The Town Board finds that the key elective positions within
the Town of Tully would benefit from a longer term of office so as
to provide for greater constancy, continuity and efficiency for the
Town. These positions require a great amount of experience, skill
and knowledge, and therefore, a longer term is needed. New York Municipal
Home Rule Law § 10(1)(ii)(a)(1) permits local governments,
including towns, to enact local laws regulating the terms of office
of their officers and employees so long as those laws are consistent
with the Constitution and general state law. It is the purpose of
this article to expand the terms of office for the Town Supervisor,
Town Tax Collector and Town Highway Superintendent from two years
to four years.
The terms of office of the Town Supervisor, Town Tax Collector
and Town Highway Superintendent are hereby increased from two years
to four years commencing with the term which begins January 1, 2016.
All local laws or ordinances or parts of local laws or ordinances
in conflict with any part of this article are hereby repealed. In
particular, pursuant to Municipal Home Rule Law § 10(1)(ii)(d)(3),
this article is intended to supersede that portion of New York Town
Law § 24 which provides for a two-year term of office for
the Town Supervisor, Town Tax Collector and Town Highway Superintendent.
