By the authority granted to it under §§ 60.23(2), 66.0801, 66.0805, 66.0819, 66.0827 and 196.01(5), Wis. Stats., the Town of Lawrence hereby creates the Town of Lawrence Utility District.
By the authority granted to it under § 66.0827, Wis. Stats., the Town of Lawrence hereby dissolves the Town of Lawrence Sanitary District.
A. 
Combined Utility. The Town of Lawrence Utility District shall operate as a combined Water and Sewer Utility.
B. 
Assumption of Sanitary District assets, liabilities and functions. The Town of Lawrence Utility District shall immediately take over all assets, liabilities, and functions of the now dissolved and former Town of Lawrence Sanitary District.
C. 
Utility District boundaries. The boundaries of the Town of Lawrence Utility District shall be identical and coexistent with the boundaries of the Town of Lawrence.
D. 
Utility District Commission. The Town Board of the Town of Lawrence shall serve as the Commission of the Town of Lawrence Utility District, and the Town Clerk/Treasurer of the Town of Lawrence shall serve as the Clerk of the Town of Lawrence Utility District and Commission. The Town of Lawrence Town Board has the authority to select other members to serve as the Commission of the Town of Lawrence Utility District. Control of the Sewer and Water Utility systems for the Town of Lawrence Utility District is vested in the Town of Lawrence Town Board; all records, minutes, and all written proceedings thereof shall be kept by the Town Clerk/Treasurer; the Clerk/Treasurer of the Town of Lawrence shall keep all the Utility District's financial records.
E. 
Utility District general powers. The sewer and water utilities of the Town of Lawrence Utility District shall have the power to construct sewer and water lines for public use and shall have the power to lay sewer and water pipes in and through the alleys, streets, and public grounds of the Town and, generally, to do all such work as may be found necessary or convenient in the management of the Town of Lawrence Utility District sewer and water systems. The Town of Lawrence Town Board shall have power, by itself, its officers, agents, and servants, to enter upon any land for the purpose of making examination or to supervise in the performance of its duties under this chapter without liability therefor, and the Town of Lawrence Town Board shall have the power to purchase and acquire for the Town all real and personal property which may be necessary for construction of Utility District sewer and/or water systems or for any repair, remodeling, or additions thereto.
F. 
Condemnation of real estate. Wherever any real estate or any easement therein, or use thereof, shall in the judgment of the Town of Lawrence Town Board be necessary to the sewer or water system, and whenever, for any cause, an agreement for the purchase thereof cannot be made with the owner thereof, the Town of Lawrence Town Board shall proceed with all necessary steps to take such real estate easement or use by condemnation, in accordance with the Wisconsin Statutes.
G. 
Title to real estate and personal property. All property, real, personal, and mixed, acquired for the construction of a Sewer or Water Utility system, and all plans, specifications, diagrams, papers, books and records connected with said sewer and/or water system, and all buildings, machinery and fixtures pertaining thereto, shall be the property of the Town of Lawrence.

Headings. The headings set forth in this chapter are for convenience only and shall not be used to interpret or construe the provisions of this chapter.
B. 
No limitation on authority. Nothing stated within this chapter shall in any way limit or restrict any additional authority or power granted to either the Town of Lawrence or the Town of Lawrence Utility District under applicable Wisconsin law.
