A Planning Board may be established by the Town Board pursuant
to Town Law § 271. The number of Planning Board members
and Chair shall be at the discretion of the Town Board.
A.
Legislative
intent. The purpose of this section is to provide the Town of Penfield
with greater flexibility in appointing the most qualified persons
to become or continue to serve as members of the Penfield Planning
Board.
B.
Terms of
office of members first appointed. Notwithstanding any provisions
of any section of law to the contrary, in the creation of a new Planning
Board, or the reestablishment of terms of an existing Planning Board,
the appointment of each member to said Board shall be for a term not
to exceed three years.
C.
Supersession
of state law. This section is intended to supersede any contrary provisions
contained in Town Law § 271.
