A Zoning Board of Appeals is established by resolution of the
Town Board pursuant to Town Law § 267. The number of Zoning
Board of Appeals members and Chair shall be at the discretion of the
Town Board.
A.
Legislative
intent. The purpose of this section is to provide the Town of Penfield
with greater flexibility in appointing the most qualified persons
to become or continue to serve as members of the Penfield Zoning Board
of Appeals.
B.
Terms of
office of members first appointed. Notwithstanding any provisions
of any section of law to the contrary, in the creation of a new Zoning
Board of Appeals or the reestablishment of terms on an existing Zoning
Board of Appeals, the appointment of each member to said Board shall
be for a term not to exceed three years. Each member's appointment
and term of office shall be made by resolution of the Penfield Town
Board.
C.
Supersession
of state law. This section is intended to supersede any contrary provisions
contained in Town Law § 267.
The Zoning Board of Appeals, consistent with the provisions
of the Town Law applicable thereto, shall determine its own rules
of conduct and procedure.
