for disposal except as may be provided for in the Township's solid waste rules and regulations promulgated under this part.
2. 
It shall be unlawful for any person to salvage or reclaim any solid wastes except at a properly permitted facility in which salvage is an integral plan of operation.
3. 
It shall be unlawful to make garbage available for animal consumption unless such refuse has been heat-treated to kill any disease agent therein.
4. 
It shall be unlawful for any person to use, maintain or operate an open dump.
5. 
It shall be unlawful for any person to burn any solid waste except in a manner and under conditions prescribed by the Coordinator, and such burning shall be in accordance with the pertinent rules and regulations of the commonwealth.
6. 
It shall be unlawful for any person to throw, place or deposit, or cause or permit to be thrown, placed or deposited, any solid waste in or upon any street, alley, sidewalk, body of water, public or private property, except as provided in this part.
7. 
It shall be unlawful for any person to allow any abandoned vehicle to remain upon any public property more than 48 hours or on private property with an expired vehicle license. Salvage yards, specially licensed historical vehicles, and those vehicles screened from sight shall not be considered abandoned.
8. 
It shall be unlawful to collect commercial trash between 6:00 p.m. and 6:00 a.m.

The collection of solid waste in the Township and the disposal thereof shall be subject to such further reasonable rules and regulations as may from time to time be promulgated by the Board of Supervisors and administered by the Township Manager or an authorized representative of the Township Manager; provided, however, that no such rules and regulations shall be contrary to the provisions of this part or applicable law.

1. 
All containers, vehicles, equipment, transfer stations, disposal sites, books and records of authorized, unauthorized or prospective collectors, storers, processors and disposers are subject to inspection by the Township Manager or his authorized agent at any reasonable hour without prior notice.
2. 
Vehicles and equipment of collectors shall be inspected by the Township Manager or his authorized agent before being put into operation and during operation.
3. 
All solid waste storage, transfer, processing or disposal facilities within the Township shall also be inspected immediately prior to commencement of operation of the site and at least once per year thereafter in concert with representatives of the commonwealth.
4. 
If violations of this part are discovered in the course of these inspections, the Township Manager or his authorized agent is empowered to enforce this part.

Prior to the operation of any solid waste storage, transfer, processing or disposal facility within the Township, the applicant shall be required to present evidence of insurance coverage in an amount required by Pennsylvania DEP.

The Board of Supervisors may petition the Court of Common Pleas of Bucks County for an injunction, either mandatory or prohibitive, to enforce any of its decisions.

1. 
Any person, firm or corporation who shall violate any provision of this part, upon conviction thereof in an action brought before a Magisterial District Judge in the manner provided for the enforcement of summary offenses under the Pennsylvania Rules of Criminal Procedure, shall be sentenced to pay a fine of not less than $100 nor more than $1,000 plus costs and, in default of payment of said fine and costs, to a term of imprisonment not to exceed 90 days. Each day that a violation of this part continues or each section of this part which shall be found to have been violated shall constitute a separate offense.
2. 
The Board of Supervisors shall have the right, at any time, and without refund of any part of the license fee, to suspend or revoke the license of any authorized collector for any of the following causes:
A. 
False or misleading statements in the application for a license.
B. 
Lapse or cancellation of insurance coverage.
C. 
Collecting or transporting refuse in a careless or negligent manner resulting in dirt, odor or any unsanitary condition.
D. 
Failure to deposit solid waste at a DEP-approved disposal site in compliance with all disposal regulations in force at the approved site.
E. 
A violation of any part of this part or any other ordinances of the Township, or any applicable state or county laws.
3. 
A fee shall be required for the collection of solid waste and recyclable materials, and said fee or charge is hereby imposed upon each residential property in the Township of Lower Southampton. Said fee shall be paid by the owner, owner's agent, and/or occupant of said residential property on an annual basis. Fees for collection of solid waste and recyclable materials shall be billed to each residential property on or before April 1 of each calendar year, and payment in full must be made within 60 days upon receipt of said notice. All accounts shall be considered delinquent if not paid by the 30th of June in each calendar year. All delinquent accounts are subject to stoppage of service without notice. The stoppage of service is heretofore authorized for nonpayment of collection charges and shall be in addition to the right of Lower Southampton Township to proceed for the collection of such unpaid charges by a civil action, criminal action or in any other manner provided by the law for the collection of a municipal claim. In addition, all expenses related to the legal pursuit by the Township for the collection of such unpaid charges shall be deemed to be recoverable from the nonpaying party. The above penalty shall be in addition to any penalties suffered as a result of any Township action taken under § 20-118 and Subsection 1 of this section.

All licensed collectors and licensed waste haulers shall promptly report any significant changes in the collection vehicles or equipment covered under the license and any changes in insurance coverage to the Township.

It shall be a requirement that all private collectors participate in the Bucks County Municipal Waste Documentation Program as provided in Subsection 4 herein.
3. 
All licensed collectors and licensed waste haulers shall maintain current, up-to-date records of the collected municipal waste and/or source-separated recyclable material within Lower Southampton Township. Such records and collected volume reports shall be subject to review by and made available to the Township or its authorized agents upon written request.
4. 
All licensed collectors and licensed waste haulers operating within Lower Southampton Township shall participate in the Bucks County Municipal Waste Documentation Program. Said program shall be developed and put into operation by the County for the purpose of documenting the origin of municipal waste and source-separated recyclable material and the ultimate disposal point of said waste and recyclables. As part of the program, each licensed collector and licensed waste hauler shall prepare and submit a semiannual report to Lower Southampton Township. The report for the first half of the year (January through June) shall be submitted on or before July 31, and the report for the second half of each year (July through December) shall be submitted by January 31 of the following year. At a minimum, the following information shall be included in each report:
A. 
Total weight of municipal waste and source-separated recyclable materials collected from all sources within the Township during each month of reporting period.
B. 
Name of each processing and/or disposal facility used during the reporting period and total weight of municipal waste and/or source-separated recyclable materials delivered to each facility during each month of the reporting period.
C. 
Name of each processing and/or disposal facility used during the reporting period and total weight of municipal waste and/or source-separated recyclable materials delivered to each facility during each month of the reporting period.
D. 
Any other information determined to be necessary during the development and implementation of the Bucks County Municipal Waste Documentation Program.
5. 
All semiannual reports submitted to the Township from licensed collectors and licensed waste haulers shall be submitted by the Township to the County by August 31 (covering January through June) and by February 28 of the following year (covering July through December).
