No person shall sweep, throw, deposit or dump or allow or permit
any servant, employee or person in his or her charge to sweep, throw,
deposit or dump any ashes, dirt, stone, brick, straw, hay, grass,
grass clippings, weeds, leaves, chips, shavings, garbage, trash or
rubbish of any kind, or any water or liquid of any kind except for
cleaning purposes, into or upon any street, sidewalk, gutter, public
square or park in the Village, except for Village leaf collection
purposes.
A.
No person shall sweep, throw or deposit, or allow or permit any servant,
employee or person in his or her charge to sweep, throw, or deposit,
any ashes, dirt, stone, brick, leaves, grass, weeds, or any other
debris or rubbish of any kind; or any water or liquid of any kind
except for purposes of cleansing same into any public highway, street,
gutter or public place or upon any sidewalk within the Village.
B.
No person shall throw, put, push, or place or allow any servant,
employee or person in his or her charge to throw, put, push or place,
any snow or ice into any public highway, street, public place or thoroughfare
in the Village. Any person who shall violate this provision shall
also be responsible for any damage or injuries incurred by the Village
or any person.
C.
This section shall not apply to water or liquids running into streets
as a result or firefighting or flushing of fire hydrants by authorized
personnel or the use in a reasonable manner of ashes, salt or other
material for the purpose of reducing the hazard of, or providing traction
on snow, ice or sleet or as hereinafter provided.
No person shall carry or transport garbage, swill, ashes or
any offensive substance over the streets or highways within the Village
of Old Brookville without a written permit from the Board of Trustees
of the Village nor unless the cart, truck or other vehicle used for
this purpose is watertight and equipped with a cover of adequate size
and material at all times, except when loading or unloading, spread
entirely over the garbage, swill, ashes or other offensive substance
in transportation. Said permit shall be revoked by the Board of Trustees
at any time upon its being satisfied that the person in possession
of the same is unfit to carry on said activity in the Village or upon
his conviction for the violation of any provision of the Village Code
or of the regulations of the County of Nassau or of the penal or sanitary
code of the State of New York.
